Chuckie Schumer admits: He’s an idiot…more: “There is no doubt that we were hoodwinked”
Sen. Charles Schumer plays the “dupe” card. Yes, you can question his competency now. He admits it–he’s an idiot:
U.S. Chief Justice John Roberts and Supreme Court Justice Samuel Alito “duped” the U.S. Senate into confirming them, a top Democratic lawmaker charged on Friday, days after a key Republican questioned if they had lived up to their promises.
Sen. Charles Schumer of New York, a member of the Judiciary Committee that held hearings on the two, said they staked out moderate positions in congressional testimony but became part of a conservative bloc that issued restrictive rulings on issues from free speech to civil rights.
Schumer, in a speech to the American Constitution Society, talked about the confirmation of Roberts and Alito in 2005 and 2006, respectively.
“Were we duped?” he asked.
“Were we too easily impressed by the charm of nominee Roberts and the erudition of nominee Alito?” Schumer asked. “Did we mistakenly vote our hopes when our fears were more than justified by the ultraconservative records of these two men?”
“Yes,” he said
As penance for the Democrats’ self-admitted stupidity, Schumer is now threatening to snuff any new confirmations of Bush high court nominees. Via Politico:
ew York Sen. Charles E. Schumer, a powerful member of the Democratic leadership, said Friday the Senate should not confirm another U.S. Supreme Court nominee under President Bush “except in extraordinary circumstances.”
“We should reverse the presumption of confirmation,” Schumer told the American Constitution Society convention in Washington. “The Supreme Court is dangerously out of balance. We cannot afford to see Justice Stevens replaced by another Roberts, or Justice Ginsburg by another Alito.”
Just a reminder that Chuck Schumer was the ringleader of the appalling circus that the Alito hearings devolved into last year. The made-for-TV antics and bloviating prompted none other than Robert Byrd to take to the floor to condemn the proceedings. Remember:
Regardless of any Senator’s particular view of Judge Alito, I think we can all agree that there is room for improvement in the way in which the Senate and indeed the nation have undertaken the examination of this nominee.
Let me be clear. I mean no criticism of the chairman of the Senate Judiciary Committee or any particular member of that ccommittee. I feel compelled to address this issue. Not to point fingers. Not to scold. Not to assign blame. But only to address specific, sincere, heartfelt concerns that have been brought to my attention by the people of West Virginia in particular.
The people of West Viriginia in no uncertain terms were, frankly, appalled by the Alito hearings. I don’t want to say it, but I must. They were appalled. In the reams of correspondece that I received during the Alito hearings, West Virginians–the people I represent–West Virignians who wrote to criticize the way in which the hearings were conducted used the same two words. People with no connection to one another. People of different faiths. Different views. Different opinions. [They] independently and respectively used the same two words to describe the hearings. They called them called an outrage and a disgrace.
And these were not form letters ginned up by special interest groups on either the right or the left. These were hand-written, contemplative, old-fashioned letters written on lined paper and personal stationary. They were the sort of letters that people write while watching television in the comfort of their living rooms or sitting at the kitchen table. It is especially telling that many who objected to the way in which the Alito hearings were conducted do not support Judge Alito. In fact, it is sorely apparent that many who opposed Judge Alito’s nomination also opposed the seemingly made-for-TV antics that accompanied the hearings…
Here’s another reminder of the atrocious behavior of the Dems.
And now Schumer has the gumballs to bleat that the Dems were “duped” and “hoodwinked?”

I don’t know what happened to the sophistication of the Senate. After being called a ‘bigot’ last month, and the leading senator telling our soldiers that they are ‘losers’ though he roots against them, and now this guy saying that no matter who, he’s going to vote against – something really does need to be done.
Weren’t Senators originally appointed positions? I don’t know who they were appointed by, maybe the Governors of the states. . . but it might be a good idea to go back to that system. The senate is no longer a hall for reasoned and sophisticated gentlemanly debate as it was intended. They all pander for votes in partisan fashion like is expected in the house.
The Senator Byrd quote was dead on. He’s seen the Senate go downhill, and I’m glad he’s willing to call them out on it.

There is something strikingly loathsome about that man. A self hating jewish liberal who would pee on the Constitution to jack up his ego. Politico described him as a “powerful” senator. I was near a pig farm in NC once and there was something powerful about that, too. He is a dangerous egotistical man and threatens to unravel further the fabric of a great nation. Unfortunately there aren’t enough right thinking people in NY to remove him from office.
According to the Politico they concerned that Roberts and Alito aren’t following precedent when they said they would. Last I checked, stare decisis was one of the main reasons why it took so long to overturn Plessy v. Ferguson. I know it’s hard for Schumer to believe, but sometimes precedent shouldn’t be followed.

I am at a loss for words.
The point is that Senators should be focused on GOOD POLICY, NOT getting re-elected. Should we now start electing Supreme Court Justices too? That’s politicians choosing as well. Would you rather see the Supreme Court Justices more partisan too? We could give them term limits and have a vote.
I for one am more comfortable with how the founding fathers set up the checks and balances. If they set up voting as a privelege, it should not be a ‘right’ as it is now (not saying what the criteria should be, but too many people vote who shouldn’t – meaning they don’t know the issues – because it is their ‘right’).
If they set it up so that the Senate was an appointed position, I’m sure this was the reason. There should be a governing body not concerned with anything but good policy, and doing the right thing for the country. As it stands now, from the time they are elected, the only thing they concern themselves with is getting re-elected. They don’t care how much mud they have to sling or how ugly and hateful they have to be to get re-elected.

Theoretically and ideally, they should be one and the same, since good policy amounts to a satisfied electorate. The problem is media and the gross misuse of it, the re-writing of history and the like. The problem is that people are too corruptable as a species for that kind of theory to be expected in practice.

This was the big message in Mr Smith Goes To Washington, and that message is at least as true today. Both quotes – and I mean no offense on this – remind me of the basic flaw in socialism: to work in the real world, you basically need a human race comprised of essentially flawless personal values and an unerring determination to put the good of others ahead of themselves. That’s why capitalism works – because it’s the polar opposite of that mindset and tends, though not completely, to prove that those kinds of lofty ideals are essentially impossible with the kind of flawed human race we have on the world today. But they’re still good words, those words of yours, because people think that’s how it’s supposed to be, and that’s good because it maintains what little shame this society has left, and that’s a bit of a good policing mechanism for our elected officials, anyway.
I believe Schumer is one of the most dangerous people in America. That guy is a nut case, but you have to give him credit for speaking out loudly and passionately for what he believes. The Republicans mostly act like wimps with little passion, The Republican senate caucus is full of people like Arlen Specter, George Voinovich, Olympia Snowe, Chuck Hagel, Lindsey Graham, John McCain, Mitch McConnell, etc. who don’t embrace traditional conservative values.
God forbid we have judges on the SCOTUS that actual understand the US Constitution better than the famous legislator-from-the-bench Judge James Munley over the wishes and laws of the community of Hazelton, PA on the illegal invasion of their community. Then again what do you expect from a Clinton appointee. I guess that 4 year disagreement between some of the Confederate States and the Federal Government in the 1860s had absolutely nothing to do with “States Rights.”

Maybe the framers of the US Constitution were right in only wanting land owners to vote, because they had the most to lose. You have to take a test to drive a car why not make potential legal voters take a civics test to vote?

Ok, I think it was clear that both Roberts and Alito were conservatives. As Scalia pointed out, those two, unlike him, overturn precedent and pretend they haven’t done so.
Like it or not, the President gets to pick nominees to the SCOTUS when vacancies arise. The way for liberals to change it is to win Presidential elections.
Other than that, I don’t understand MM’s point. The hearings are a joke, but whose fault is that? There are rules that say you cannot ask questions about a case that may be heard by the SCOTUS, but that includes almost anything–the law is dynamic. For that reason, the hearings are a joke. It has nothing to do with what party is in power.

So, if it is appropriate to hold hearings to see if a nominee to the US SC has misrepresented their position in testimony, Shouldn’t hearings be held as to candidates, running for office, who misrepresented their positions to the electorate?

The judiciary is how liberals intend to insulate themselves from election results, overturn the will of the people, and maintain liberalism despite what people voted for in referendums around the country.
If a judicial nominee doesn’t indicate they will toe the liberal line on the bench, their life will be invaded by opposition research political hacks, and their reputation smeared. No holds barred, no sympathy for families. They will completely carpet-bomb your life. It’s rank intimidation, that’s all.

A lot of what underlies BDS is the bizarre love/hate relationship that today’s donkey party has with George W. Bush.

Anything bad – anything – can within six steps of “logic” be dot-to-dot connected to that man. I’ve heard it proposed and rationalized that he was responsible for the earthquake and tidal wave in the Indian Ocean three years ago.

By manipulating George Bush like a ventriloquist’s dummy, these nefarious characters can bamboozle even the most wary donkey; accordingly, when they make fools of themselves, they can always escape responsibility for it.
It’s kind of like the MasterCard commercials:
- Being able to call George Bush a knuckle-dragging, drooling, imbecilic fascistic Adolf-wanna-be: Smarmy.
- Being able to make a buffoon of yourself, and claim that George Bush tricked you into it: Indispensable.
- Being able to do call upon either of the above at will, with no sense of self-irony: Priceless.

On the other hand, the same Jekyll/Hyde qualities they find so handy are a simultaneous source of considerable fear and hatred. Think about it: If you were confronted with somebody so apparently wicked that you’d have trouble distinguishing him from the Anti-Christ – and who, alone or in league with his far more dangerous handlers, is literally capable of committing any imaginable evil – wouldn’t you be scared of him? Wouldn’t you hate him?
Not that it’d be justified… there’s a couple of words representing two important planks of BDS: “Paranoia” and “Superstition.”
You can see both on display with Schumer’s remarks. His irrational fear of his nemesis nominating another conservative Justice, is coupled with the alternative-reality based superstition that getting Roberts and Alito confirmed could only result from his abusing/manipulating the confirmation process.

That reminds me of a press conference I saw in the year 2000. It was the Russian Navy “answering questions” from the press after the Kursk disaster. There was an Admiral at the podium, and the mother of one of the Kursk sailors confronted him in front of the press, demanding answers about the fate of her son.
If this were a U.S. Navy Admiral, he would have gotten her answers for her. One term limit for senate at 6 years. Then you’re out. House: one 4 year term and you’re out. Make them crawl on their bellies as lobbyists if they want to be “on the Hill”.

Professor J. Scott Armstrong of Wharton (bet with Al Gore that Al declined) has written on Competitor Orientation and how he believes it can hurt the firm. Not to stretch it too much, or put words in his mouth, but experiements show that many people will choose the irrational position of say, reducing their own firms profits (as opposed to a second choice of greatly increasing their profits) if it damages the competition. They do this even if the choice has no long term competitive advantage. It’s sort of a we got them this time mindset. If people are wired that way – and apologies to the Prof for using his research as he may not have intended – it would explain why Schumer and his ilk would be willing to be Dupes, idiots, lied to, continuously befuddled by the Bush/Rove Master/Blaster duo (i.e. reducing their own “profitability” – as in 10% approval ratings). It’s a case of “we don’t care what it does to our party or nation (the firm), as long as it damages the other party (competitive firm/same nation).” The good of the nation (firm) has no bearing on their decisions as long as they see only a competition between parties.

I tend not to use the word “evil” to describe the rational, calculating forces that are at work in the world.

Their reason leads them to evil ends.

Why else would anybody use the marvel that is the global forex market to take down the currency of a country and bring people to their knees (Thailand)?

The House passed the bill Friday on a 371-40 vote, a day after the Senate passed it 85-8. The White House said the president would sign it.
The legislation would shift money to high-risk states and cities, expand screening of air and sea cargo and put money into a new program to ensure that security officials at every level can communicate with each other.
Its passage ranks among the top accomplishments of the 6-month-old Democratic Congress. Republicans would say it’s one of the few.
“We will have done in six months what previous Congresses failed to do for almost six years,” said Pelosi, D-Calif.

Some of you ask how us New Yorkers could elect Schumer. Last year, we elected Eliot Spitzer governor and compared to him, Schumer is a paragon of ethics. Last week, Spitzer got caught (or at least his aides got caught) trying to use the state police to smear the Republican majority leader of the state senate. Now, it looks like Watergate all over again, with questions of “What did Spitzer know and when did he know it?” freely thrown around by the media. I’m surprised our hostess hasn’t picked up on this, since Spitzer has been touted as the next attorney-general if a Democrat got elected president.
I’ll have to google him!

The fault is in the process of RE-ELECTION RULES – and the American people could fix that if they decide to NOT DEPEND on CONGRESS to fix election flaws.

We are talking about the regulation of *Criminal* behavior: lying, deceit, fraud, bribery and money laundering.
Allowing long-term office holding discourages grassroots candidacies and encourages incumbent racketeering.
Disrupting Stasis, Steady State,Status Quo or The Mess We’re In requires creating a system that deprives criminals of their havens.
In addition to re-election rules and term limits, I would further advocate the implementation of transparency laws which include putting all earmarks, and the papertrails which build them, on the Internet for public review.
Pelosi Galore and company just passed a law for public oversight of earmarks,but you have to travel to DC and visit the offices of each Porking Committee, must review records under the eye of Congressional staffer, and cannot make any copies of documents.
I’d like to hear more about the re-election rules change process, OmbreRose, from your perspective.
