Taxpayer lawsuit filed against Spitzer over illegal alien licenses
It’s about time. Judicial Watch, doing the job no one else has done yet, files suit against NY Dem Gov. Eliot Spitzer over those insane illegal alien driver’s licenses:
Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced today that it has filed a lawsuit on behalf of a New York taxpayer in the Supreme Court of the State of New York, Suffolk County against New York Governor Eliot Spitzer over a new policy implemented on September 21, 2007 that will “give all New Yorkers the opportunity to apply for driver’s licenses without regard to immigration status” (Staudenraus v. Spitzer, Index No. 07-33872).
According to New York State law, with respect to driver licenses, the DMV Commissioner “shall require that the applicant provide his or her social security number.” Under the new DMV policy, however, applicants will not have to provide a Social Security number to receive a driver’s license. They must only provide a foreign passport and some secondary form of identification, such as a lease or a copy of parole papers.
The lawsuit, filed in conjunction with the New York law firm Borovina and Marullo PLLC, on behalf of Suffolk County resident and taxpayer James M. Staudenraus, seeks “equitable and declaratory relief against defendants who in the course of their official duties has caused…a wrongful expenditure, misappropriation, misapplication, and other illegal and unconstitutional disbursement of state funds as well as unlawful conduct in connection with their plan to issue driver’s licenses to undocumented aliens in contravention of New York’s Vehicle and Traffic Law.” In addition to Governor Spitzer, the lawsuit names Department of Motor Vehicles (DMV) Commissioner David Swartz and the New York State DMV as defendants.
According to the complaint, “There is no express language anywhere in the VTL [Vehicle and Traffic Law] which dispenses with the requirement that an applicant for a driver’s license provide his or her social security number.” Moreover, Spitzer and the DMV intend to implement the policy without involving the New York State Legislature, and “without complying with the rule-making requirements prescribed by the State Administrative Procedure Act.”
“Eliot Spitzer wants to use his public office to sanction illegal behavior and put all of us at risk through his plan to give driver licenses to illegal aliens,” said Judicial Watch President Tom Fitton. “If Governor Spitzer wants to change the rules, he has to follow the rules – which means going through the New York State Legislature and otherwise following New York law.”

I doubt this will succeed. Voters in CO lost a challenge to a re-districting plan set forth by that state’s supreme court (against the state’s constitution, mind you) on the grounds they didn’t have standing.
I would be surprised if that exact case isn’t used by the defense.

copy of parole papers won’t fly. parolees often need specific permission from their parole officer to obtain a license and a good deal of them have specific conditions that they will not have a license or drive. ‘course, if you’re already breaking the law, why would someone like that be terribly concerned about breaking another one?
Does this guy think Americans are stupid? I would have some sympathy for the Mexicans, if they supported us in the War on Terror, or if they helped us enforce our laws. The fact is they take a dump on us every chance they get. They’re invading our country without using an army. They’re using our own legal system against us. The multicultrist and illegal alien sympathizers are like the Native American scouts who betrayed their own tribal brothers. If the Europeans never received help from Native American scouts, we’d be living in whole other country. Most Americans want the law enforced, not another invasion. The elitist politicians need to listen to the people who put them in office, not force their nutroot agenda on everybody.
New York’s Democratic leadership is constantly crying about getting more of the Homeland Security money and they want to give potential terrorists a tool to bring about another attack?

I work in the insurance industry. by no means are insurance companies and brokers above the law…but his lawsuits a few years back against some large brokerage firms really stretched, bent and twisted the limits of our laws to favor him politically. He was a bully with a badge. I hope they stick it to him.
Why doesn’t he go after the real insurance crooks. The managers and plan administrators et al of the WTC workers compensation captive that has billions of dollars to pay out to firefighters but they have to fight tooth and nail to get medical costs taken care of..(yes, i know dangling prep.) This also happend under his watch.

Spitzer must have gotten elected for the most part because he had a “D” after his name. I don’t think people knew what evils and stupidities he was capable of. (there’s another of those dang danglin’ preps for ya)
Spitzer got elected because the MSM jumped on his bandwagon, including those now critical of him, and effectively gave him a get-out-of-jail-free card. No one, and I mean no one, bothered to scrutinize his record as attorney-general (and not all of his cases involved Wall Street) to find vital clues to his behavior and character. It’s not too late for Michelle and other honorable and diligent investigative journalists to go digging through the record, even though they might need protective hazmat suits. I’ll bet their findings would make Mike Nifong look ethical.

3. For people who have no choice but to pay into a system that leaves nothing to their children.

Dangling preposition? Winston Churchill had the perfect rejoinder to that bit of pedantry, saying it’s the kind of nonsense “up with which I shall not put”.
“Take care of”, “put up with” etc. are idomatic expressions formed by words that lose their formal functions as parts of speech and instead merge to create a different meaning, here as “nurture”,”accomplish”or “finish”, and “tolerate”.
If anyone can parse and diagram “That’s something you’ll soon need to take care of” to show “of” being used as a preposition, I would certainly like to see it done.
I don’t know what offends me more – the sheer stupidity of the idea (thinking that illegal aliens will “come out of the shadows” to accept a driver’s license that will on it’s face indicates that it is not proof of citizenship) or the insanity of the idea (giving illegal aliens an entrée into situations where they can attempt to carry out their murderous ideology). Maybe this moonbat democrat (excuse the redundancy) will compromise by having the following printed on the “license:” “If you are reading this, please call ICE.”
BTW it always infuriates me when liberals refer to these “illegal” aliens as “undocumented.” Makes it sound like “I have citizenship papers or a valid visa, but I left in my other pants so it wouldn’t get wet when I swan across the Rio Grande.”
The not so funny thing is, there arent any shadows. It’s plain site and more and more brazen everyday. Some may have a lower profile than others but in reality it’s reflections not shadows, reflections of non secure borders and the problems that have accompanied non enforcemnt of our Laws.

I’m going to watch this case closely, because here in Lexington, KY, the Mayor’s Immigration Council just issued their recommendations. Included is a recommendation to issue drivers licenses to illegal aliens. No kidding. (Steam comes out of my ears every time I even think about it!) I’m estimating, but I would have to guess that Lexington’s current population is ~$15% illegals. (It’s the thoroughbred horse industry…) If I go to certain areas of town, I would bet my annual salary that I am the only non-illegal in the area. Crime is up. Traffic accidents involving illegals are not uncommon. I am definitely keeping my eyes on NY right now. I bet the Mayor’s office is watching NY closely too. I hope Spitzer’s proposal goes down in flames — then maybe the recommendation here will die a quiet death. I think I will pop over to the JW site and get some contact info.

granite, I believe that was actually a reporter that managed to correct Sir Winston. He’d said “We will not put up with this” or something like that, and he got called for it.
Being a man who strove for propper use of the King’s English, he restated his idea more formally. Or so the story goes.

Now that I know what Judicial Watch can do, I will try to point them in the direction of something far more serious, but I need help.
Several times before today I have tried to get the attention of people like Michelle Malkin to investigate what is happening in New Haven, CT.
Bill O’Reilly, Sena Hannity, Glenn Beck, and the entire FOX News Channel.
Unfortunately, all FNC cared about was OJ & Glenn Beck’s staff ingored me.
I am going to try again and PLEASE, Michelle, PLEASE pay attention!
CT State Senator Len Fasano’s office has been trying for a couple months to get the State Attorney General to prosecute the City of New Haven for:
Fraud
Forgery
Falsification of Federal Documents
Identity Theft
Here’s why:
When illegal aliens in New Haven apply for Social Services, THE STATE EMPLOYEES GENERATE SOCIAL SECURITY NUMBERS for them using a random number generator program. They keep track of all the numbers they generate in order to avoid using the same number twice. However, THEY DO NOT CHECK THOSE NUMBERS AGAINST THE SOCIAL SECURTIY ADMINISTRATION DATABASE!
Here’s how this affects ALL OF YOU:
Social Security numbers are 9 digits, so they can range
from
000-00-0000
to
999-99-9999
which means there are 1,000,000,000 possible combinations.
That’s one billion, with a “B”.
How many people are there living in the United States?
Anyone?
Someone out there must know.
Someone out there should be able to calculate the odds of AN ILLEGAL ALIEN GETTING YOUR SOCIAL SECURITY NUMBER.
WHEN that happens,
THEIR criminal record is now YOUR criminal record.
THEIR credit history is now YOUR credit history
If you file for social services in ANY STATE IN THE NATION, you will be DENIED because the system thinks you are ALREADY RECEIVING THEM.
When you retire and file for Social Security benefits, you might NOT GET THEM because an illegal alien who has your Social Security number may already be COLLECTING YOUR BENEFITS.
If you apply for a marriage license and the illegal alien using your Social Security number is already married, YOU WILL NOT BE ALE TO GET MARRIED because the system will say that YOU ALREADY ARE.
When you need to get a new drivers license, you will have difficulty because an illegal alien is using your Social Security number to get a drivers license in New Hacven, CT.
When you apply for Student Loans, the illegal alien may have USED YOUR SOCIAL SECURITY NUMBER TO GET FINANCIAL AID, which means that maximum amount allowed for you by law HAS ALREADY BEEN GIVEN TO SOMEONE ELSE.
Finally, imagine all the implications when you FILE YOUR INCOME TAXES and use a Social Security number which shows INCOME YOU ARE NOT DECLARING because you do not know that an illegal immigrant is EARNING WAGES WITH YOUR SOCIAL SECURITY NUMBER and not filing.
Please, Michelle, PLEASE pay attention to this. You have a network of resources and you can bring this public. I’m asking you. I’m BEGGING you. Please investigate this and shine the light of public scrutiny on this.
Nobody is talking about this so NOTHING IS BEING DONE. We need to make this a story to force the government to STOP THIS.
Or are you willing to remain silent and hope that your family’s indentities will not be stolen by the City of New Haven and given to someone else?

The left is fond of saying “dissent is the highest form of patriotism”, so I think it’s time we start dissenting against the liberal flood of stupidity and political correctness that’s ruining this nation.

Everyone that has lost their license to DUI’s and/or the ‘habitual traffic offenders’ would be standing in line for a ‘new’ license, pretending to be an illegal.
Just dummy up a foreign passport, or go the the 7-11 MM and Bryan showed us, and you’ve got another license.

The Judicial Watch suit is unfair. Have they no compassion for poor Spitzer’s “sense of desperation” about the issue of illegals? And since Hillary (eventually) came out (was flushed out) in support of Spitzer’s plan, have they considered her feelings?

You know, I’ve been so desperate to get this (#33) into the public spotlight that I even talked to the local NBC news.
I accidentally found Amanda Raus of the CT30 Hartford affilate of NBC in the Stew Leonard’s parrking lot in Berlin, CT and told her everything.
She said that it would take some time before the story would air because research was required. I agreed and have been TiVo-ing the 11pm news on NBC CT30 every night.
It’s been almost two months. Nada.
I now sympathize with H.G.Wells, who said his gravestone should read,

Seems to be an accurate description of the state of affairs in New York these days.

I found out about it at a Republican Town Committee meeting in Wallingford, CT, when State Senator Len Fasano’s office gave their report.
The mayor and I took turns voicing our discontent.
When the Senator’s representative told us about how the Mayor of New Haven was tapping into State funds because he was running out of city funds, the mayor hit the roof:
“Are you telling me that the mayor of New Haven is taking money meant for MY city to fund HIS program which violates Federal Law?”
I called the Senator’s office and spoke with his secretary, who said that he is currently trying to get the CT State Attorney General to press charges.
The way they found out about it was thanks to some whistle-blowers in the Social Services office who didn’t like being ordered to commit fraud.

I’m relying on those of you who have resources and/or are investigative journalists/reporters to contact his office, ask about this, and ask how things are progressing.

I’m hoping someone will do some old fashion reporting as I am not a reporter and this is the only way I have or raising awareness.

Look, I totally understand Spitzer. Without a license, it’s hard to get on an airplane, which makes it harder to crash into another one of Manhattan’s skyscrapers. We just can’t keep throwing roadblocks up in the way of mass murderers like that – the polarity will cause forest fires.

The other day a Lou Dobbs’ commentator rang the bell on this subject. Aside from the votes for Democrats scam the commentator postulated legal driver licenses for illegals make the illegals insurable to drive a vehicle and as such become cheap replacements for American truck drivers and any other commercial vehicle. More jobs Americans won’t do, OMG (follow the money).
As a personal ad hominem, the only person entitled to appear as pugnacious as Spitzer is Bill Cowher. Someone should teach Spitzer not to lead with his chin but I’m thinking he believes he is the toughest clown in town.
I wonder if the illegals are forced to take their driving tests in Engish, or if Spanish and other languages are given as options?

Amazing thing is in AZ with merely the threat of stepped up enforcement (law doesn’t go into effect until Jan 1), guess what they have noticed – a decrease in the number of illegals there. More fertile ground elsewhere. Of course, certain groups are fighting it and now it’s in the hands of a single judge. Again explain to me why a single judge supersedes the will of an entire state legislature?
TimDechanter: I’ve proposed to the few conservatives I know here in CT that we all inform the governor that we don’t intend to pay the portion of our state taxes that goes to New Haven. If New Haven wants to break the law, then they don’t get our state money. I’m not really sure how to actually pull this off though.
