As I noted this morning, it’s not looking good, but it is not over.

12:07pm. The card-check cloture vote is still going on. On the House side, Rep. Pete Hoekstra released this statement:”A growing majority of House Republicans are uncomfortable with the product and process of the Senate immigration bill,” Hoekstra said. “A public hearing has never been held on it, and it was crafted in secret by only 12 senators and two cabinet officials.” The text of the Hoekstra resolution is as follows: “Resolved the House GOP Conference disapproves of the Senate immigration bill.” The Republican Conference temporarily suspended debate during a meeting this morning due to time constraints, but he expects the Conference to address it at a meeting scheduled for this afternoon. “We believe that a workable and effective immigration bill is an important objective, but the underlying Senate bill is bad public policy,” Hoekstra said. “We need to focus on border security and a legal identification process before anything else. The bill is the wrong answer and the wrong way to solve the problem of illegal immigration.”

11:49am. Time for the H.R. 800 card-check cloture vote.

11:40am. Reid is bashing “Big Business” over the card-check bill–the same Big Business that is behind the shamnesty Reid and the Grand Schemers want to ram down our throats. Now, he’s extolling the shamnesty process. Talks about his Sunday visit with the president. “This is not a Democratic bill. They understand that. We had a Democratic bill last year. It died. This was a bill negotiated in good faith with total support of the president.” Points out lopsided Dem vs. GOP support for shamnesty. “We need 25 Republicans to support us in this matter.

11:35am. Breaking from Senate floor coverage for a second during resumed quorum call: I’ve just received the latest salvo from GOP senators who asked Harry Reid for a fair amendment process (background here). Here’s the letter (click for full size), which notes that while the Senate GOP agrees with the “clay pigeon” strategy, the ball is in Reid’s court to set up a process that doesn’t cherry-pick amendments and block others:

11:30am. Quorum call. Classical music time! That was quick. Blech – here’s Mitch McConnell. He’s addressing the card-check bill and urging opposition.

11:22am. Mike Enzi points out that both bills being debated right now (the union card-check bill and the shamnesty bill) have not gone through the proper process and have not gone through committee. I believe he just said he could spend 30 hours debating the card-check bill. Hoo-boy.

11:11am. Ken Salazar parrots the “it’s not perfect” talking point about shamnesty. Lists the fantasy enforcement provisions. Parrots the “jobs Americans don’t want” line and crusades for the “undocumented workforce.” I hope Byron Dorgan is going to speak soon. Oh, no. Groan. It’s Kennedy again. Will he sing his Spanish anthem on the floor? Not yet. He’s reading profiles of union members harassed by Eeevil Management.

11:05am. Hearing that Norm Coleman’s press guy told Laura Ingraham that Coleman will side with shamnesty and vote yes on today’s cloture motion. Will he play the “voted against it before I voted for it” card later this week?

11:00am. Teddy Kennedy is yelling, claiming that “security is out the window” unless shamnesty passes. Sherrod Brown interrupts to talk about the union bill. Jim Geraghty thinks Judd Gregg is irked.

10:54am. John Cornyn is up. (Rough transcipt) — I’ve argued that the current bill sets up the DHS for failure because it requires them to grant approval of Z visa applications for full travel/work authorization within 24 hours even if background check not complete. Cornyn attacks White House for calling that “mythology.” Cornyn quotes the bill. White House is not telling the truth. “My concern is the gulf between the promise being made to the American people and the likelihood that the prommise will be carried out.” Why…has nothing been done about 600,000-plus absconders already? Can they build exit system? Can they process 12 million applicants? Can they detain those caught on the border?

10:48am update. Sen. Sessions is on the floor now talking about shamnesty. He notes the small amount of time that has been allocated to address the bill (he’s got 4-5 minutes). “Yes, we need to reform immigration…but the bill we are going to vote on will not do that.” Gives a reminder of 1986 amnesty disaster and the recent CBO report analyzing legislation on the table, which contains “loophole after loophole.” Notes the doubling of legal immigration on top of the anticipated increase in illegal immigration the bill would usher in. Touches on impact on skilled workers, drop in income. “The American people do not like this bill. Our phones are ringing off the hook.” Urges vote against cloture. Runs out of time.

10:36am. Agh. Joe Biden is on the Senate floor blabbing. Where is my mute button?

10:00am Eastern. Senate debate has begun. There will be some action on union-related bills. Procedural votes on those and the shamnesty are scheduled for 11:50am.

Not so bad news: Senior Hill sources say our side will pick up more votes than the last cloture go-around–continuing the trend of eroding support for Bush-Kennedy as time passes and more light is shed on the Grand Scheme. The insiders say your phone calls and activism have made a difference, and that they will be needed even more between this morning, when the cloture vote on the motion proceed happens, and Thursday, when the cloture vote on the overall bill takes place.

As I reported last night, you can hate Harry Reid all you want, but ultimately, the hands of the White House and the GOP Grand Schemers are responsible for agreeing to this god-awful approach to ramming a bad bill through the floor, short-circuiting the committee process, and larding up the package with fantasy amendments to buy off the wafflers.

Republican leaders will have to answer for this.

I’ve stopped contributing to National Republicans and have made it known that I will never again support any pol who has not, does not or will not close the borders. Each time I receive a phone solicitation, I tell them that. If they send me a postage paid envelope asking for money, I send it back with a pre-typed explanation of how Nat Repubs stance on immigration has lost them my support. Lately I’ve also sent one or two Gringo De Mexico Bush bucks.

    It’s very discouraging. Not enough politicians or government officials are willing to act in the best interests of our country, or even listen to their constituency on this issue. They have their own agenda and will advance it against the wishes and bests interests of the American people. I really don’t what else to do.

    DO NOT stop paying your taxes. If they think (and all they have to do is think) you owe, the IRS will come after you. I should know. I even proved I did not owe and – I paid. Not a good idea to tout even as mad as I am right now.

    This has become more than a boarders/complexion of America issue. This is now also a matter of corruption in the way Reid is using his power. If he ultimately succeeds, the effect on democracy in this country could be prfound for decades to come.

Another trigger is the hiring of 4,000 additional border patrol agents, but the agents don’t have to be trained or stationed at the border. Yet another trigger that must be met before allowing illegal aliens to apply for greencards is the establishment of an Electronic Employment Verification System. But, employers don’t have to use the system until up to three years after the date of enactment.

    Mr. President,

    I would like to talk about the immigration bill, or what is known as the Grand Compromise. It’s no secret that I’m concerned about this bill, and that in my opinion, it contains an amnesty program for every illegal alien in the United States.

    Not too many Senators today can say they voted for the 1986 amnesty bill, known as the Simpson-Mazolli Act. I did. At the time, I was led to believe that it would solve our problems. But the bill was not only short-sighted, it was unworkable. It was soft on enforcement, and weak on legal reforms. We believed that a legalization component was in the best interests of the country. The American people – myself included – thought that illegal immigration would decline with an amnesty program. Evidently, we were wrong. The 1986 bill failed us.

    So, this body is back to put another Band-Aid on the problem. I don’t blame the American people for being angry, or rejecting the promises that some are making that we’ll enforce our laws from now on. They don’t have any faith in us, and I’m here to say that the “trigger” won’t convince anyone either.

    I’ll get to the amnesty program in a few minutes, but first, I’ll address the so called Trigger that’s included in the substitute. The trigger says that the “Y” and “Z” visa programs would be subject to a trigger.

    Let’s talk about Trigger. This chart shows “Trigger,” the cowboy actor, Roy Rogers’, horse. He’s coming in handy these days. He first galloped into the Chamber during the budget resolution. He’s back for immigration.

    You can see from the chart that Trigger is a pretty impressive looking horse. He looks big and strong, and probably can help do some chores around the farm. I’m sure my grand kids would ride Trigger if they knew he was safe to ride.

    He looks safe, but we can’t trust Trigger. Neither can we trust the trigger in the Grand Compromise. It’s false and misleading.

    I’ve heard members of this body talk about how amnesty won’t start until after the Trigger is pulled. Well, its says on page 2, that “with the exception of the probationary benefits” the “Y” and “Z” visa programs cannot start until certain actions items are completed.

    So, 12 million illegal aliens will apply and likely get a probationary card. This card gives an alien a work authorization, social security number, and protection from removal. That’s problem number one! Amnesty is given away before we even get to the Trigger.

    I’ll talk about four of the key actions that the trigger requires.

    Frist, it requires the establishment of an Electronic Employer Verification System. I’m a champion of this concept. In fact, I wrote Title three last year. It could be a very solid enforcement tool. But the trigger only says it needs to be established. It says nothing about requiring all businesses to use it. Under the compromise, employers wouldn’t be forced to use it until up to three years after the date of enactment.

    Second, the trigger says that 18,000 Border Patrol agents have to be hired. According to Department of Homeland Security officials, we already have 14,000 agents. So, the trigger requires that 4,000 more are hired. Sure – we can hire these agents. But the trigger doesn’t require the agents to be trained and stationed along the borders.

    Third, the trigger says we have to construct 370 miles of fencing. I understand this construction is currently underway. The Congress authorized 700 miles of fencing in the Secure Fence Act of 2006. We also provided billions of dollars for fencing and infrastructure last year. Why doesn’t the trigger require that all 700 miles have to be constructed?

    The trigger also says that DHS needs resources to detain up to 27,500 aliens per day on an annual basis. The problem is that these spaces are already full today. How do these trigger actions add to our present day enforcement efforts?

    Fourth, the trigger requires the United States to end the “catch and release” practice. Maybe it’s late breaking news to some around here, but we ended that practice. Secretary Chertoff was on TV, telling the world, on August 23rd of last year that he ended “catch and release.”

    However, further along in the bill it says that OTMS – Other than Mexicans – can be released into our communities on a $5,000 bond. The policy of “catch and release” won’t end. This part of the trigger is false and misleading.

    There’s a lot missing from the trigger.

    For example, title one of the compromise has border security requirements, but they aren’t in the trigger. The bill requires the Department to have a National Border Security Strategy and Surveillance Plan. One would think that a plan is necessary right away in order to secure the borders, not after the trigger is pulled.

    The trigger doesn’t include authorizations for a number of Homeland Security personnel. While the bill requires the Department to hire more investigators for alien smuggling and more interior enforcement personnel, these requirements are not parts of the trigger. I think before an amnesty starts, we should require interior enforcement measures to be met. Our national security is not just a border issue.

    Finally, I think the trigger should include something that we’ve been trying to do since 1996. After the first attacks on the World Trade Center, Congress enacted a law that required an entry and exit system to track all foreign travelers. This is known as the U.S. VISIT program.

    We had to endure another attack in 2001 before people took the entry/exit system seriously. We got it partly implemented, but the Administration decided, on its own, that the exit portion wasn’t worth the cost. So, the 1996 mandate still remains ignored.

    After 10 years, we in Congress are still pulling teeth trying to get an implementation schedule out of the bureaucrats. It’s laughable. And, we should be ashamed.

    This trigger isn’t legitimate or worthy of Roy Rogers’ support. It’s only a cover-up for amnesty.

    The cloture motion I supported today was to move ahead with the debate on the immigration bill. This is the first of many votes that we will take on this bill. I did so because the immigration crisis facing our country is too important to be ignored and I think we in the Senate have a responsibility to address it. Nevertheless, I believe work needs to be done to improve this bill.

    Coleman can be had if we can find out what a “dealbreaker” would be for him. Some enterprising soul from Minnesota might want to call and sound out his staff on that.
