February 1993, Boston Globe: “The US Senate dealt President Clinton his first legislative defeat yesterday, voting to write into law the Bush administration’s policy prohibiting people infected with the AIDS virus from immigrating to the United States. The defeat came despite Sen. Edward M. Kennedy’s spirited battle in defense of the president’s commitment to lift the prohibition. The Senate voted, 76-23, to prevent people infected with the HIV virus, which causes AIDS, from immigrating, after defeating by a 56-42 vote an amendment by Kennedy that would have kept current federal policy in place for 90 days but left Clinton free to change it after that. Kennedy accused the Republicans of both racism and partisan mean- spiritedness.
Voting for the prohibition were Sen. Joseph I. Lieberman, Democrat of Connecticut; Sen. William S. Cohen, Republican of Maine; Sen. John F. Kerry; Sens. Judd Gregg and Robert C. Smith, Republicans of New Hampshire; Sen. John H. Chafee, Republican of Rhode Island; Sen. Claiborne Pell, Democrat of Rhode Island; and Sen. James M. Jeffords, Republican of Vermont.

He also flip flopped on the issue of the Israeli security fence. In Oct. 2003, he told the a group of Arab-Americans that he opposed the fence. Yet now he supports the fence (and disagrees with the International Court ruling), saying it is vital to Israel’s security.
Is the date on the second piece wrong? February 2003 makes no sense, as the piece talks about a “first legislative defeat” for President Clinton. Should this be February 1993?

Wait a second! He changed his position over the course of eleven years?!?! Why, you’d think that he reviewed the issue some time between 1993 and 2004 and come to the conclusion that the prohibition was wrong!
Since some of your readers like lumping people of what they perceive as like political persuasions, let me pose this question: given that Kerry allgedly “flip-flopped,” with an eleven-year gap between the “flip” and the “flop,” on the prohibition, would you say it’s fair to consider Bush’s shift from a refusal to offer North Korea incentives to disarm to a willingness to offer them, in the span of less than two years, a “flip-flop?” Maybe you should also address his dismissal of peace summits as a means of addressing the Israeli/Palestinian conflict, followed by a 180-degree shift the next year.
The “flip/flop” strategy works in particular instances, I think, but for discerning voters, it must be laughable to see any major politician riding the charge that their opponent is inconsistent.
Also, as a minor technical note, if “flip-flop” is an expression of temporal linearity, with “flip” denoting the first action, and “flop” as the action that follows, then what you describe in this entry is a “flop-flip.” You so crazy, Michelle.
I don’t understand. Is he looking to lift the ban to temporarily give HIV positive people a set amount of time to be in the country so we can host a conference (and then they leave) or is he looking to lift the ban in it’s entirety? It’s not clear from what is posted.

Noah – ahhh, the old “well you’re guy does it too” defense. John Kerry flip flops on issues so much that it’s become a bit of a joke even on the left. Bill Clinton was the master of telling each group exactly what they wanted to hear, but Kerry doesn’t have the personality to talk out of both sides of his mouth and get away with it. (That’s a compliment to your candidate, so don’t get mad.)

Marshall, in an election, you tend to vote for a candidate based on a perceived superiority over his or her rivals. You know, you COMPARE them. If people wish to make Bush out to be a better candidate than Kerry because of Kerry’s “inconsistency,” particularly when it comes to policy shifts over the course of a decade (a decade, for Mel Gibson’s sake!), then it’s only fair to note that “their guy” speaks on both sides of an issue, too, and within much smaller, and arguably less justifiable, spans of time.

Noah is right on this one. A span of several years is enough to have review the issue and change a position. After all, most democrats start off being pro-life and after years of pro-abortion money review the issue and decide the baby really is nothing more than a lump of tissue.

Discrimination? Every country has the right to set its immigration standards whether it be illiteracy, age, cost to taxpayers, etc. Immigration isn’t a right. Unconstitutional to whom? The immigrant? They aren’t subjects of the US Constitution. And if a country and its taxpayers decide that a costly and communicable disease requiring intense medical management for a person’s lifetime isn’t desirable, so be it. Or do you naively think that most immigrants arrive here with private insurance in place?

Noah,I agree that people can change their positions but comparing a static position with a non static situation to defend you argument is intellectually dishonest. What specifcs are different now in the HIV/immigrant issue than they were 10 years ago. I don’t think comparing that issue to the ever evolving North Korea situation or the ME situation is even close to a logical comparison.
Kerry is a flip-flop because he has the mind of an academic- i.e. he sees all sides of an issue and will expound forever on all the nuances. Problem? Can’t decide which of the ten thousand truths that he knows is the central truth.
Bush has the mind of a leader. See the center of the problem and act on it.
So what’s the big deal? All they have to do is enter illegally like everybody else, and they will be protected by all of the “sanctuary” policies in force by local governments and medical facilities around the country. Then they can live here without fear and get free medical care to boot.
If Kerry explained why he changed his position, it would make him look like less of a flip-flopper (flop-flipper to you, Noah). Odds are he’d just deny ever having supported the ban or find some dissembling way to pass off his previous vote. Either way, I’ll just crack open a beer and enjoy the show.
Just a quick question, what kind of pork fat was tacked onto this bill. I’m not gonna go digging for it, but it’s a matter of public record that nearly every bill that goes to the hill has a lot of fat attached. And many times, bills get voted against for the fat that’s on it, not the content of the bill. It’s a common tactic on both sides of the aisle that if a Bill they don’t like rolls through to tack stuff onto it that will either get it more votes, or take away votes. Without more information, this really isn’t a flip flop IMHO. Just more white noise.
Was this the only vote on this specific issue? I can’t believe this didn’t come up again sometime after 1993.

Ten years (plus) later, he’s changed his mind on one aspect, but the overall motivation and sentiment has never wavered.

Jesus, the term “unconstitutional” gets thrown around so much anymore it has almost lost meaning. It has become a buzz word, used to the point of desensitizing people to it. I used to consider questions of constitutionality to be of prime importance. Now it doesn’t even turn my head. Hell, obviously some people think you don’t have to be a tax-paying citizen of the United States, or even currently residing in the United States to be protected by its mandates.
