		<description>ahh, a late friend of mine was in a car accident. the owner of the car was thrown out, my firend was pulled from the passenger seat severly burned.

the family of the owner blamed the person in the passeringer seat for the death of the owner.

It sucked, the passenger suffered sever burns and permenet scars, yet he was publicly blamed for the death of his best friend.

such is life (and death) I guess.</description>

He hit the car and the lady died.  He was not charged with vehicular manslaughter for many various reasons. It still haunts him to this day.  By the logic of some people here, should my brother be punished forever and ever and be forced to relive an accident because some people think he got off easy? First, I NEVER DRIVE AND TALK ON THE CELL PHONE.  If I did run a light or stop sign and t-boned you, you have every right to take me down and, I am sure that you would.

To put this in perspective.  When I was 17 I was involved in an accident causing injury to a man on a motorcycle.  I was charged but, I was not at fault.  The guy was riding in the blind spot of a van (he couldn’t see me and I could not see him).  I, being a rider myself, always watch for motorcyclists.  I pulled out slowly looking for the guy while the van pulled into the turn lane.  The motorcyclist saw me, panicked and slammed on his brakes and slid into the median, flipped and was hurt pretty badly.  Later in the hospital I visited the guy (mind you I am 17) and talked with him.  He asked what happened and I told him.  He said he was at fault but the &quot;law&quot; didn&#039;t agree.  I paid for everything.

Now, here is the part where I am supposed to admit I committed a crime.  The truth is if I had not been the guy looking for him and it was the average Joe, that man would be dead.  Any other person would have pulled right out the cyclists would have t-boned the car and it would have been the end.

It&#039;s like Rush and Bill O&#039;Reilly have been saying: most of the newspapers in this country have had trouble and are losing subscribers. I don&#039;t subscribe to any newspaper, and if I ever did, it would only be for coupons.

That is a far more philosophical question than I want to get into.  Should the punishment be commensurate with the intent?  Sure and in almost all cases, it is.</description>
