Look who’s defending an HIV-infected spitter
You’ll never guess who came to the defense of an HIV-infected criminal who repeatedly threatened police officers in Dallas.
Actually, you’ll have no problem guessing his identity.
It’s the spit-speckled clown himself! Watch as he indignantly turns the story — about a convict who intentionally tried to infect police officers with AIDS and posed a public-safety menace — into a red-herring sermon about discrimination against law-abiding AIDS patients:
The bottom line in the case is not how likely transmission of the AIDS virus through saliva is. It’s about the HIV-infected criminal’s malicious intent.
Is 35 years excessive? I think so.
But the jury took into account the man’s history of assaulting law enforcement officers (and other prisoners). They considered his intent. They followed the laws on the books governing habitual offenders. And there is ample legal precedent for prosecuting spitting as a crime:
In a 2007 decision by the Ninth US Circuit Court of Appeal, intentionally spitting on someone is “an offensive touching that rises to the level of simple assault,” that can be punished by up to six months in prison.
…at least nine HIV-positive individuals in the US have previously been sentenced to much longer prison terms for spitting. A 2003 analysis from the Yale University Center for Interdisciplinary Research on AIDS “found 24 instances of prosecutions for spitting…[and] convictions for HIV exposure in eight cases, in which there were two convictions for attempted murder, two for criminal exposure to HIV, one for assault with a deadly weapon, two for assault, and one for battery by body waste. The sentences imposed ranged from 90 days in jail to 25 years incarceration to life imprisonment.”

2) I was a cop…if someone tried to give me aids via spitting on me I can assure you they would not have to worry about the long term health problems aids causes but rather the short term heatlh problems they just brought on themselves.

I disagree, since this was an attempt to murder a police officer. I have family in law enforcement, including the NYPD – that tends to influence my thinking on things such as this.
What a shock about Geraldo. On the other hand, I didn’t realize that those two were still on tv.
O’Reilly is in the tank for Obummer. He can never find anything wrong with him (the Senator cannot be held responsible for who he hangs out with) and he continues to say that he will be very upset if the Senator doesn’t enter the “no spin zone”.

In the reporting of this item, there seems to be a big gap from Geraldo. Was the spitter a was a habitual criminal? If this guy was pure as the white snow an had no other criminal record, I might actually agree Geraldo. My instinct knows that the Judge took all aspects into account and sentenced this scumbag accordingly. Of coarse Geraldo will never let you know that.

Jerry Rivers and Bill O’Reilly are birds of a feather. I just don’t see why Fox thinks they are worth their millions. Ok, I suppose ratings mean something and O’Reilly does champion some childrens’ rights issues, but I don’t care to watch either retard pontificating and further enabling creeps like Obamanation, Jesse Jackson and Al Sharpton. And I always wondered what women saw in Jerry Rivers that he could woo them in volume. Maybe he exudes charisma in person? Wouldn’t it be nice for all public figures to be questioned by lie detectors? I agree that as bas as O’Reilly and Rivers are, the competitors at CNN and MSNBC are insufferable to the max. One who knows that they have HIV also knows the estreme danger posed by their bodily fluids. When they intentionally spit on another person, they are intentionally engaged in an act to inflict death or serious injury. Aggravated assault with a deadly weapon or attempted murder are comparable crimes. And 35 years is not excessive for those comparable crimes, particularly if the perpetrator has a history of criminal behavior.
Geraldo has not practiced law for about 30 years, and the notion that he can be trotted out as some legal analyst is utterly ridiculous. His skills at legal analysis are less than those of a first year law student. His skill is at trying to provide some legal basis to his “feelings” on a particular subject. Any time someone like FOX news uses him in the role of legal expert, they are making a mockery our of the legal profession by passing a buffoon off as a lawyer.

Yes Geraldo is still on FOX news. I still watch FOX News but I am also hoping that Michelle Malkin and perhaps some other conservative joins forces and produces an internet news show perhaps moving to TV later on. I bet that conservatives would flock to the show in groves.

I pray everyday that a cure will be found for AIDS but a patient who has contracted the disease should be punished for trying to spread it.

This HIV spitter got what he deserved. He deliberately tried to transmit his disease onto a police officer and no mercy should be spared him. I think spitting at anybody (especially the military and police) should be considered asault, especially if the person is harboring a potential bio-hazard.
This guy will get his backside readjusted in prison as he so richly deserves.
If someone attacks you with a weapon, you have every right to defend yourself, with deadly force if you believe your life is endangered otherwise. This case is no different, and if I was attacked by this scum trying to infect me, I would use deadly force in self-defense to stop them and preserve my own life.
If the cops beat this AIDS-infested lowlife senseless they’d be likely exposing themselves to his blood.
If the story is correct about this fellow’s past history namely biting another inmate to try and give him AIDS, he should have never been let out of prison in the first place.
And he should be spending the rest of his life in solitary confinement.

I watched the video long enough to see who was defending the scumbag, and then stopped watching it. Since the the guy had aids and had tried infecting someone else, 35 years ain’t long enough. The spit was a deadly weapon aimed at a police officer.
I also think O’Reilly is sucking up to obummer. When Laura or someone else points out who he associates with, O’Reilly says real quickly that that doesn’t mean obummer thinks like they do, after all, we can’t read his mind.I change channels when he has a segment on obummer, for I know he’s going to lick his shoes. If obummer comes on his show, I don’t plan to watch that segment.

I don’t think there will ever be a cure for it, zorro. I’d have to check with an epidemiologist but I can’t help but think there’s gotta be some level of mutation from person to person, where the virus “latches on” to an individual’s DNA, taking something from it. So even if a “Person A” could be cured, by the time it get’s to “Person B” – much less “Z” – you’re dealing with a different critter.
The sad thing is that this disease could be wiped out in one lifetime if everyone in the world were responsible – primarily in their sexual actions and in not injecting illegal drugs. Those who are infected by blood trnasfusion/transplant/at birth is a tragic consequence of the those who are irresponsible in sexual choices and drug usage – the sad flow chart of wrong choices “trickles down” to the innocent and responsible.

I believe even the most optimistic of those who have been researching and working for a cure have lost much of their original optimism, from all I’ve read. You get news every now and then “A cure has been found” only to see that hope dashed when it’s tested in the real world. And I’m an optimist myself, but I’m also a realist; my thinking is that this disease will be with us for a very, very long time and become more resistant to treatment, much less cure, as time passes.
And that’s sad, as I suspect many of us know and care about at least one person who has been impacted by it in one way or another.
