Jerk update: Lawyer accused of keying Marine’s car in court today

By Michelle Malkin  •  January 18, 2008 08:55 AM

Remember that jerk lawyer accused of keying a Marine’s car on the eve of his deployment to Iraq? A veteran sends an e-mail asking for a show of support for the Marine in court today. If you’re in the Chicago area, pitch in:

Private attorney Jay R. Grodner, 55, of Chicago has been charged with a class A misdemeanor — criminal damage to property — punishable by up to one year in jail and up to a $2,500 fine, said Andy Conklin, spokesman for the state’s attorney’s office.

The court date is [today] at 1:30 pm at District 29 at Belmont and Western Ave in Chicago. A good address to use is either 2400 W. Belmont , or 3200 N Western for your gps. (It’s a few minutes off of I-90 ).

Sgt. Michael McNulty’s Lawyer will be in court and we ask that any Chicago area Veterans & Active duty also fill the court room that day to show that we will not accept our troops being treated in this manner. We will expect the courts to handle this situation with only the best outcome for Sgt. McNulty and charge this leftwing nut, attorney Jay R. Grodner to the fullest extent of the law.

John Kass at the Chicago Tribune wrote last week:

Grodner is now under investigation by the state’s Attorney Registration and Disciplinary Commission, sources said. Commission officials declined to comment Thursday.

More than two decades ago, according to public records, Grodner received a censure by the Illinois Supreme Court after an unrelated investigation by the disciplinary commission into allegations he participated in producing phony signatures on a tax ballot initiative…

…McNulty’s car has an estimated $2,400 in damage, well within the statutory range for felony criminal damage to property. The Cook County state’s attorney’s office declined any comment on whether the case will be upgraded. But they are pursuing the matter in preparation for the Jan. 18 hearing at Belmont and Western.

What’s missing is Grodner’s side of the story.

I hope he can start providing one.

Blackfive, which brought the story to light in the blogosphere, has all the background and a photo of the Marine’s damaged car.

My “Support The Troops” magnets seem to disappear, too, while my flag magnet does not.

It all fits into a pattern of petty vindictiveness exhibited by the Left.

I was thinking the same thing. A lot of people who want to show support for the Sarge may be coming from places where there is no reliable public transportation. It would be a good idea to review how to take the “L” to get into town and out again.

Though he might not be in the courtroom, [Sgt] McNulty might derive some comfort from the fact that the presiding judge is a former Marine. Circuit Court Judge William O’Malley was a lance corporal in the early 1960s and is known around the Chicago Courthouse for wearing a Marine Corps pin on his lapel and celebrating the Corps’ birthday each November.

How can one claim to support the troops if you don’t support their mission? If you don’t support the mission, then you can’t support people who are engaged in fulfilling said mission. It makes no logical sense. If one doesn’t support the mission, I don’t know how they can claim to support the troops any farther than hoping the troops don’t die in furtherance of the mission’s goal.

To my mind, it’s similar to saying, “I support the fact you’re a conservative, just don’t try to implement any sort of conservative policies.”

I’m sick of the tired, old cliche of “I don’t support the war, but I support the troops.” It is nonsensical, and frankly, seems to fit the definition of cognitive dissonanace, as I understand it.

An update via Blackfive’s comment section:

The case was called at 13:33, and the Defendant (Jay R. Grodner)did not show up. There were 2 heavy hitter State’s Attorneys here to handle it. The Judge increased his bond to $20,000.00 or 10 percent cash, and put out a warrant for his arrest.

The Defendant called at 13:40 to say that he would be a half an hour late and was waiting for the media to leave. The Judge said in open court that if he showed up he would be taken into custody, and if he didn’t, he would be fair game for any law enforcement agency that wanted to pick him up.

At 1400 hours the defendant showed up, and was told that he was half an hour late. The Judge stated on the record that the defendant had done the same thing during the previous court date, and he said that the defendant called and said that wanted to wait for the media to leave. The Judge said “That is not the way I run my courtroom.” He increased the bail and took him into custody and told him to try and work out a deal with the State. About 25-35 marines and assorted military were there.

The case was recalled at 14:22, and the State said that the defendant had asked for permission to put his belt and such back on. The Judge said, “Treat him like all the other prisoners.” The defendant was brought out and the plea deal that they had worked out was entered into the record.

The Judge asked him if he had committed the specific acts he was accused of. The defendant hemmed and hawed, and the Judge raised his voice to make him say yes or no. The defendant agreed, and the Judge read the facts into the record. Several times, the Judge said if there were no deal, he would be given a court date just like any other defendant, and he could try and make bail soon.

The deal: 1 year Social Service Supervision, restitution of 600 dollars to be paid to Social Services and which would go to the Injured Marine Semper Fi fund, to be paid by February 25th, 2008, and $50/month in supervision fees.

The Judge then, in as angry a voice as I have ever heard him use, scolded the defendant, saying that the Marine license plates the complaining witness had were not vanity plates or about ego, but the proceeds go toward the Marine and Navy scholarship fund for the children of fallen soldiers, sailors and marines. These Marines protect his very existence “so people like you can enjoy their freedom.” He further said that the reason there were so many in the courtroom and so much public interest is that the Marines have a tradition since 1775 that “No Marine gets left behind.” Several ‘Hoorahs’ in the courtroom.

And then the deal was done, and he was taken away by the sheriffs to be released later.
