#2: Due process for wives.
In Malaysia, Islamic Sharia law allows men to divorce their wives with a triple talaq text message.

Well, here’s a small dose of sanity–surprising, I know–from Maryland’s Supreme Court, which refused to recognize Islamic divorce. Yes, you can resist sharia creep:
Saying “I divorce thee” three times, as men in Muslim countries have been able to do for centuries when leaving their wives, is not enough if you’re a resident of Maryland, the state’s highest court ruled yesterday.
Yesterday, the Court of Appeals rejected a Pakistani man’s argument that his invocation of the Islamic talaq, under which a marriage is dissolved simply by the husband’s say-so, allowed him to part with his wife of more than 20 years and deny her a share of his $2 million estate.
The justices affirmed a lower court’s decision overturning a divorce decree obtained in Pakistan by Irfan Aleem, a World Bank economist who moved from London to Maryland with his wife, Farah Aleem, in 1985.
Both of their children were born in the United States.
In 2003, Aleem’s wife filed for divorce in Montgomery County Circuit Court.
When he filed a counterclaim, he did not object to the court’s jurisdiction over the case, according to the ruling. But before the legal process could be completed - and without telling his wife - Aleem went to the Pakistani Embassy in Washington and invoked the talaq, in effect attempting to turn jurisdiction of the case over to a Pakistani court that later granted him a divorce.
When they were married in Karachi in 1980, Farah Aleem was 18 and had just graduated from high school. Irfan Aleem was 29, a doctoral candidate at Oxford University in England. As is customary, the couple signed a marriage contract. It obligated Aleem to give his wife the equivalent of $2,500 in the event of their divorce. When they split, he did so, and claimed he owed her nothing more.
Maryland’s highest court disagreed.
“If we were to affirm the use of talaq, controlled as it is by the husband, a wife, a resident of this state, would never be able to consummate a divorce action filed by her in which she seeks a division of marital property,” the judges wrote in their decision.
They said the talaq “directly deprives the wife of the due process she is entitled to when she initiates divorce litigation.”

#5, what they used to do and still do in some places is “marry” a woman for the night, have a one night stand, then 3 sentences later they are free and clear. I this senerio they often don’t bother asking the woman however. It was used in the context of military conquest to excuse the rape that usualy went with that in the 7th century. A nice little loop hole, For the guy at least.

Jewish women have the same problem — husbands have the right to refuse to grant a divorce. Modern orthodox brides often require the groom to sign a contract promising to give a religious divorce (a “get”) if the couple gets a secular divorce. A court held itself unable to enforce such a contract because it had no authority on religious practice.
Now to go after the washing basins and prayer rooms( that a certain company here in Mn allows then to use phone rooms for)…..

I’ve been to Malaysia, and, watching the government at work there, makes me happy to be back here. First thing you learn is that you don’t disagree with the government there, as a citizen. The morality police is for real there too. If this case was in Massachusetts, Vermont or California, they would have ruled that Islamic law takes precedence; mustn’t upset the moslems. I’m surprised Maryland didn’t go with him.

Wow. Normally in divorce proceedings I take the guy’s side so long as the woman is taken care of relative to the means of the husband. But this makes me mad. He just wanted to dump her after 20 years and leave her with just 2500 dollars. That’s ridiculous.
I don’t understand why western women want to marry men from this culture. They actually believe that women are inferior creatures. I would think they’d have compassion for their ex wives and want them to at least be able to take care of themselves. This guy was just mean and greedy. False analogy. Muslim doctrine supports these particular concepts of divorce, whereas Christian doctrine does not support polygamy, much less statutory rape.
A doctrine should be judged on its own merits, not on the merits of its followers. The Pakistani man followed Muslim doctrine to its logical conclusion, whereas the Texas cult members did not follow through on Christian doctrine.
It’s ironic that this sort of argument comes from Christianity’s detractors who have not looked at the logical conclusions of their own atheistic faith. What is the logical result of a culture dedicated to moral relativism?

It isn’t like Western culture has been decent by contemporary standards for than a few decades. 150 years ago, slavery was legal in the U.S.; 100 years ago women couldn’t vote, there weren’t any child labor laws, and life expectancy wasn’t very long. If we look at Europe, the situation in most places was pretty nasty in the West until after WWII and in the East until after the fall of the USSR. I’m not saying “Oh, western culture is evil! How dare we judge Muslims!,” but I am saying that it’s not the case that we’re perfect and that it’s definitely not the case that a society with some things very very wrong (e.g., the US in the 1850s) can’t improve. It’s also worth remembering that the denigration by seculars of the values of a religion (even when these values are worth denigrating, as is the case here), results in these values are clung to that much more fervently; e.g., the rise of fundamentalist Protestantism in the U.S. as a reaction to liberal Protestant theology, or German and Irish Catholics in the late 19th c. under Kulturkampf and British colonialism. Just from a pragmatic level, the more modernity casts itself as opposed to Muslims, the more Muslims will hate modernity. Looking for common cause, if it can be found, is more likely to be successful if history tells us anything. Whether or not that cause can be found is another issue, and I have no idea what that cause would be.
And if you’re going to launch into pointless name-calling, at least make sure you know on what point we disagree. I’m not drawing an equivalence between the West’s past and Islam’s past or present, but an analogy. I’m not saying Islam doesn’t have problems. And I’m not saying that we shouldn’t criticize Islam, just that the history of conflicts between secularization and religion suggests that that approach won’t accomplish much if it’s too adversarial.
Sorry, hate to change the subject but I just heard Eddie Arnold died a few hours ago. I’m from the D.C area, Porter Waggoner, Roy Clark ( who was born & grew up a few block from here) Mel Tillis, and yes, Eddie Arnold. Uline Arena. I wasn’t big into C&W then, to me it was just music. Why did you shift tense? That’s my point. At one point we killed our reformers. You could say “The West in 2008 has reformed, the West in 1914 was barbaric and rabidly nationalist and killed their reformers.” Or “The American South in 2008 has reformed [In that most of us treat Black folks as equals]. The South in 1859 killed their reformers [that is, abolitionists like John Brown].” The goal should be to avoid as much of the space between 1859 and 2008 as possible; i.e., to bring about the needed changes with as little bloodshed and backlash as possible, because bloodshed and backlash doesn’t do anyone any good for a long time (100 years in this example). Even when you’re right (as the abolitionists, of course, were), being antagonistic about it doesn’t do any good. This doesn’t mean we should overlook what’s wrong with Islam, just that we should talk about what’s wrong in a way that’s likely to be useful.
If I may be so bold to ask, how would you suggest non-Muslims should approach Muslims concerning their actions and worldview?
I will reasonably, respectfully argue with them, up until the point that they wish to do harm to my family or country, at which point I will “visit violence on those who would do us harm.”

The key words here are “contemporary standards”, you Monday Morning Quarterback. This country has been, since its founding, far above “contemporary” standards for the rest of the world, and remains so. In fact, the world has spent the last 250 years striving to reach our standards.

This is a serious and fundamental misunderstanding of Islam. Islam states that the most glorious period was that time when Mohammad was alive and acting as prophet. Since then, humanity has gone in continuous downward spiral that can only be redeemed once the rightful Caliphate is once again in charge. Thus, modernity is at odds with Islam, as it represents the furthest possible time period away from the time of Mohammad. Further consider that the doors of Ijtihad were closed in the 12 century, meaning that Muslims could no longer use reason to interpret the Koran. Given that 12th century reason is considerably different than 21st century reason, it stands to believe that those who follow the strict doctrine of Islamic radicalism would be opposed to all aspects modernism. There is nothing we can say or do to change this, and “newspeak” that will not offend this type of Muslim does not exist.
In contrast, Christianity believes that we are in an upward trend since the death of Christ. Hence the idea that we can learn from our mistakes and improve upon them, with a critical eye towards the past, is not only acceptable, but encouraged.
I’d say that’s a pretty big difference.
