Breaking: Criminal contempt motion against Nifong to be filed
WRAL reports:
Defense attorneys for three Duke lacrosse players are expected to file a motion Friday asking a judge to enter criminal sanctions against disbarred Durham prosecutor Mike Nifong.
Nifong was disbarred June 16 by a State Bar disciplinary committee for his handling of the Duke lacrosse rape case. The committee unanimously agreed with the Bar on 27 of 32 charges, including the most serious allegations — that Nifong’s actions involved “dishonesty, fraud, deceit and misrepresentation.”
Three men — Reade Seligmann, David Evans and Collin Finnerty — were charged with rape, sexual assault and kidnapping in connection to an off-campus party in March 2006. All charges against the three were dropped in April 2007 after the state Attorney General Roy Cooper declared them innocent.
If the motion is granted, Nifong could face a possible fine and/or jail time.
While we’re on the Duke case, reader Maurice sent me a heads-up on a galling headline in the local Duke Chronicle last week:
“Duke announces settlement with indicted laxers.”
Writes Maurice: ‘How about “Innocent Laxers’ or ‘Wrongly Indicted Laxers’ or even ‘Vindicated Laxers?’ If we needed a further example of how the media contributed to the injustice to which these gentlemen were subjected, this is it. The Chronicle’s editors should print a retraction and issue an apology for continuing to slander these three upstanding young men.”

Mr. Nifong needs to go to jail, go directly to jail, do not pass go and do not collect $200.
I hope he gets a 350 lbs, tattooed, missing afront tooth cellmate named Bubba who thinks he looks “purdy cute”
The newspaper should print an apology, and the “gang of 88″ should indivually write letters of apology to the three students. Think there’s much chance of that?
One of these shameful liberals, the department chairwoman of cultural anthropology, actually set up a whole class presuming the Duke lacrosse players were guilty. On the syllabus it said, “What does the lacrosse scandal tell us about power, difference, and raced, classed, gendered, and sexed normativity in the U.S.?” (source: American Enterprise Institute http://www.aei.org/publications/filter.all,pubID.25759/pub_detail.asp)
Better question: What does it tell us about liberals running our universities?
If I were the players, I would sue Duke.

They can’t sue. They already reached a settlement in lieu of a lawsuit.
Nifong and the “gang of 88″ both deserve to be sued. It may set a standard whereby those that accuse must be held accountable for slander, libel and downright dirty politics for personal puposes.
Tsk…tsk…tsk…poor Nifong. I’m sure fellow inmates will EMBRACE ‘Mikey’ with open arms should he be convicted.
I hope they put him under the jail.
It’s funny how Nifong is not being nearly as villified as were the 3 young INNOCENT boys who’s lives were devastated by his greedy need to retain political power.

My gut says lock him up but my mind says lets not go so far that legitimate cases can’t get the attention they deserve because DA’s are too fearful.
With all of the damage that this man has done to these 3 kids, and the way the evidence was handled, kind of makes me wonder IF he has not done this before.
I called this one from the beginning. Nifong was a DSR (Democrat Seeking Reelection) Whenever there’s a DSR involved, you can be sure there is chicanery afoot.
When you consider that Nifong an “officer of the court” was trying to jail these people for rape when he knew the charges were false, jail would not be to much. I wonder how many others are innocent and sitting in jail.
Next up, what about the perp?
Funny…In all the stories circulating, what’s missing is the (D) behind Nifong’s name…As if it weren’t relevent.
Nifong tried to follow the Standard Liberal Playbook: It is the severity of the charges, not the actual proof of guilt that is important. He hoped that just the indictment of these three innocent young men would be enough to railroad them into jail. Can you imagine what would have happened if these guys didn’t have the means to defend themselves??? He needs to spend some time in a cell to ponder his despicable actions.
So…what about the accuser?? She gets off scotfree?
Why does the accuser get a pass? Criminal charges should be filed against her for a couple of reasons.
First: She broke the law by falsely accusing these men.
Second: Filing charges against the accuser would hopefully dissuade people from falsely accusing someone for hopes of a big payday in the future.
Denmother, the settlement only covers actions taken before a certain date. If the good prof conducts a course where the premise is that the 3 laxers did indeed assault and/or rape the “dancer”, I think they could bring suit against Duke and the prof, as this is after the cutoff date in the settlement.
Oh, almost forgot…What about the head coach that was fired because of this woman’s lies? What recourse does he have? I think he’s at least got a pretty good case against Duke.
Pressler reached a settlement with Duke a few weeks ago.
Who, aside from opportunistic lawyers, really benefits from these situational ethics battles? The greatest threat to our judicial system comes from within. Will “Judge” Roy Pearson be penalized, even disbarred, for his egregious legal abuse of the D.C. Korean immigrant dry cleaners? At least the Duke lacrosse players are young enough to eventually recover.
The victims of Nifong must make him pay for ruining their lives, whether by throwing him in jail or by obtaining a large monetary compensation or both. Disbarment and losing his job is hardly enough.
As for the alleged liar “victim-accuser,” charges must be pressed against her as well.
Are we a nation of laws or not? Are laws applied equally to everybody, regardless of race or color?
Where are the “reverends” Jackson and Sharpton?
Can’t see them anywhere when injustice is done by Blacks to Whites.

I think I know the answer.
Unfortunately, Nifong’s conduct is not unique among prosecutors, so it would be a mistake to scapegoat him for all the perversities of the criminal justice system. Instead, a thorough look at how business is done is greatly needed to prevent any more miscarriages. Too often, the plea bargaining system is used by lazy and/or corrupt prosecutors to score cheap and easy victories over the innocent. Here’s an idea for our Hostess with the Mostest: New York’s governor Eliot Spitzer led a charmed life when he was attorney-general even though his use of threats and intimidation to win plea deals were standard operating procedure. His record needs to be examined. I’ll be she would turn miscarriages comparable to Nifong.
I lived in NC for a number of years, and I see this not entirely about politics and race: Nifong, a local yokel, saw an opportunity to lock up three priviledged Yankee boys while pandering to the locals. They’re still fighting the Civil War down there and I see this as proof. Red state or not, they don’t like us Yankees moving down there — the Confederacy lives!
I was disappointed that the three innocent young men decided to settle with Duke, but on the other hand as a mom myself, I can understand why they would want to get on with their lives as quickly as possible.
In a perfect world, I would have loved to see the three young men and their lawyers tell Duke and the Gang of 88 to publish a public apology, and only then, after reading it, if it met their standards, would they even consider accepting the settlement with Duke.
We can only dream….

So why isn’t there a Gang of 88 rushing to explain to us what this case of prosecutorial misjustice tells us about the problems in our justice system? Are they basing class lectures around that topic? Are they putting this on their syllabus? Certainly, this verified example of injustice opens the door for a wide-ranging discussion of race, money, class, and the law that would benefit almost any liberal arts classroom.
Oh, wait, this isn’t the discussion they want to have. It doesn’t satify their narrow-minded viewpoints. It doesn’t justify their overhyped programs. And they don’t have any privileged oppressors to blame for this situation except Nifong and, well, themselves.

I understand where you’re coming from, but rape isn’t funny. That our society
acceptsencourages it as a simple fact of life in prison says something very, very unflattering about us.We should be trying to put an end to such barbarity. To stop joking about it is a required first step.
I think we’re a long way from that. All he had to do was follow procedure and he would OK right now.
Like others, I also wonder how many other people he has done this too. I think Crystal Gail Mangum should also be taken to task as well. She’s done this before to three other guys but guess they were of the same race so no harm no foul in someone’s book-not mine but she’s getting away with it again.
As for the gang of 88, I thought I read where the gang leader bugged out and went to some other school to do the same thing to someone else. I’m sure the gang of 88 won’t apologize because in their world, like Nifong’s they’re sure something happened in that restroom.
As for Nifong, I hope he goes to jail as well but won’t hold my breath.
Criminal charges need to be brought against this guy. Its not just incompetent work on his part, he knowingly did the things he did. They need to make him pay in civil court and he needs to have criminal charges brought as well……he tried to destroy these kids’ lives.
They also need to go after Jessie Jackson and Al Sharpton in civil court for slander and defamation of character!
James Felix it wasn’t ment as a joke. One of the unmentionable deterents to jail (besides the confinement) is that horrible things happen in prison.
This country holds together because we the people for the most part have at least some faith in the system. We even “forgive” the rich for getting off with good lawyers because if we were accused and were rich we could do the same. What we will not tolerate is when the government does knowingly does something like this.
Mike Nifong deserves every horrible thing that happens to him up to and including a visit late at night from “bubba”.
I live in the beautiful, but corrupt state of NC - overtaxed and paralized by Democrats in power. Our hope was rekindled by John Edwards defeat as Senator and now Nifong (and everyone involved) are revealed for the kind of people they are. Prosecutors Sutton and Fitzgerald should be next.
Damn! I must have missed the statements by Jesse and Al. You know, the ones correcting their earlier accusations. Can someone please post them…
Just a thought… I want to throw Nifong under the bus as much as everyone else, and, until now, I have been. Yet, he hasn’t been convicted formally as of today; to my knowledge, he hasn’t even been booked. Everybody who’s settling or is about to get sued regarding this case can tell us that chances are very small (really, really small but not zero) that we could be making their same mistake right now.
OK, enough of that. Assuming a conviction, I’ll be right there with all the rest of us in, figuratively speaking, throwing him under the bus. In the meantime, may his trial take every bit as long as the limbo through which he put these three guys… that suffering might even be worse than the jail itself.
