#2: Due process for wives.

In Malaysia, Islamic Sharia law allows men to divorce their wives with a triple talaq text message.

Coming to the US?

Well, here’s a small dose of sanity–surprising, I know–from Maryland’s Supreme Court, which refused to recognize Islamic divorce. Yes, you can resist sharia creep:

Saying “I divorce thee” three times, as men in Muslim countries have been able to do for centuries when leaving their wives, is not enough if you’re a resident of Maryland, the state’s highest court ruled yesterday.

Yesterday, the Court of Appeals rejected a Pakistani man’s argument that his invocation of the Islamic talaq, under which a marriage is dissolved simply by the husband’s say-so, allowed him to part with his wife of more than 20 years and deny her a share of his $2 million estate.

The justices affirmed a lower court’s decision overturning a divorce decree obtained in Pakistan by Irfan Aleem, a World Bank economist who moved from London to Maryland with his wife, Farah Aleem, in 1985.

Both of their children were born in the United States.

In 2003, Aleem’s wife filed for divorce in Montgomery County Circuit Court.

When he filed a counterclaim, he did not object to the court’s jurisdiction over the case, according to the ruling. But before the legal process could be completed - and without telling his wife - Aleem went to the Pakistani Embassy in Washington and invoked the talaq, in effect attempting to turn jurisdiction of the case over to a Pakistani court that later granted him a divorce.

When they were married in Karachi in 1980, Farah Aleem was 18 and had just graduated from high school. Irfan Aleem was 29, a doctoral candidate at Oxford University in England. As is customary, the couple signed a marriage contract. It obligated Aleem to give his wife the equivalent of $2,500 in the event of their divorce. When they split, he did so, and claimed he owed her nothing more.

Maryland’s highest court disagreed.

“If we were to affirm the use of talaq, controlled as it is by the husband, a wife, a resident of this state, would never be able to consummate a divorce action filed by her in which she seeks a division of marital property,” the judges wrote in their decision.

They said the talaq “directly deprives the wife of the due process she is entitled to when she initiates divorce litigation.”

    Sorry to have to point out the obvious, but not all who SAY they are Christian really are.. Which is why the bible warned: “You will know them by the fruit they bear”.

    So if this was an attempt to slander Christianity, it was a pretty sad & weak one..

    She only needs to show that she signed it under duress, and it will be voided by the court. It would not be hard to prove that an 18 year old women in Pakistan being forced into a marriage was forced to sign the “contract” under duress.

    Jewish women have the same problem — husbands have the right to refuse to grant a divorce. Modern orthodox brides often require the groom to sign a contract promising to give a religious divorce (a “get”) if the couple gets a secular divorce. A court held itself unable to enforce such a contract because it had no authority on religious practice.

    I don’t understand why western women want to marry men from this culture. They actually believe that women are inferior creatures. I would think they’d have compassion for their ex wives and want them to at least be able to take care of themselves. This guy was just mean and greedy. When you marry you become family especially if you have kids. Why would you want your family to suffer at the hands of your own greed? Thank goodness justice prevailed here.

    So you see, it is possible for religions to grow and mature. It’s just too bad that you’re not willing to recognize the ones that aren’t as dangerous. Rather, you’d rather bring up past aggressions (most of which happened generations ago…if not centuries ago) as an excuse for not critiquing current evils.     False analogy. Muslim doctrine supports these particular concepts of divorce, whereas Christian doctrine does not support polygamy, much less statutory rape.

    …maybe speed skating is OK, because the woman is completely covered…

And I’m not saying that we shouldn’t criticize Islam, just that the history of conflicts between secularization and religion suggests that that approach won’t accomplish much if it’s too adversarial.

    If I may be so bold to ask, how would you suggest non-Muslims should approach Muslims concerning their actions and worldview?
    I will reasonably, respectfully argue with them, up until the point that they wish to do harm to my family or country, at which point I will “visit violence on those who would do us harm.”

    This is a serious and fundamental misunderstanding of Islam. Islam states that the most glorious period was that time when Mohammad was alive and acting as prophet. Since then, humanity has gone in continuous downward spiral that can only be redeemed once the rightful Caliphate is once again in charge. Thus, modernity is at odds with Islam, as it represents the furthest possible time period away from the time of Mohammad.
