12:07pm. The card-check cloture vote is still going on. On the House side, Rep. Pete Hoekstra released this statement:”A growing majority of House Republicans are uncomfortable with the product and process of the Senate immigration bill,” Hoekstra said. “A public hearing has never been held on it, and it was crafted in secret by only 12 senators and two cabinet officials.” The text of the Hoekstra resolution is as follows: “Resolved the House GOP Conference disapproves of the Senate immigration bill.” The Republican Conference temporarily suspended debate during a meeting this morning due to time constraints, but he expects the Conference to address it at a meeting scheduled for this afternoon. “We believe that a workable and effective immigration bill is an important objective, but the underlying Senate bill is bad public policy,” Hoekstra said. “We need to focus on border security and a legal identification process before anything else. The bill is the wrong answer and the wrong way to solve the problem of illegal immigration.”
11:49am. Time for the H.R. 800 card-check cloture vote.
11:40am. Reid is bashing “Big Business” over the card-check bill–the same Big Business that is behind the shamnesty Reid and the Grand Schemers want to ram down our throats. Now, he’s extolling the shamnesty process. Talks about his Sunday visit with the president. “This is not a Democratic bill. They understand that. We had a Democratic bill last year. It died. This was a bill negotiated in good faith with total support of the president.” Points out lopsided Dem vs. GOP support for shamnesty. “We need 25 Republicans to support us in this matter.”

Breaking from Senate floor coverage for a second during resumed quorum call: I’ve just received the latest salvo from GOP senators who asked Harry Reid for a fair amendment process (background here). Here’s the letter (click for full size), which notes that while the Senate GOP agrees with the “clay pigeon” strategy, the ball is in Reid’s court to set up a process that doesn’t cherry-pick amendments and block others:

11:22am. Mike Enzi points out that both bills being debated right now (the union card-check bill and the shamnesty bill) have not gone through the proper process and have not gone through committee. I believe he just said he could spend 30 hours debating the card-check bill. Hoo-boy.
11:11am. Ken Salazar parrots the “it’s not perfect” talking point about shamnesty. Lists the fantasy enforcement provisions. Parrots the “jobs Americans don’t want” line and crusades for the “undocumented workforce.” I hope Byron Dorgan is going to speak soon. Oh, no. Groan. It’s Kennedy again. Will he sing his Spanish anthem on the floor? Not yet. He’s reading profiles of union members harassed by Eeevil Management.
11:05am. Hearing that Norm Coleman’s press guy told Laura Ingraham that Coleman will side with shamnesty and vote yes on today’s cloture motion. Will he play the “voted against it before I voted for it” card later this week?

11:00am. Teddy Kennedy is yelling, claiming that “security is out the window” unless shamnesty passes. Sherrod Brown interrupts to talk about the union bill. Jim Geraghty thinks Judd Gregg is irked.
10:54am. John Cornyn is up. (Rough transcipt) — I’ve argued that the current bill sets up the DHS for failure because it requires them to grant approval of Z visa applications for full travel/work authorization within 24 hours even if background check not complete. Cornyn attacks White House for calling that “mythology.” Cornyn quotes the bill. White House is not telling the truth. “My concern is the gulf between the promise being made to the American people and the likelihood that the prommise will be carried out.” Why…has nothing been done about 600,000-plus absconders already? Can they build exit system? Can they process 12 million applicants? Can they detain those caught on the border?
10:48am update. Sen. Sessions is on the floor now talking about shamnesty. He notes the small amount of time that has been allocated to address the bill (he’s got 4-5 minutes). “Yes, we need to reform immigration…but the bill we are going to vote on will not do that.” Gives a reminder of 1986 amnesty disaster and the recent CBO report analyzing legislation on the table, which contains “loophole after loophole.” Notes the doubling of legal immigration on top of the anticipated increase in illegal immigration the bill would usher in. Touches on impact on skilled workers, drop in income. “The American people do not like this bill. Our phones are ringing off the hook.” Urges vote against cloture. Runs out of time.

10:00am Eastern. Senate debate has begun. There will be some action on union-related bills. Procedural votes on those and the shamnesty are scheduled for 11:50am.

Bad news of the morning: All signs point to a win for shamnesty today. Not so bad news: Senior Hill sources say our side will pick up more votes than the last cloture go-around–continuing the trend of eroding support for Bush-Kennedy as time passes and more light is shed on the Grand Scheme. The insiders say your phone calls and activism have made a difference, and that they will be needed even more between this morning, when the cloture vote on the motion proceed happens, and Thursday, when the cloture vote on the overall bill takes place.
As I reported last night, you can hate Harry Reid all you want, but ultimately, the hands of the White House and the GOP Grand Schemers are responsible for agreeing to this god-awful approach to ramming a bad bill through the floor, short-circuiting the committee process, and larding up the package with fantasy amendments to buy off the wafflers.
Republican leaders will have to answer for this.

First: SECURE THE BORDER. Second: Admit immigrants in the order they applied. Third: deport the law breakers. Yes, this would amount to all the illegals, who are trespassers and/or invaders. Which leads back to: SECURE THE BORDERS. That is the first order of business for elected officials, and it’s the one thing about which every elected official is derelect in his duty. SECURE THE BORDER. ADMIT IMMIGRANTS IN THE ORDER THEY APPLIED AND WERE VETTED. DO NOTHING ELSE UNTIL THESE TWO ITEMS ARE COMPLETELY COMPLIED WITH. THIS IS THE WILL OF THE PEOPLE.
IOW: The only fair ‘immigration’ reform is to tell the trespassers to “get in line”.
One thing that TOTALLY STINKS is the bush-kennedy-reid-mccain amnesty bull sends all the foreign invaders TO THE HEAD OF THE LINE.

Just called my two iowa senators…grassley is a confirmed NO vote….but Harkin’s office says he has not told his staff how he intends to vote.
Umm….shouldn’t a senator’s staff always know how the senator they represent will be voting on legislation? I told his staff, the Harkin better get this right, or he is finished in Iowa.

Sometimes the people in the office will ask for a Zip Code, be ready and have one before you call, that way you can say where in their state you live. As a last line in the sand, everyone needs to write their representative and state in no uncertain terms, that should they vote for this bill, they will be VOTED OUT OF OFFICE in the next election. This needs to be made crystal clear, to Republican and Democrat alike.

My senators are among the most corrupt in the nation. Menendez and Lautenberg. The only problem Menendez has with the bill is that it doesn’t let enough family members in. He has an amendment pending to increase the points allowed for extended family members.

In other news…….Finally got through to one of Brownback’s state offices. Told them how disgusted I was that his D.C. mailbox was full and the fax was turned off. The guy was pretty snitty telling me that it’s not intentional, that they are being inundated with calls and faxes. Cluebat anyone?!
Michelle, Thanks so much for the links to the Senators to contact re the cloture vote on “amnesty”. And, thank heaven for Google “Auto Fill” which fills out the dang forms with one click. This entire process is a microcosim in what is wrong with our government……….and would be interesting if it weren’t so acutely serious. I am praying that our elected officials remember who they represent……but I am not holding out much hope.

I’m pretty disappointed in Kit Bond – he’s saddling the crappy legislation with an amendment guaranteed to kill the bill when the actual vote comes around. Either he’s too spineless to vote ‘no’ on cloture (and perhaps too spineless to vote ‘no’ at vote time, preferring to let others sink the bill for him), or he’s playing some political angle only he knows about.
Forget the 202 numbers. I have been getting through now to all but Brownback by using numbers from the middle of the lists.
Suggestions: Be polite. Be pithy. Be firm.
And keep trying until you get all of them. By the way, only Webb’s and Cochran’s offices asked it I was a constituent. I told them I wasn’t but was calling because it was a matter of national importance.

Just got an email response from Coleman. After about 5 paragraphs of patting himself on the back he states:

I actually spoke to a female and this is what I said;
“Tell Mr. Burr that the Conservatives in NC will not elect nor re-elect him to anything IF he supports one iota of any shamnesty bill”

She thanked me. Guess she’ll need tranquilizers to get through all the angry callers!

This is what is just so incredibly baffling to me. Bush needs what little political capital he has left for upcoming war funding votes, yet he is choosing to piss it away on this incredibly stupid amnesty which almost nobody outside Washington wants.
By forcing Republicans to walk the plank on this, it’s going to be harder for him to ask Republicans to walk the plank on funding an unpopular war, no matter how necssary it is.
Meanwhile, this issue has become a total win-win situation for democrats. If amnesty somehow gets defeated, it’s a defeat for Bush, as he’s squandered what little political capital he has left while alienating his base to the point of divorce. And if amnesty passes, he’s just handed democrats millions of new voters, guaranteeing Republican minority status.

After the Demos swept into control of Congress, I had no doubt they would reveal themselves for what they truly are, and display such incompetency and stupidity that they would completely alienate the electorate in the two years to follow. Looks like I was quite right on that point.
But I didn’t anticipate the Republicans would display an equal degree of stupidity and complete disrespect for their own constituents. They are destroying the party, and the only hope they had of regaining control.

I’d Said the Senate Has Some ‘Splainin’ to Do. Why Did They Keep Saying That Nothing Happened Until The Border Was Secure?
Kris Kobach is a lawyer, former Assistant Attoryney General and professor of Immigration studies.
He says this:
The comprehensive immigration bill before the U.S. Senate (S. 1639) has been roundly and justly criticized for what it would do up front: grant immediate amnesty to virtually all illegal aliens now in the country and jeopardize U.S. national security. However, these difficulties are only half of the problem. S. 1639 would also create a legal morass that entangles immigration courts, as well as newly created administrative courts, for years to come.
Background
S. 1639 would grant immediate amnesty (in the form of a “probationary” Z visa) to 12-20 million illegal aliens. According to Section 601 (f)(2) of the bill, the amnesty must begin within 180 days after the bill is signed–no border enforcement triggers need to be met. Under Section 601 (h)(1), the bill allows the government only one business day to conduct a background check to determine whether an applicant is a criminal or terrorist. Unless the government can find a reason not to grant it by the end of the next business day after the alien applies, the alien receives a probationary Z visa.
That’s your tough new immigration bill. Wow! That’s tough! Waiting a whole day!
The 24-hour requirement is particularly inexplicable, considering that the ombudsman for U.S. Citizenship and Immigration Services (USCIS)–the agency that would implement the amnesty–recently released a report revealing that, even without the tripling of the workload that the amnesty will bring, FBI name-checks on aliens seeking benefits routinely take 90 days or more to complete.
The entire bill was a sham. They knew they could not do background checks. So they would just be passing out visas like candy, to every terrorist or criminal who asked for one.
The bill would give amnesty to people who had been caught, and had been ordered deported, and who skipped out, ignoring every semblance of law:
The amnesty under S. 1639 extends even to absconders–fugitives who had their day in court, were issued an order of removal by an immigration judge, and ignored the order. Approximately 636,000 absconders now roam the country, having defied the law twice–first when they broke immigration laws and again when they ignored the removal orders. That number has grown by an average of 68,184 a year from September 2003 to September 2006.
Not only that, but the new law would allow these guys to stay anyway, if they claimed they had a family, and that sending them back would work an “extreme hardship” on their family. Guess what Democratic judges would do, when faced with such claims? Everyone of these guys would get to stay:
Section 601 (d)(1)(I) of the bill would allow USCIS to grant Z visas to absconders, provided that the recipient can demonstrate that his departure from the United States “would result in extreme hardship to the alien or the alien’s spouse, parent or child.”
The flexible term “extreme hardship” has long been the subject of interpretation in immigration law. For more than 30 years, courts have wrestled with its meaning. Extreme hardship can include consideration of the alien’s age, health, length of residence in the United States, family ties in the United States and abroad, position in the community, financial status, occupation, and possibility of other means of adjustment of status, immigration history, as well as the political and economic conditions of the alien’s home country. It is a fact-intensive inquiry into circumstances that vary from case to case.
The bill not only allows the absconder to obtain amnesty if he can show extreme hardship to himself, but it also allows him to receive amnesty if he demonstrates that his removal would cause extreme hardship to his spouse, parent, or child. This is a wide loophole.
For example, immigration attorneys representing absconders could argue that, if any member of an absconder’s family is a U.S. citizen, that family member must remain in the United States, and then the separation of family members would constitute extreme hardship.
The bill rewards the worst people, and punishes the good ones:
Perhaps most troubling is the fact that this offers a massive reward to aliens who have defied immigration courts. Successfully fleeing justice can win absconders the most generous visa ever created, as well as de facto permanent residence in the United States. Aliens who obeyed their removal orders and left the country, however, are not eligible.
The new bill would encourage every illegal to game the system:
S. 1639 would triple the workload of an agency that is already at the breaking point. The vast majority of amnesty applications would be approved after receiving only a few minutes of scrutiny.
Moreover, virtually every denial will be appealed for two reasons. First, the alien has nothing to lose by pursuing an appeal, and second, the alien cannot be deported while his amnesty application is pending. Even if only 1 percent of the 12 million-plus amnesty applications are denied, that is at least 120,000 appeals.
The bill encourages massive document fraud:
Few employers of unauthorized aliens in the fruit and vegetable fields keep such detailed records. The bill gets around this problem by allowing the alien to offer an “inference” rather than actual documentation. To meet this burden of proof, the alien can offer evidence to show that he worked the required hours or days “as a matter of just and reasonable inference.” In other words, the alien could present or even fabricate a pay stub for one day’s work at the end of the season and simply assert that he was in the fields for the entire season.
The bill gives PERMANENT EMPLOYMENT to some illegals. They simply cannot be fired.
. Permanent Jobs for Agricultural Workers. S. 1639 offers an especially sweet deal for illegal agricultural workers once they obtain their Z-A visas. In Section 622 (b), the bill states, “No alien granted a Z-A visa may be terminated from employment by any employer during the period of a Z-A visa except for just cause.”
Employers who dare to fire newly legalized aliens holding Z-A visas would do so at their own peril. The bill would creates yet another administrative court system to review complaints by Z-A agricultural workers “who allege that they have been terminated without just cause.”
The bill is a complete disaster. These are not Senators, these are buffoons

I think it is his scheme to try appeasing POTUS and the People. Vote for cloture to make POTUS happy but poison the water with an amendment that leads to ultimate defeat. When I called his offices, his staffer stressed that there will be 2 cloture votes which lends some little credence to this supposition.
I stressed that if Bond votes yes for any cloture or for the final bill that I will vote no for him in any future election. The staffer was shocked that this is so important to me. I pointed out that this issue is that important to the survival of this nation and that it will be a decision maker for my next vote.
Where is Gregg right now? “Yes” vote or “No” vote? I don’t think he was very clear.

This is insane to say the least. I was able to finally get through one of Senator Burr’s offices and the person that answered the phone sounded indifferent.
I also stressed the fact that I’m a registered Republican and that I would not hesitate to vote for a Democrate, if he voted to cloture on this bill, the reply that I got was that I’ll pass this on to Senator Burr.
I hope that he reliazes that after 2010 he won’t be in office any longer.

I have written you twice now. I also called your office this morning to find out how you intended to vote on the cloture motion for the Amnesty Bill.
I was told you hadn’t announced, which seemed fishy to me.
My suspicions confirmed a minute ago when I called your office after the vote and found out you voted for cloture.
You know very well that the bill is now in an easy position to pass, so spare me the “I voted no later” line.
You have failed your NH citizens. You have failed our LEGAL immigrants, you have failed our border security. You have failed me, my wife (who is a LEGAL immigrant), you have failed my family, my friends, my community.
You will not only NOT be receiving my votes, or my money, but neither will the Republican Party of NH.

I have attempted to call both my Senators and the RNC however they are all busy and I say lets keep calling them day and night for the next two days until the next cloture vote comes up and make their lives as miserable as they have made ours today. Not one dime ever again to the RNC I will send my donations direct to any conservative candidate that runs against any of the yea voters.
Just called my state party headquarters and told them to take me off the donation and volunteer list. As I was on the phone I shredded my voter registration card, I guess being a tax paying veteran means nothing anymore. I am so sick right now I just want to stick my head out of my window and let out a scream that would scare small animals ….
We need a new Conservative party in this country and we need to throw out the Bush gang now. I voted for the guy twice, now I would support his impeachment with every fiber of my being. Laura Ingraham called his office on her show to implore him to vonte “no”. SHe THe staffer who Laura spoke to left Laura on hold for about 15 min. and eventually came back to tell her that Coleman was not available and suggested Laura leave a voice mail.
This really ticked Laura off as she gave him huge support on her show in getting him elected.
What does that say, when a supposedly Coservative Republican runs away from a popular National talkshow host live on the air, who has given him plenty of coveragee in the past when it suited him.

We’re in a worldwide war with a host of enemies that employs asymmetric warfare, so the obvious solution is to leave our borders porous, grant legal status to millions of people we know nothing about and not go through the inconvenience of building a wall.

Okay I agree – but let’s wait until the vote on the actual bill takes place.
This was a vote on cloture after all and I suspect some Senators will actually vote against the bill who voted for cloture.
How is that possible? Some Senators are into the traditions of the Senate and see voting against invoking cloture as against the spirit of the rules. Others wish the debate to continue for other reasons. The point is, while it seems almost certain that the bill will pass, let’s not target anyone specific until they’re on the record supporting this travesty with their actual vote on the measure.

IF they were with us today, the leftists in Congress and their abettors in the MSM would have emasculated them. We’ve already seen what they have done and continue to do to our current military leaders who show even the merest hint of being like Grant or Sherman.
You should add Pryor, D-AR, to the list of those who “jumped ship.” He was one of the Dem’s who voted for cloture on 6-07, if I’m not mistaken. Maybe he can be turned for the second cloture vote. I’m from AR, and I will certainly be letting him know I’m not happy with his vote.
Print out this list and put the names of these Repubs were you can see it every day: Bennett, Bond, Burr, Coleman, Collins, Domenici, Ensign, Gregg, Lott, McConnell, Murkowski, Snowe, Stevens, Warner, Brownback (R). Donate to their opponents, regardless of party (It’s better to have a “D” after liberals, anti-Americans, commies and traitors). Make sure Sam Brownback never gets a single vote in any Presidential primary. These are the folks who sold out our country on June 26, 2007, a day that will live in infamy!! There needs to be investigations here. Who took bribes? How much did Lott get from his gaming industry friends?

I am done with Bond. I am hopeful that the House Republicans will come through for us. A bill made in secret and not allowed in committees should be showing red flags to everyone. It’s appalling. It’s a bill that can’t stand the light of day. Shameful. Just shameful.
