Cutting through the fog
You all know how I feel about the Wall Street Journal editorial board’s muddle-headedness on immigration. It’s all the more frustrating because the board remains a beacon on other vital national security issues. The newspaper’s editorial today on the Supreme Court rulings is the best analysis I’ve read. It recommends that Congress do its part by consolidating the probable flood of Gitmo cases in a single court, corrects the media misperception that Justice O’Connor stood unequivocally (ok, when is she unequivocal about anything) against the Bush administration’s position on enemy combatants, and makes clear that the court opened the door to military tribunals–a point which I picked up on yesterday.
The board concluded:
All in all, the Court stepped away from the chaos of making judges the arbiters of American security. That’s a welcome victory for the Presidency, no matter who wins in November.
Agreed.
Update: Also a good ongoing and more in-depth discussion of the cases at the Corner between Jonathan Adler and Mark Levin.
Update II: And interesting stuff at The Volokh Conspiracy.
