Chart of the day: Illegal aliens get what?
Reader A.F. e-mails the chart of the day. He writes: “Michelle, I work peripherally for the insurance industry and get the industry’s magazine National Underwriter. The May 8 issue contains a cover story titled: “Workers Comp for Illegal Aliens Sparks Debate Among the States.” A box within the text describes which states already provide WC for illegal aliens: “CA, FL, NV, NY, TX and UT expressly include illegal aliens in the WC coverage” —- UTAH??? So you can come to the US, work illegally, complain of headaches caused by a little slip and fall and you can go on drinking Dos Equis with my tax dollars for the rest of your natural life. What a country!”
I’ve mentioned the illegal alien workers’ comp scheme before in immigration speeches over the years and have been met with skepticism. The trend has only exploded since I first reported on it.

Will it really matter in 8 months when the new president is sworn in and all the illegals get amnesty?
I bought a bird feeder. I hung it on my back porch and filled it with seed.. Within a week we had hundreds of birds taking advantage of the continuous flow of free and easily accessible food.
But then the birds started building nests in the boards of the patio, above the table, and next to the barbecue.
Then came the poop. It was everywhere: on the patio tile, the chairs, the table…everywhere.
Then some of the birds turned mean. They would dive bomb me and try to peck me even though I had fed them out of my own pocket. And others birds were boisterous and loud: They sat on the feeder and squawked and screamed at all hours of the day and night and demanded that I fill it when it got low on food. After a while, I couldn’t even sit on my own back porch anymore.
I took down the bird feeder and in three days the birds were gone. I cleaned up their mess and took down the many nests they had built all over the patio. Soon, the back yard was like it used to be…quite, serene and no one demanding their rights to a free meal.
Now lets see…our government gives out free food, subsidized housing, free medical care, free education and allows anyone born here to be a automatic citizen.
Then the illegals came by the tens of thousands. Suddenly our taxes went up to pay for free services. Small apartments are housing 5 families. You have to wait 6 hours to be seen by an emergency room doctor. Your child’s 2nd grade class is behind other schools because over half the class doesn’t speak English. Corn Flakes now come in a bilingual box. I have to press “one” to hear my bank talk to me in English, and people waving flags other than “Old Glory” are squawking and screaming in the streets, demanding more rights and free liberties.
Maybe it’s time for the government to take down the bird feeder.
This is crap news, lets tell all the aliens where they can get WC from.

My experience with feeders is somewhat different. I’ve discovered that my welfare queen deer have figured out that if they reach up and kick the feeder, birdseed falls out. They’ve kicked two feeders into pieces.

I blame both; the illegals need to be deported and the businesses who, with prior knowledge of their illegal status, hired them should have their business licenses revoked and their company fined heavily.
There is enough blame to go around. The worker is still to blame for being here illegally. And let’s not forget illegal workers do have choices. They are not forced into this country or to take the jobs they take.
I have the grave misfortune of living in South Florida — home of hurricanes, rip-off “repairmen”, sky-high property taxes and insurance, over-crowded hospitals and schools. It gripes me to no end to stand in line in the grocery store behind a line of illegal immigrants waving their food stamps while chattering in Spanish. There are more signs printed in Spanish in my local store than in English. The illegals don’t bother to learn English. Why should they when Spanish is so predominant everywhere here in Palm Beach County? Sorry…just blowing off steam.

However, my fight begins when a group of workers are given more than they pay for. In other words, if illegal workers (for example) are paying $1 into the WC system, then, what the hell, pay them out their $1 benefit for legitimate claims like all the rest. Deport them for being here illegally, but honor the WC system of pay in-pay out for legitimate claims.
However, if illegal workers are benefiting from a system by paying less than their legal co-workers and benefiting from a transference of others’ premiums, then I have a real problem.
Does anyone know if illegals and their employers are paying in less and still receiving full entitlements?
A little logic would go a long way toward helping people who think like this.

I am a paralegal working for a personal injury firm in LA and the WC stuff is worse than you think. You cannot even ask in discovery whether the person is illegal or not. In most cases it doesn’t matter. I’ve also seen many cases where workers with legal temporary work permits from Mexico file fraudulent claims and usually get paid. There are a network of doctors along with the dishonest lawyers who help the legal and illegal workers create phoney claims and usually get paid. The workers comp reform in California really reduced the size of the awards but the problem continues. What really angers me is the state employees like the Highway Patrol and Prison guards that file for Workman’s Compensation right before they retire so they get 100% salary during the time of their retirement (they usually only get 50-60% - along with free medical care for life (and their families) from the state for them and their families. California is awash is this type of fraud. It seems that everyone is getting paid except the honest hard working people not in government.
TX, what are the other options? As long as businesses are willing to hire illegal aliens, then what else is there?

In the mean time, I’m going to have a bleeding heart and suggest that even undocumented workers deserve protection and recourse for a business that is abusing them. I obviously don’t expect any agreement on that.
Cut federal funding to these states and watch the practice stop. Simple. California wonders why it is broke and the answer is right there “in the shadows”. It’s the illegal invaders, stupid.

Rusty - I think I missed something… illegal alien workers are victims of abuse by the businesses that employ them? I understand that businesses should be held accountable for hiring illegal aliens, but I do not understand the abuse comment.
I have to agree with nuss that I am also pleased as an Idahoan that Idaho excludes illegals from WC. I guess open borders advocate “wide stance” Craig couldn’t put the fix in for his buddies at the state level. Although other than the Air Force Base most of the non-retail jobs in our area belong to Big Agriculture, which delves heavily in employing individuals of questionable legality. I would love to see some ICE Kabuki theater raids on some of these employers this summer.

You don’t seem to be aware that a large percentage of these illegals present valid-appearing documentation when they are hired. That’s an additional felony, or more likely felonies. The employer really has little choice if they have documentation. If you don’t hire them you risk a discrimination suit.

I can barely pay my cellphone bill and get no financial assistance from my state. Maybe it is time to become and illegal. Oops too late I came here legally and became a proud American citizen already. Darn! time to move to Arizona I guess!
When I worked the ER we would frequently get injured workers who the boss said he would pay cash to be treated. In those cases I would always notify workers comp just to ease the employers burden of course.

The employers have fought like hell to block any sort of employee verification. They want to be able to hire illegals. They are not the victims here.
Rusty, have you contacted the Democratic Party and asked them to pass the SAVE act, which cracks down on the companies which hire illegals? The Dems are currently blocking it for some reason.

Some employers have. Not all, or even the majority. Of course, companies like Tyson and ADM want to use illegals because they can evade minimum wage and other labor laws. However, they don’t even need documentation - in fact, if they accepted the illegal documentation at face value, they’d have to pay legal wages, negating the whole reason for hiring illegals in the first place.
There is no difference between the illegals and the companies that hire them. The companies can easily verify, but don’t want to do it because they can’t get the cheap labor. They need to be prosecuted to the fullest. The illegals need to be rounded up and deported. The expenses we save in the long run will easily take care of the expense of shipping them out. This includes medical, W.C., schools, bad mortgages, etc. Ever wonder why California is so far in debt? This is a big reason.
Rusty, I agree with you that the greedy companies that gleefully employ illegals are more to blame than the worker. I know people from Mexico who have been actively recruited by companies here in Kansas. The meat-packing plants are notoriously dangerous to work in, and employers benefit from the fact that most illegals will just look for work elsewhere after they have been injured.
And if I were an average person living in Mexico, I would be tempted to cross the border myself. The benefits this country offers would be very tempting indeed.
This is quite a paradox because employers hire people (and not just illegals) off the books precisely to save on W.C. premiums. Therefore, any attempt to enforce the rule that illegals are covered will discourage employers from hiring them, or so one would logically think.
Well a successful business is one without a soul. They are there to make the most amount of money with the lowest amount of costs. So of course they would be against more paperwork and legislation which makes it harder to hire individuals, cause then they pay more. Simple Simple Simple.

I would say that, for me, that does not equal abused employees exactly. ¡Pobrecitos! They came here illegally. They know that they are working illegally and they are fully aware that they get jobs because they accept lower pay. I do not think that any worker should be allowed to be abused as far as harsh conditions, lack of safety, etc, however, wage laws are in place for legal employees.
When companies hire illegals then both the company and illegal alien are at fault.

Here in Texas, we also see ALL products on the shelves with bilingual text. But whats even worse is that many of the products are turned around to the Spanish side, making citizens turn the box around to see the details in English! In Home Depot, ALL of the products are turned to the Spanish side.
Whats even worse is that the law enforcement REFUSE to arrest illegals. I was the victim of a “hit and run” a few years ago and had 2 passengers in my vehicle. I had to chase the criminal down, cornered him, then called the police in Garland, TX. While waiting for the police, I heard the illegal talking to his sister on his cell phone. I asked who he was calling and he told me in english. But when the police arrived, he refused to talk. They questioned him in both Spanish and English and he refused to tell them where he lived. He produced an ID card of some sort from Mexico, which the police briefly flashed in front of my face without letting me copy the details.
When I demanded that the police do something (a very risky thing to do), they pretended to be concerned and had me fill out a couple of “citizen complaint” citations of some sort which required I fill in my personal information (again). While one officer tried to block my view by leaning inside my car window while I filled out the forms, his partner was telling the illegal to leave (but I had his pick-up cornered, so it had to stay). The partner became increasingly frustrated and began screaming “bom-a-mose” or something in Spanish, demanding he leave. Finally the illegal left, walked off without his TOTALLY ILLEGAL vehicle (no reg. illegal tag, no insurance etc). As soon as the illegal left, the officer stood up, and said, “OK, we will issue these to the other driver and….” At this point one of my passengers interupted and said “Issue them to Who? Your partner just chased him off!” (remember, they didn’t get an address from him, so it was impossible for them to issue ANY citations or anything else for that matter).
I know this is long, but what was even worse is the police did not file any reports and I had to get a transcript of my 911 call (which was filed under a mix match of my actual name - even though the officers had my information in 4 different documents and I spelled my name clearly in the 911 call) and threaten to sue my Insurance agency before the damage was covered.
The city of Garland,TX also sent out a notice in the electric bills (electric is re-sold by the city) declaring to all illegals that they will not be deported or prosecuted for turning in citizens that commit crimes against them. They made it very clear that they were not enforcing “federal” law and wanted to assure the illegals that the city wanted to protect their “rights”. UNBELIEVABLE!
The end story is that illegals in Texas have True Freedom. Freedom from prosecution, freedom to get all free services available, plus work a normal job that any American citizen would take (and for the same money). While citizens are upheld to the full extent of the law. If the roles were reversed, I would have been sent to jail, lost my driving privilege and fined thousands of dollars. The illegal…goes free and I have to threated to sue my insurance agency while using the phrase “I am not responsible for the questionable actions of the Garland Police department, but you are responsible for the damage to my vehicle caused by another vehicle operating illegally on the streets of Garland Texas”.
One additional stake-to-the-heart:
The city opened a “Day Labor” building specifically for the purpose of matching contractors with illegal workers and billed it as a solution to stop the illegals from hanging out in large groups at stores and street corners. On one side of the building the illegals sign up and stand in very large groups (30 to 100 at a time) and on the other side contractors drive up and order workers. I wonder how much of a “take” the city gets on this arrangement?
God help us in Texas, we have NO RIGHTS anymore and the banks post more Spanish than English. I’ve lost my country and have become a “last class” citizen (I’m Irish/Indian but officialy called caucausin, so I pay for more and receive less than the other group (minorities - meaning non-white) and now I’ve also lost my right to have the law enforced against the criminals that make me a victim.

Wasn’t part of the Bush-McCain-Kennedy amnesty bill the eventual granting of social security benefits to people who were working illegally before amnesty. How do you figure out who is entitled to what when multiple illegal aliens share an SSN?
I would guess with almost certainty that the majority of all Americans want to halt this complete disregard for the law. However, it appears as though those “in-charge” could care less, no matter who we vote into office.
Our country is turning into Mexico, with American citizens becoming the backbone or “SLAVE” to the illegal. What else would you call it when someone reaps the benefit of some else’s labor, pays nothing in return and can do what he pleases without any fear of consequences or authority over them? For anyone interested, I know for a fact that the illegals in the Dallas area completely abuse the Social Services.
I have a relative that married an Illegal and they had an extreme dis-agreement over illegally using social services for the child. My relative insisted on honestly reporting their income and the illegal refused, saying the services are “Free” if they say he was not working. And he confirmed that everyone he knows (a big group) do the same thing and abuse every social service available. He also has been claiming 4 dependents for years when he had none. Needless to say, they broke up, but the relative had to move over threats from the illegal that he would take the child across the border.
The illegal has been working for Denny’s restaurant for over 10 years as a cook, making the same wage any citizen would make.
Each year Denny’s receives notice from the IRS that the social security number for him is invalid, but he continues to work for them.
I say prosecute Denny’s and deport the illegal. In other words, ENFORCE THE LAW and Protect Our Citizens! Hello? any body up there in DC? NOT!
Yet another reason we in NYC pay the highest tax in the entire US. If we’re going to pay for them to have workers comp, maybe we should go out and make sure they actually have an injury to be compensated for..
Actually this doesn’t even make any sense.. how can someone be compensated for work that they’re not actually doing - at least not legally. Does this mean if a drug cartel runner gets breaks an ankle while running across the border from Mexico with a load of drugs, they can then claim WC if it happened in the US? Well going by what I see here, yes, they can. Meanwhile the cops in NYC give out hefty fines for putting your bag on the seat next to you in the subway, or for dozing off on the subway, or for sitting on a milk crate, or for having too many words on your shop awning. Seriously. What a ridiculous joke the united states is.

Well Rusty, I also blame them both. I would love to see some of these employers actually all of them, especially those who do it all the time in the slammer. But the illegals are here illegally. That means they have committed a crime. But that means nothing to good hearted libs who want to make sure the taxpayer picks up the tab.

You would think that this rule on Workers Comp would open Pandora’s box concerning other payroll costs. Wouldn’t employers now also be liable for unemployment and disability insurance on these same illegal workers? How about Social Security and Medicare taxes? Yikes!
Even the unions in the Dallas area have illegals as members (halve or better according to the word of mouth in the area).
They don’t care.. just collect 4% of each paycheck, plus collect the monthly dues. The unions are in heaven with this arrangement! Meanwhile, the reason employers can’t get Citizens to work is because of the language and culture barrier. Who want’s to work at a job when your boss (foreman, super.. whatever) speaks very little English and most everyone around you speaks Spanish? Not me.
Communication is critical in the workplace, so not only are they completely breaking every law, but they also put citizens at serious risk and push them away from employment. Yes, this is the only circumstance where illegals are “doing jobs Americans won’t do” as Mr Juan and Juan say.

W/C coverage of illegal aliens is actually the result of several state court decisions. Employers hired illegal aliens and didn’t pay w/c on them, the illegal alien got injured and wasn’t covered by w/c and sued. The courts, using state law, said the employers must carry w/c on their workers. Period. The cases generally threw out any discussion about whether the worker was legal or not as that was a federal question. The employers brought this on.
Sadly, illegal aliens have now taken advantage of this in many areas and have an extremely high rate of bogus claims. There are people that train them how to go about creating bogus claims and clinics that file bogus injury reports. It’s a big business, as the clinics receive more money for “therapy” than the illegal stooge receives in w/c pay. And, of course, the employer’s w/c rates go up for ALL of his employees due to his high rate of claims (which seems to prove that he operates a dangerous workplace). At least the employer is punished somewhere for employing illegals.
I cannot accept the nomination. that’s a tough nut to crack.

Illegal worker in Rhode Island wins workers comp award
Edgar Velásquez, an illegal Mexican immigrant who accidentally slashed his face open with a chainsaw in 2006, on January 14 won a $30,000 settlement in a groundbreaking case against the owner of a Rhode Island tree service company. I have posted on this case several times. Thanks to Global Workers Justice Alliance for alerting me to this recent development. Velasquez is back in Mexico. Let’s hope he actually receives the award that he won.

PROVIDENCE — Edgar Velásquez, an illegal Mexican immigrant who accidentally slashed his face open with a chainsaw in 2006, yesterday won a $30,000 settlement in a groundbreaking case against the owner of a Warwick tree service company.
Velásquez was working for William J. Gorman Jr., owner of Billy G’s Tree Care, who hired the 22-year-old and then turned his back after Velásquez sustained severe injury.
Velásquez alleged that Gorman tipped off immigration authorities, who arrested and deported him before he could pursue his rightful claim under state law. Last fall, one year after his deportation, the U.S. Department of Homeland Security granted Velásquez a rare humanitarian visa that allowed him back into the country to face Gorman in court.
Chief Workers’ Compensation Judge George E. Healey Jr. said the settlement should put employers on notice.

Can prostitutes get W/C for their “illegal” work? Serious. Think about it. The Federal Government is the sheriff, the Sanctuary States are the Pimps, the Companies that illegally hire the workers are the “Johns” and the illegal invaders are the prostitutes.
We have a sheriff willing to turn his blind eye on all the illegal activity going on and the Johns are getting the prostitutes to do the jobs their spouses won’t do (I think Spitzer exlains it better) and we have law abiding citizens calling on the Sheriff to clean up their neighborhood and especially the corner (usually a Home Depot) where the Prostitutes hang out.
In an attempt to clean up this mess, we need to elect a new Sheriff that agrees to fix the problem. This means putting in a new President and Congress that are willing to fix the problem.
Just like the stings we see in the news regarding the real prostitution stings, the same thing needs to be done with the illegals. We plant Ice workers as the prostitutes where the Johns come to get their fix. In this case the Johns are contractors. Ice then busts them for hiring the illegal and they lose their contractor’s license.
Soon the Johns would fear getting caught and would return to their spouses.
(It needs a little work but I never claimed to be a Michelle Malkin. Hope you get the point)
Here’s another brain teaser from our finest legislative minds. Congress and many states have passed laws aimed at human trafficking that punish kidnappers, smugglers and strong-arm goons. So far, so good.
But these laws come with a basket of goodies to the victims, real or “alleged,” that amounts to a bonanza for the social services lobby (taxpayer-funded counseling, legal services, etc.), as well as special visas that would speed up green cards for “trafficked” persons. I use quotation marks here because trafficking is not well-defined and any illegal can claim to be coerced, or can even fake his or her passage here as falling within the trafficking definition. This means that “trafficked” hookers get a higher priority for green cards than decent folk who have been on a 20-year waiting list.
These laws also require that traffickers compensate their victims according to the wage standards of the labor performed. But, again, how do you compensate trafficked hookers? And doesn’t this effectively legalize prostitution through the back door? (No puns intended.) When questioned, lawmakers reply that there should be no compensation for illegal activities, but don’t hookers here presumably against their will face working conditions more hazardous than restaurant dishwashers? Doesn’t such an exception violate the 14 Amendment’s equal protection clause? Hmm.
Rusty that thinking is completely flawed that one must pick whatever crime is worse. Both employers and illegals are breaking the law. The USA is a nation of laws and both should be punished. If we carried out justice in regards to “picking” whatever crime was worse, we’d never nip crimes in the bud to save potential problems later.
My bleeding heart goes to neither. Punish both severely. Both are premeditated crimes and hurt a lot of people.
Here in Texas it’s absolutely rediculous. Illegals think they should have all the rights of citizens.
We need to:
1. Fine and imprison those that hire illegal aliens.
2. Strip them of their business licenses and coporate charters.
3. Permanently ban the employers and officers of the company/corporation from city/county/state and federal contracts.
4. Fingerprint, DNA test, and deport the illegal aliens to point of origin.

I actually have a possible solution to use this situation to our advantage:
Step 1. Require claims from illegal aliens to be reported to the state’s insurance regulatory commission. Call it “necessary to insure that legally required payments are not being witheld from valid, elligible claimants.”
Step 2. The IRC is probably already legally required to report possible abuses which may be being used as an illegal tax-shelter to the state’s tax agency. Just pass a law (de)clarifying that “Workman’s compensation payments are treated as taxable income, and any falsification of tax documents for the purposes of securing payment for a claim, even if the claim is valid, may constitute criminal tax fraud, especially if that income is misreported or not reported on applicable tax filings with a valid TIN.”
Step 3. Bingo presto, the Tax board has a ready-made list of WC claims for illegal aliens, the (fraudulent) TIN’s and SSN’s they filled out their insurance info with, and the companies who hired them. Give the state tax board the chance to not only start investigating and prosecuting the bejeezus out illegal aliens for tax fraud, but also give it license to go after companies that it reasonably suspects of committing tax fraud through the hiring of IA workers.
Hey Mr. President of Exploiters R Us Inc., we see you reported witholdings for all these minimum wage employees… Funny, they don’t show minimum wage income on their tax filings to report their WC payments… and we have some questions about their social security numbers…
Because these claims are legally required to be paid, the guilty companies get hit with the double whammy of litigation, AND sky-high workman’s comp insurance premiums.
In this manner, companies which are prone to hire illegals won’t stay in business long, and the incentives for illegals to break the laws will disappear. All without immigration even being mentioned as the true motivating issue behind the change in legalese.
Heck, the British killed off the slave trade in the same round-about way…. exploiting the pompous leftists who are only too enthused to agree to more and more legislation that appears to be useless on its face but “sounds good” to the electorate. Let them claim they’re “fighting tax fraud” with the conceited self knowledge that they scammed the taxpayers for their bloated salary yet another day. By the time they figure out the game, we’ve already won.
After all, there left hasn’t claimed any BS that there’s something “racist” about prosecuting tax fraud… yet anyway.
As an added bonus, this allows states to do something proactive without any risk of being back-handed by the fed for stepping on their floundering immigration powers territory.

Deport the illegal aliens. Consider modifying the Citizenship clause of the Fourteenth Amendment to assign the citizenship of children born here to that of at least one of the parents. Let’s follow the enlightened path of some of our European friends.

the most effective law that has been passed and upheld is the state law recently passed in Oklahoma. Republican state legislator Randy Terrill is the author of the great law.
it penalizes illegals, those who employ them, and those who aid and abet them. and most of all, it takes away all public benefits from illegals.
it has resulted in the self-deportation of over 25,000 illegals from that state.
if all 50 states had the law, and a federal law was also passed by Congress, then you would see a huge reduction of the problem in this country.

My 4 step plan to eliminate Illegal Immigration:
1)cut off social services to illegals. They can still get truly emergency medical care, but if they can not provide proof of citizenship then make it mandatory that ICE is called.
2)prosecute companies that hire illegals up to and including incarceration and loss of business license.
3)Prosecute Illegal Immigrants who use stolen identies to obtain employment and/or benefits
4)Bill the foreign nation where the illegal alien came from for the costs of the incareration, medical expenses and deportation cost. To collect on the bill, reduce the foreign aid to that country by the amount of the bill.
If we do these four things there will not be ane illegal alien problem.
Abandon liberal values and have more children, that’s what. Oh, but your party doesn’t want to give up porn, prostitution and adultery.

Worker’s Comp, that could make them more attractive to the scumbags who hire them.
Better would be a situation where the EMPLOYER was liable for any injuries sustained by an illegal alien on the payroll, where the employer has to pay out of their own pockets the cost of medical care; however the illegal doesn’t get to collect anything except a bus or plane ride back home.
And last I knew there wasn’t any tax money involved in Worker’s Comp aside from whatever is spent by the various state labor departments to oversee it.

I have sent this onto my Rep’s multiple times and get the same canned letter response about the good that they have done (none that I have seen). At this rate I am tempted to throw my hat in the ring an run on solid Conservative priciples. I doubt that I would win (like most average Americans I do not have the cash to bankroll such an effort), but if I at least got more people talking about this issue and many others it would be well worth it.

I have had several friends agree with this same train of thought…Bill the country that is encouraging and assisting the invasion /takeover of our country. I live in Texas, so it truly feels like an invasion.
In RI, they don’t necessarily talk about WC for illegals, but late last year Sen Reed did negotiate with the Mexican government to fly back a deported illegal so he could sue for benefits. What happened was he mangled his own face with a chainsaw while at work. He got over $30k plus an all expenses paid vacation back to RI (and our fine hospitals) courtesy of the state.

I worked for several yrs for a CO WC defense firm. Although ti supposedly says that ‘legally authorized’ aliens…that’s BS. I can give you information about several different illegals that have received or are receiving WC benefits..if they have not settled.
One of them is a young man. Walked across a stairwell & the cardboard broke, sending him down 2 floors. His co-workers PICKED him up and moved him to his uncle’s truck, instead of calling 911. Left him there for the day, moved him to his uncle’s LR and he was finally taken to the ER 24 hrs after incident. He is a quad - however, since he can move some fingers slightly, he is a high functioning quad who had a vehicle retrofitted so he could drive. House was retrofitted. His mother, wife and toddler daughter were brought up here to care for him and were being paid for caring for him. That’s 4 of them here. They were in the midst of settlement discussions when I left, but there were a LOT of demands. He was working for a sub that didn’t have WC, so it fell to the contractor to pay for it.
Another woman, in her 50s, lost her job after an injury. She was released back to work and the position was discontinued…economic downturn. She was able to draw permanent and total disability, in spite of being released for work with no restrictions. Her ‘disability’? Little to no English. If you are Spanish speaking, WC injury and can’t get another job, you can claim total/perm if you cannot speak enough English to get another job! This woman has been here over 20 years…she can speak English, but we had no way to prove it.
Swift was one of our clients - the plant ICE did a big raid on 2 yrs ago…yep…had a number of claims the day after it.
CO gives WC to illegals, they just do not want to advertise it, but if you are an employer here hiring illegals, then they can claim WC for job injuries and get it. If you do not carry it since all your employees are illegals…look out. You will be in trouble. Not for hiring illegals, but for not having WC for them.
