Open borders lobby loses in Arizona
Good news for immigration enforcement proponents from Phoenix:
A federal judge has thrown out a lawsuit seeking to block a new Arizona law that prohibits people from hiring illegal immigrants and requires businesses to verify whether applicants are eligible for employment.
The law takes effect Jan. 1.
In his ruling on Friday, U.S. District Judge Neil V. Wake wrote that the lawsuit was premature because there was no evidence that anybody had been harmed, and that the plaintiffs—a coalition of business and immigrant rights groups—were suing the wrong people.
The ruling said the law gives only investigatory authority to the governor and state attorney general, who were named as defendants. Wake said county prosecutors, who weren’t defendants, actually have the power to enforce the law.
But the open-borders lobby will be back, of course:
The plaintiffs had asked for a preliminary injunction blocking the law from taking effect. Farrell Quinlan, a spokesman for business groups in the suit, said they planned to file more information with the judge to answer what he sees as shortcomings in the complaint.
Alfredo Gutierrez, a spokesman for immigrant rights groups, said they plan to refile the lawsuit after Jan. 1, when they might be able to show damages caused by the law.
A spokesman for Gov. Janet Napolitano said the governor’s office had not yet read the ruling and had no immediate comment.Napolitano signed the bill in July, saying that while immigration is a federal responsibility, Congress was apparently “incapable of coping with the comprehensive immigration reforms our country needs.”

Immigration reform, how many times do we need reform?!! Just enforce the current laws! sheesh..
Good news, yes. But the open borders crowds’ power depresses me. They’ll find some judge somewhere to thwart the people’s will.
This is a huge step in the right direction. Couple this with Maricopa County Sheriff’s Department having deputies trained by ICE for helping with deportation and more BP on the border and its looking better. We’re rapidly approaching a point where local governments will be doing all they can and the Fed will have to get off their hands and do something.
There is a lot of talk around town that this will just encourage illegals to move to other states where the laws are more lax. While I’m glad to see a reduction in AZ, other states will also have to step up.
If our legislatures worked this hard to actually do something about the influx of illegals as hard as they work to get them protection under our laws, we would be better off for it.
What part of - ILLEGAL, don’t they quite understand.
It seems like the organization was once for immigrant rights, and has now been perverted/hijacked much like many civil rights group. Misguided at best.
More progress. Inch by inch we (the people) will gain control of this monster of an issue.
If even half the states pass such laws, the other half will bankrupt themselves caring for 20 million illegals. They will have no choice but pass tough illegal immigration laws as well just to stay solvent. Then we will see the exodus of most of these illegals self-deporting back home, which is much preferable to forced deportation in my mind.
Oops - legislators.
At least I think some of these people are starting to get it, (caution) I said some and starting. Let’s hope this ball keeps rolling. And with Michelle on watch I have no doubt that it will. Once again YHANKS Michelle!!!!

I certainly hope that, after January 1st, someone on our side of this issue files a lawsuit to uphold this law in AZ.
While they are at it, they should quantify the costs of these illegals and sue the federal government to recover those costs for the people of AZ. A class action suit.
The only bad part of this is that only the lawyers will win in the end. They get the money on BOTH sides of the issue!
Just as the good news from Iraq is becoming impossible for the MSM and democrats to ignore, the will of the people to stop illegal immigration is becoming more and more difficult for government entities to ignore. If the people keep pressuring the politicians hard enough solutions will be found.
If the courts find ways to strike down anti illegal immigration measures, highly motivated legislators can find ways to come back with something that will hold up in court.
There is much work still to be done, but I’m hopeful.

I keep ranting about the southern border of Texas. If anyone think that Mexican
illegals postively impact Texas just go to the border (and a lot of other areas of TX)
and see what is happening there. For one thing, unless it has been stopped this
week, there are Mexican flags flying above US and TX flags (some on OUR federal
buildings). There are cardboard box and tent shanty towns. The anchor babies aren’t
being cared for as they should be and there is a lot of illness. Needless to say, crime
is up (to put it mildly) and there is absolutely no English. The Mexican police and Mexican army DOES come across our border regardless of what the official line is here
in TX. The mayors of border towns have told Governor they won’t allow fence to be
built anywhere near their towns or cities. Environment groups ( the Left) say “fence
bad-block view!”) and even fishermen are screaming that in places it would block
them from the river.
This is what these peaceful just want to work for a better life Mexican illegals have
done to just one part of this country. I know that we have illegals in this country
from most of the countries on this earth, but these are the majority. They don’t
improve any area they live in. They turn everywhere that they live into little Mexico,
just like where they came from. The Left seems to want an underclass; peons in this
country. This isn’t a conservative thing…it’s a Democrat thing!
Please excuse the hissy fit. Am feeling “a mite” testy today as Grandma used to say.

Seems the main two states really trying to locally fight the illegal invasion are my birth state of Oklahoma and my residence state of Arizona …
Just as they have seen in Oklahoma the illegals have been leaving Arizona at a steadily increasing rate as the date of implementation of our new law (Jan. 1) gets closer.
Maybe I should buy a lottery ticket today …
The real beauty of this is that the slave masters (a.k.a. “business groups”) who filed the lawsuit have been exposed for who they are. Now, in addition to the new law, they have to deal with law enforcement knowing where to look first. Sheriff Joe should be all over them in less than a month.

UNC system head Poncho, Erskine Bowles, wants to give in state tuition to illegals.

Don’t forget folks, - Congress and the President define what is “illegal” and what is “legal”.
The immigration “reform” really needed is to go back to what we had prior to 1965 and start from there, along with abolishing birthright citizenship and full “rights” for non-citizens.
We should be allowed to hold aliens to a higher standard such as deportation for DUI, shoplifting and other misdemeanors as well as felonies.
Criminals who re-enter after deportation should get either the death penalty or life at hard labor.
I like the idea of death, or life at hard labor.

What on earth would Mexico do if the illegals came flooding back across the
border? They would probably station troops on border to keep them here because
there goes the money.
Standing is the magic word. In these lawsuits, some judges are looking (and rightly
so), at standing as in who is truly hurt by this law? If the persons bringing the
lawsuit aren’t hurt by the law, they don’t have standing. This could have been used
all along and also against ACLU suits.
Let us not kid ourselves that this is anything but an invasion - plain and simple.
As to refiling when damages or harm can be proven - one assumes that the harm will be to citizens as opposed to invaders.

Here in Tx the other border thing is the apalling amount of trash. Either the poverty is not quite so bad or Fox and the govt are paying them to take out the trash.
It is a mess all over the state. Seems that it is either Mexican names that we hear the
most lately when a crime is being reported. You see way more brown and black faces
on the news because we are now the minority in Texas.
No one is reporting on what is going on on the border. A friend and her husband just
moved back after 6 months on a job in Laredo. She said she kissed the ground in
North Central Texas when she got back here. That’s how awful it was for them.
Since when do criminals here illegally have ANY rights? Their rights exist back across the border from whence they came.
Immigrant rights groups. Ha, rights for people who come here with their hand out for the dole. So much for the working schlub who pays the taxes for the entitlements for illegal aliens.

I wrote him back and again told him there is nothing to debate. Illegal means against the law. What part of this did those in power NOT understand?
I also told him that the citizens of this country are fed up with the freebies they get from our taxes.
Also, I stated that we are becoming a 3rd world country and we are not going to let it happen.

I have an Uncle that lives in NC. Son and Daughter in Law lived in NC before moving
to VA. VA not any better than NC.
For some reason, the pols and the MSM and NYT cannot seem to accept the idea that
the majority of this country disagree with them. I listen to nuance when I watch the
news on tv and I hear a lot of approval for the illegals in the news readers voices.
When they say something about anti illegal immigration people you can hear the
disapproval. It’s the same thing when George W. Bush was running for president. I
quite watching two channels because of the way they behaved when talking about
him. It’s the same thing with illegals and anti illegals.
This law is essentially toothless. First, it’s not retroactive and applies only to new hires. Second, only those who “knowingly” hire illegals can be charged. I live in one of the areas in Phoenix that’ve been overrun by illegals. Just a few blocks away from my home is a street corner where, for a few bucks, just about any fake ID can be had - DMV licenses, passports, birth certs, etc. It’s out in the open, like a flea market, and it’s the vendors only who will stand to gain. Well, them and the businesses who won’t hire citizens.
The flea markets they patronize have been raided again and again because that’s
where most of their fake documents come from.
How can you prove someone “knowingly” hired an illegal besides the fact that he/she can’t speak a single word of English.
Unless and until we can secure our borders all of this will remain meaningless. How many “crimes that Americans will not commit” have been committed by people coming back after having been “deported” sometimes a multiple number of times? One of the very few powers the federal government is actually given is to secure our borders. Why won’t they do it and how come they are not accountable to more than a vote when they are in violation of the constitution?

Again, hate to sound like a broken record but the trend of pandering o illegal alienr/criminals comes down right from white house. with politicians or their parties having to pay little or no price at all. In a sane worls. Bush, Teddy, Chertoff would have been tried for treason and the illegal immigrants would not have sugar daddies in white house, senate and congress. But American electorate are so lame that they can’t even see there the real problem lies… with their pliticians.
Ironically, when a patriot like Tom Tancredo does something about it, he is labeled “anti-immigrant”. Which proves the problem with American electorate. No wonder criminals rape America while border patrol agents rot in prison.
