Defending Stanislav Shmulevich

By Michelle Malkin  •  July 31, 2007 10:07 PM

Many of you have asked how you can contribute to/help the defense of Stanislav Shmulevich, the former Pace University student being charged with felony hate crimes for putting copies of the Koran in a campus toilet on two occasions last fall.

Charles Johnson at LGF has an update:

The latest news on the Stanislav Shmulevich Koran-dunking “hate crime:” Mr. Shmulevich now has a legal team, and two LGF members are on it. His defense is being prepared.

The team intends to act pro bono (without charge to Stan), but in any case like this there will be substantial legal expenses unrelated to the attorneys; so they are also planning to set up a transparent fund to receive donations from interested parties. When that’s established I’ll post more details.

Must-see: Christopher Hitchens battles CAIR over the case. Video here.

And more legal analysis from Allah, Megyn Kelly, and Eugene Volokh.

The flush to judgment continues. Where’s the ACLU?

Good to go. It will be hard to fight CAIR’s enormous budget and political influence, but every victory for the rights of free Americans is a good one and the proper precedent needs to be set from the start.

SWJ: “Where else would they be?” Great question! We know the answer. It certainly isn’t defending Americans. That would be too American.

The only way that this incident can be prosecuted as a “hate crime” is if the courts in New York decide that expressing anger over an ideology by desecrating one of its symbols is the equivalent of making violent threats against a specific person or group of people.

If that happens, then New York will have set a dangerous precedent for the erosion of freedom of speech in this country.

And since there should be no legally discernible difference between the act of defecating on a Koran and submerging a Crucifix in a jar of urine, Andres Serrano had better find a good attorney.

MikeOK-I agree with you regarding serrano’s work of art, but there is always a double standard in treating various religious groups.

In short: Christians and Jews are very-very-very BAD. muslims, athesists, agnostics and satanists are to be treated as GOOD.

Ask any Christian who has faced legal trouble in this country for defending their beliefs or reputation. I know Naval Hospital Corps School comes to mind!

I think this guy would have a lot more support from the media and the ACLU if only he was an illegal immigrant. Seems they have more rights than law abiding legal citizens these days.

When the evidence is presented, it will be apparent that this Koran was trying to commit suicide. The same thing happened to me when I was target practicing one day. That book just jumped right in front of my target. Not a thing I could do.
Like me, Shmulevich was just in the wrong place at the wrong time.
On a different note, if he was the owner of the book, there is no standing for a case here.
ACLU needs a new venue - Haiti sounds good.

I think the copies of the Koran were owned by the university. So this case should rightfully be considered an incident of vandalism - a slap on the wrist and a small fine.

Put into this meditation room at taxpayer expense? Were bibles (King James and the one the Catholic church uses), a book of mormon, and torah also provided by the university at taxpayers expense?

This is another issue, but it should be looked into.

Let me get this straight,Michelle…as I understand it,the koran in question belonged to Pace University…and if that is the case, what other books owned by the University would result in a ‘hate crime’ charge if tossed in the can?…and if this is indeed a ‘hate crime’, does that mean that Pace University is now a member in good standing of the protected ‘victim class’?

There is no mention of this case at all on the ACLU’s page. Given some of the other tripe they are concerned with, you’d think they’d have room to voice at least SOME opinion.

But of course, they seem to conveniently lack opinions and motivation unless the religious folks being offended are Christians (even though I’m not religious, I can recognize that this is happening. . .that’s how bad it is).

While that did raise an eyebrow with me at first - fair and rational thought dictates that we don’t jump to conclusions about that.

Just because the investigating detective MAY be Muslim ( which we don’t know ) - doesn’t preclude him from being fair.

If that were the case, would we then have to remove a Catholic investigator from a crime against a Catholic? Or have a black investigator recuse himself from a white on black crime?

Let’s stay focused on what we know and not make a jump without knowing the facts or without evidence of retaliation.

Where’s the ACLU? They’re probably conferencing with CAIR on sentencing strategy. Does anyone know if this law has been tested for constitutionality? It’s obviously a free speech issue, but then again the Supreme idiots did hand down the Kelo decision.

Finally, what in the hell is wrong with New York? Are they worried about a cab driver strike?

    Source: Associated Press

Federal authorities are looking into a video that shows two men shooting a Quran with a military rifle, then throwing the bullet-riddled Muslim holy book at the entrance of a a Chattanooga mosque, an FBI agent said Monday.

The Washington-based Council on American-Islamic Relations on Monday had called on the Justice Department to investigate the incident as a possible civil rights violation. The group said it was the latest in a series of incidents targeting mosques in several states. . .

The video, titled ” kill the koran” was posted on MySpace.com last month, said CAIR spokesman Ibrahim Hooper. It could still be seen on the Web site on Monday.”

And Bill O has his photo on the CAIR website now.
    They love Bill now!
