Judge upholds illegal alien sanctuary in L.A.
I know many of you are already sick to your stomachs over bad court news today. Sorry to deliver another one. La Raza/The Race cheers. McCain and Obama, any comment? Nada?
Via KNBC:
A Los Angeles judge dismissed a taxpayer lawsuit Wednesday that sought to repeal a long-standing directive prohibiting Los Angeles police officers from asking arrestees about their immigration status.
Los Angeles Superior Court Judge Rolf M. Treu sided with the city and the American Civil Liberties Union, which claimed there were no triable issues raised in the suit. He heard arguments on the motion June 10 and had the case under submission since then.
Los Angeles resident Harold P. Sturgeon filed suit in May 2006 against police Chief William J. Bratton and members of the Police Commission, seeking to have Special Order 40 declared unlawful.
In court papers, Sturgeon’s lawyers called Special Order 40 “essentially a ‘Don’t Ask, Don’t Tell’ policy regarding illegal aliens.”
Sturgeon asked for a permanent injunction preventing taxpayer money from being used to enforce it. He and other critics said the 28-year-old mandate from the Los Angeles City Council hampers the LAPD’s ability to exchange information with federal immigration officials.
The order is intended to avoid discouraging illegal immigrants from reporting crimes and assisting police.
In their court papers, lawyers for the City Attorney’s Office maintained the directive does not prevent the LAPD from working closely with federal Immigration and Customs Enforcement officials.
“There is no evidence … to show that ICE has ever complained that they have not had the assistance of LAPD, or that LAPD has not come when they are called,” the city’s court papers state.
In their court papers, ACLU lawyers maintained that Special Order 40 is consistent with federal law and not in conflict with it.

In related news, McCain and Obama will attend the “Latin American National Congress” on July 18 and 19 in Los Angeles. Via reader Edgar M.:

informador.comThe two virtual presidential candidates will discuss matters of interest for the latin american community in this country.
The Angeles.- The virtual presidential candidates, Republican John McCain and Democrat Barack Obama, will be the guests of honor at the third Latin American National Congress, that will be carried out on July 18 and 19 in Los Angeles.
The organizers confirmed the participation of the two politicians in the event, that will be performed in an exclusive hotel in Downtown Los Angeles, where it is expected that more than 300 organizations of 20 cities will attend.
On the first day, McCain will be presented during lunch and Obama at dinner. The two virtual presidential candidates will discuss matters of interest for the latin american community in this country.
In the First National Latin American Congress of 2006, 70 resolutions on diverse issues were taken and 260 local and national organizations assisted, in 2007 300 cities attended and 98 resolutions were adopted.
Among the issues undertaken during both congresses were educational reform, migration, public health, urban development and foreign policy, among others.
The organizers advanced that they prepare an ambitious agenda to promote the registration of millions of latin Americans as new voters in order to continue growing like a political force that can influence the elections next November.
The leader of the Latin-American Mexican Brotherhood and the Mexican-American Political Association (MAPA), Nativo López, indicated that the young voters can make the difference in the electoral mobilization.
‘In this electoral year we should move and act as a united family so no one is left behind’, indicated López, who considered that another of the issues that will be emphasized in the debate will be driver’s licenses for the undocumented.
Among the organizations that will attend the event are the Willie C. Velásquez Institute, the League of Latin-American United Citizens (LULAC), the Mexican-american Educational and Legal Defense Fund (MALDEF) and the National Network of Day Laborers (NDLON).
As well as the Hispanic Federation, the Educational Project of Registration of Voters of the Southwest (SVREP), the National Alliance of Latin-American and Caribbean Communities (NALACC) and the Hispanic National Council on Environment (NHEC)

Pass the duct tape, my head is about to explode.
But they DO get to be put under Double Secret Probation.
I have an idea! Since Arrest are public record, how about forming a citizens board to review each arrest and report illegal immigrants to ICE?
Doug, that actually isn’t a bad idea. The only problem is that those of us that would do that are busy working to pay the taxes necessary to support the illegal alien infrastructure…….

I suppose Rush Limbaugh has enough audience that stations can carry him and an equal time anti-Limbaugh with no ratings and stay profitable, but when Obama becomes President, say goodbye to Savage, Levin, Ingraham and Hewitt.
Pelosi says Dem caucus is interested in restoring the ‘Fairness Doctrine’.
This kind of judicial abuse is just making the citizens angry it’s only a matter of time before people start taking the law into their own hands.
Immigrant crimes are up around the country. The bad thing is innocent legal immigrants are getting caught up in this mess of the crimes against immigrants!
Making me sick when I hear things like this? No.
Stoking my rage? Yes.
I wish McCain wasn’t an idiot.
My wife’s family are Hispanic, her father is a legal US citizen born in Mexico, and Hispanics who played by the rules do not favor open borders.
Enough pandering to illegals! How many of these crimes that the police want reported occur because either the criminal, victim or both are here illegally? What good does it do to report the crime if the illegals are not identified and deported? I can’t wait to get jury duty for any of the crimes committed because our elected officials think that making these people voters is a better idea than listening to the current LEGAL VOTERS.
Next time I’m pulled over and asked for License, Registration, and proof of insurance, I’m going to refuse saying I’m an illegal invader and I have rights that protect me from the police.
If a cop smells alcohol he can do a breathalizer and a field sobriety test. If he “smells” illegal entry to the US he should be allowed to request proof of legal entry. Anyway, it should be a normal part of any cop as our first line of defense to check this. Are the Feds omnicient? How are they supposed to investigate something they are unaware of? We are, or were at one time, countrymen working towards a common goal. Now we have social engineering Marxists openly working to rewrite the constitution through the courts. Sweet.
Maybe I can start ignoring laws I don’t personally agree with. How ’bout them apples 9th District Court? Marxist toads.
The both of them are Whores!
Do you see why I cannot vote for the Republican LOTE?
PS the last LOTE for whom I was talked into voting- by my R friends -was ARNOLD…
THE LAST LOTE for me!!!!!!! LLM
# 10 John A..Your idea bears serious consideration!
Christian Soldier, I feel your pain. I was duped into voting for that Liberal running as a Republican.
This is spilling over into the outlying areas they are being overwhelmed by the flow of illegals from the anus of Southern California that is LA. I found out more info on the half dead body dumped on the emergency driveway that I mentioned a week ago or so. It was gang retaliation, a couple of white gangs were exchanging blows as a result of a gang sign flashing. Ok you got me, I was just kidding about the white gang part of that. It was a fourteen year old something or other, I don’t know if the brick that eventually killed him was legal or not but I suppose when one side of your head is missing it don’t really matter. I just love what they have done with my home..Not!
Why is it that every time I start to think I just might support McCain he goes and pulls a bone-headed stunt like thie?
The high school near me was 12% mexican ten years ago… it is now 36%.
Head in the sand McAmnesty won’t be happy until it is 100%… bastard!
Always remember that the gang problems that are in LA has nothing to do with sanctuary city status or Special Order 40.
Soon, if you want to protect your own sanity, you will has to shove your own head up your own arse. UGH
and some posters wonder why we will NOT vote for McCain.
Sick of hearing about it.
I do not support any liberal and he is one.
California judges…?
And the thanks we get for letting the illegals invaders stay.
That’s sarc, right?
There is a little good news in this. At least private citizens are taking action to try and stop this insanity.
Keep upIncrease the pressure, everyone. The illegal gang members will eventually go to far. It is only a matter of time before a prominent judge, lawyer or their family members are a victim of these violent illegal alien predators.
Southpaw – I doubt it. They live in gated communities with armed guards to protect them…
Liberal judges have eroded the rule of law to the extent that no one knows what the law means anymore. It “evolves” faster than anyone can keep up with it. Law and order is fast becoming neither law nor order, only chaos. Yet somehow I get the feeling that Liberals want it that way.
In case you have forgotten here is the case that brought the special order 40 up.
LA Times
Meantime we stand ready for the next illegal to kill under the measure of special order 40. Thanks No Angeles. ( No Angels)
The judge refused to legislate from the bench. He refused to overturn the proper directive governing police policy. Boo freakin hoo. If you don’t like the directive, vote the bums out. Otherwise, suck it up.
Yes, and cheap ones at that.
Someone should get copies of the resolutions passed in the past meetings of this organization and what is on the agenda this time and pointedly ask the candidates which ones they support and oppose.
Guaranteed that quite a few are all about circumventing US immigration laws and how to use the ACLU/MALDEF types to get around other laws.
Wonder how much taxpayer money goes to these groups…
lgm, they’ll jack your car and kill you and your family if they have to, just like anybody else. If that happened and it turned out to be a an illegal that should have been deported previously, at least I’ll have the dignity not to say “Boo freakin hoo”.
That’s strange – Phoenix police seem to have a different opinion:
Southpaw, until it happens to him or a close friend or relative he could care less. It’s the same thing with these judges and lawmakers who are shoving this down our throats. Unless and until it happens to them the best they can do is “boo freakin hoo”.
BTW I live in mean PWC in NOVA and they’ve cracked down on the illegals. They’ve all headed to Fairfax where they’re welcomed with open arms. I say good riddance to them.
Proper directive , my a$$.
How about a little law enforcement? See Phoenix police quote, above. And as the NJ Atty. Gen. finally came to her senses last year and reversed their sanctuary policy after a 2 time loser illegal felon killed 3, and tried for a 4th, last year in Newark.
The very first two illegal aliens arrested under NJ’s new no-sanctuary policy were wielding machetes in their neighborhoods!
Michelle – have you stopped giving the common sense screening test for new contributors? PLEASE reinstate the old policy!
Aw, what’s a little machete wielding between neighbors? Happens all the time, don’t it?
LGM’S Amigo. Wonder if you would like telling the family of the murdered about their loss?
The professed benefit of Order 40 is such a fabrication. If 40 were not in effect there would be no need for illegals or legals to report crimes committed by illegals and MS whatever’s. They would be long gone and not available to commit crimes in the L.A. jurisdiction. Oh well, perhaps this is the politically correct clinging to their victim hood and liberal degeneracy.
I guess this judges’ ruling means you can’t ask these guys about thier immigration status:
http://www.latimes.com/news/local/la-me-drew26-2008jun26,0,7856136.story
From the link above, just doing the Ma Barker job Americans won’t do:
During one raid at her house in 2002, police found cocaine, marijuana, a Tec-9 assault weapon, ammunition, a small explosive and a cellphone that was ringing with customers’ drug orders, according to court records. Also in the house were six children under 10, including Leon’s youngest child, a 3-month-old boy
Well who’s going to deliver the papers now, Southpaw.
13 anchor babies, unflipping believable….well not really.
I’ve got a plan, Southpaw. We take the gang members from your link and place them in this place and we can clean up the streets with one big 4th of July party. We can have vedors at that party selling custom body bags.
National sovereignty, who said anything about national sovereignty?
AGAIN…..How many BILLIONS of US taxpayer $$$$ (your and my $$$$$) are going to the corrupt Mexican government to secure ITS Southern border??!!!!!!
How many BILLIONS of US taxpayer $$$$ are going to provide FREE everything to illegals and their children?
The high school near my home has installed “free lunch dispensers“.
Over 50% of the students now get free breakfast AND lunch. The lines have become so long that students couldn’t get their free, taxpayer provided lunch in the allotted lunch time. Soooooo, they have installed vending machines that are filled up with hot meals BEFORE the breakfast and lunch periods start. Students go up to the machine, enter their free lunch ID number, and our tax money provides them with a nice hot meal. But get this, these machines are HIGH tech! They are covered all day by a metal “garage door” that is opened with a handheld remote control when the food needs to be put in, and closed remotely when the meal period is over. They had to use our taxpayer money to get fancy machines that use remotes because, heaven forbid, someone, paid with tax dollars, actually has to open or close a gate by hand…
We are doomed, doomed, doomed…. and by the way, a lot of that food is just thrown away by the kids.
Isn’t it nice that their parents have two meals a day paid for by us taxpayers? I sure wish I was able to get free food for my family!
Damn those slackers, McAmnesty and the democrat liberal leaches to hell!
Your courts already ruled on that. Remember Reginald Denny? The judge in that case ruled a brick is not a deadly weapon. I thought about marketing “Brick on a Stick” after that ruling.
Well maybe that’s why I have never had to worry about my weight like many must today. In my school days no one except mom gave me a meal. Besides I tried as hard as I could to minimize breakfast and I altogether shunned lunch, too busy doing stuff like being a kid to have time for gorging myself. The result is, I can now safely gorge myself over and over if I want to. I was thinking of going to Denver for the crat convention and walking up and down on the sidewalk eating a big fat burger and honkin load of greasy fries (imported and paid for in my own dollars). You know, pull out all the stops and really pi$$ them off.
OK some of you think illegal Mexicans are eeeevilll. That doesn’t give the court the right to tell police how to do their jobs.
Don’t think the kid last week read the opinion, tough luck for him I suppose. Yes we remember Reggie and all of the dirty facts that go along with it, won’t ever forget. I propose drug tests with every ruling, oh sure, I know we can’t drug test our way out of this one, but it’s a start.
This makes me so happy that I decided to move to the middle of nowhere Idaho instead of returning to California after retiring from the Air Force. Now if I can only get my youngest brother to flee Sacramento with his family before this dying state breaks down completely.
lgm says that some uf us think illegal mexicans are evil…? dah. all of us think illegal mexicans are..ILLEGAL.
Mexico is essentially pulling a Muriel boatlift on us. They are not exporting anyone except their thugs and indeginous peoples. How come our media will not call them on their own racism? I work by the border, the uber good-looking novella soap stars are not the ones jumping the fence. Obviously, unless you can trace your ancestry back to Spain, forget it. Better head north.
Let’s hear it lgm, i’ll say it for you. Since many of the Mexican people believe that the indeginous ones, those whose ancestors were already in what is now Mexico, are eeeevill and the same “fairer” skinned Mexicans cause those historical tribal populations to displace themselves into the U.S., it is time to start charging these Mexican elitists with hate crimes and forcing them to accept the fact that the Mexican land needs to be productive for all of her citizens.
Fools. Bye bye LA. Don’t even think of bringing your society killing liberal crap to the rest of the country. Every CA liberal should be forced to live there forever in the sewer they themselves are creating. But sadly, they will ruin the city and state then move off to somewhere else when it becomes unliveable for honest hard working citizens. Of course, they will set the new place on the same destructive path.
Actually Weary Citizen they have in many, many cases moved here so you have a perfect example of what you laid out already. We end up with the retched refuse of other states and have for several decades now. That’s why some people say we are rude you bet we are we know who these people are we know where they came from and in many instances we know what they did to get booted back home. If you had these people in your state you would become rude too. They don’t fit in here with us, they don’t agree with us, you can see it in the propositions we regularly put forward and pass only to see these rats usurp the will of we the people. The society killing lib garbage was developed in the North East and is, if you research it, on display there even before WWII. You can blame us for allowing these rats in but you cant put the finger on us for creating that crap.
The generic solution to court activism seems simple. Congress should pass a law that says rulings that create a point of law only last for 5 years times justices in the majority.
It’s long past time that the legislative body take back their power which was unilaterally declared to belong to the Judicial branch by the judicial branch. If Congress passes a law to the contrary and gets the executive to sign it, they’d have the majority on this issue.
The judge refused to legislate from the bench. He refused to overturn the proper directive governing police policy. Boo freakin hoo. If you don’t like the directive, vote the bums out. Otherwise, suck it up.
