Update: Charges dropped against dad who defended son from molestation
You’ll remember this blood-pressure-raising story from two weeks ago. Jason Beatrice, father of a four-year-old boy who was reportedly molested in a Raynham, MA grocery store, was charged with assault after coming to the defense of his son.
I just heard from the Beatrice family. The charges have been dropped:
Dear Ms. Malkin,
My mom just called me to tell me the charges against my brother were dismissed!!!
As for the man who touched my nephew, he didn’t show for his arraignment and I haven’t heard anything more about it.
Thanks again to you and your readers for supporting my little brother and my family!
That’s the good news.
The bad news: The accused molester was a no-show at his arraignment yesterday.
Via the Raynham Enterprise News:
An elderly man accused of groping a boy in a Raynham supermarket bathroom reportedly failed to show for his arraignment Tuesday.
Market Basket janitor Valerio Rodriguez, 71, of Providence faces a felony indecent assault charge after he allegedly reached under a bathroom stall partition and touched a 4-year-old boy’s calf June 1.
A judge at Taunton District Court issued a default warrant for his arrest and added a “do not release” order to it, said Gregg Miliote, a spokesman for the Bristol County District Attorney’s Office.
“Once he is located and arrested, he cannot be released until he goes before a judge,” Miliote said.
That means a judicial officer, such as a justice of the peace, cannot release him on bail if he is arrested overnight, Miliote said.
As of early Tuesday afternoon, Rodriguez had not been located, Miliote said.
Gee, I wonder where he could have fled.

This great news! Congrats Mr. Beatrice.

As for the scum of the earth who fled… stay gone!
So much for trying to show the man some compassion because of his age. When will they learn?
Shocked, I’m shocked this ILLEGAL ALIEN did not show up for his court date.
Probably heading for San Francisco, he’ll be safe there.
Sadly, I live about 20 miles from where this happened. In the “sanctuary” state of Massachusetts. I’m up to my armpits in liberals.
My b.S. Meeter just pegged 15 (and it only goes to 10). All he needs to do is head to San Fran. Free at last, free at last.
LOL Mojoe, didn’t see your post before I wrote mine.
SF is a good one…but Hartford,CT is a more likely run for the border…
I hear a ‘deep sigh’ from Diane Sawyer concerning the message this says.
As earlier linked in MM’s first article:
Umm ooops?
As MM ponders:
Great minds sir, great minds.
“He was just playing.” When he learned it wasn’t a laughing matter… poof – he’s gone.
Meanwhile, the father was busy being treated like a criminal.
Justice was served! /sarc
Michelle,
Thanks for the update. Great news of the day for the Beatice family. Hope they find Rodriquez.
L
Hey Michelle, look at this sob story! Boo Freaking Hoo.
Was it ever determined that Rodriguez was here illegally?
If the guy on the run was smart he would turn himself in, according to the last story things are getting pretty cozzy inside prison.
plus he would prolly have friends with benefits… ew.
Great news and it is not even Friday yet!
Our Criminal Justice is log due for an overhaul when it comes to child molesters. They get too much of a pass and therefore, they have no fear as repeaters. They need to all find God, within one
yearmonthweek of their crimes.…System is long overdue…
Can you tell this hits a nerve with me?
Do you mean in the conversion sense or the meet ones maker sense?
Well, so much for those communications Chief Pacheco had with me by e-mail where he kept telling me to wait because “there is much more to the story than what you have been able to hear or read in the media” and I “shouldn’t believe everything [I] read or hear.”
I guess there was so “much more” that had not been taken into consideration that they finally had to drop the charges.
Mine broke, John.
I’m good with the latter. And, in that vein, they had better start working on the prior.
At least the father got in a few punches. I know it’s not much but its something.
This was in MA? He was probably late for a legislative vote.
Hmm….there’s a little sanity up here in the People’s Republic. Who knew?
I thought it was real clear chap! Child molesters do not make good converts. They will meet The Maker. The process should be expedited.
I like that bit in Ron White’s standup routine where he talks about the death penalty in Texas and while other states are reviewing the death penalty and allowing endless appeals, Texas is putting in an express lane.
When this happened I left a comment of support on the aunt’s blog and mentioned the support she and her family had from Michelle and the good folks here on this. Happy to hear things worked out for her brother! A family shouldn’t have to deal with such a thing.
I didn’t think the charge would hold. What prosecutor in his right mind would want to pursue this? I doubt if there is a jury in America who would convict the father.
As for the perp… they should start looking under some rocks…
It doesnt say from anything i’ve read, but based on the story, i’d be willing to at least state its a strong possibility.
Glad they showed some common sense here. Charges should never have been brought against this father.
It’s Massachusetts.
Can they even ask?
He sure can run fast for an old guy, 30P!
I never could find anything that said whether he was here illegally or not. Based on what I did read though, I came away with the impression that he, probably, is/was here illegally. But, like rike101 said…
And, even if they had ask, I wouldn’t expect to see it printed by the MSM. That is outside their normal MO. If they ever do print such information, in most cases, it is buried in some obscure area of the article.
If that’s the case, I wonder if the dad has any recourse against Market Basket?
LOL Barry F. hope your meter can be repaired. It’s getting close to November.
Dad should have never even been charged!!!
Look for the molester on Market St.
If this even happens to my kid, I’ll guess I’ll have to break the guys legs during the fight so he can’t flee since the criminal justice system can’t keep people from fleeing.
Congrats to the Dad – he should never have been charged in the first place.
As for the alien criminal, he should now be caught, jailed and when sentence is complete…DEPORTED. (even legal residents can be deported for crimes of moral turpitude).
Mookie,
I’m no lawyer, and i’m not 100% on law there, but…i’m sure he could make things really uncomfortable. He prolly could make a solid case of negligence on the part of the business owner, or get them for hiring an illegal if thats the case. i’m sure there are legal remedies for this there, just not sure about what they are for that location.
It’s MA. I wouldn’t take for granted that they have any legal remedy for the market having hired an illegal alien in MA, if he was illegal.
The Father needs to get in the gym. The perv did not spend two months in the Hospital.
If you live in MA…your citizenship is about as worthwhile as ENRON stock…Now if you are gay, Illegal or a Kennedy, you can drive drunk and kill someone and still hold your head up high….You can also have a passel of kids and everyone else will pay for them for you!
AH America -Home of the FREE LUNCH!!!(the whole enchilada!)
Hey Leatherneck,
Good point. Sounds like the dad needs to give the cops a lesson on how to handle thugs when he finishes his workout. Apparently they are more worried about protecting a molester with a fat lip than they are about taking out a predator who is attacking a child, like he has probably been doing for 50 years.
I could puke.
Americangrunthog:
Don’t blame the cops. If the perv was punched, and told the cops that he wanted to press charges, (and if they could see that he was indeed hit), then they must charge the dad. I am sure they knew that the charges wouldn’t hold. It was just a formality.
He’s at the ICE office, trying to self deport
Hallelujah! Glad to know there still exist some common sense in Massachusetts.
I love it myself, especially when he mentions that in Texas if you kill somebody, they got the right to kill you back. Hilarious.
Thanks to Pres. Bush for signing into law the Adam Walsh Act (July, 2007), perverts who cross state lines after molesting a child can now be legally tracked to their new locale. My youngest child was a victim of a creepy pedophile three years ago. This loser was convicted of raping a kid in Texas 30 years ago. He moved across the street from us 25 years ago and assumed the identity of the “perfect” neighbor. Until July, 2007, convicted child rapists could move wherever they pleased without their criminal records following them, much to our family’s horror. The creep who molested our daughter was not only prosecuted to the fullest extent of the law by yours truly, he was actually DEPORTED three months ago! Praise God from whom all blessings flow and thank you, President Bush!
Pity the poor kids in his new locale. Hope they track and …… this guy.
He should never have been released!
Glad to hear the Good Guy is going to be cleared. What a load of garbage that was.
Navymom, hugs to you and your daughter. Glad the creep is not here in this country anymore.
NavyMom:
I hope the creep who molested your daughter is collecting his just reward.
I hear that in Louisiana, Gov. Bobby Jindal just signed an act where all sex offenders must be registered for life instead of the customary 15 years. His thinking is that they want to make it as tough as possible for these monsters so that they leave the state. Smart man.
Jindal 2012 or 2016!
That’s a negative Ghost Rider, Escalation Of Force is warranted.
What the heck happened to mandantory miniumums? 5 years on each count of sales of a Schedule I drug should have been the sentence.
Served consecutively.
3 strikes??? This women is lucky.
Seventy-one and couldn’t speak English…hmmmmmm…either he was here illegally or a public school graduate.
That wasn’t felony indecent assault. That was a gay marriage proposal.
He fled? Gee what a surprise. Another advantage of being an illegal; you can commit crimes, flee back across the border, and the U.S. has a hell of a time tracking you down to bring you to trial.

WOW! So NOW we know how they are able to undercut their competitors and buy them out! Helloooo, ICE?
There’s hope for our justice system, yet.
Where the charges dropped against the dad because the guy ran?
Or because of the PR from it all..
‘Yes, we lost the accused child molester.. he’s still groping boys’ legs under bathroom stalls who knows where.’
‘But we still have the father who defended his son!! Should we try him still?’
‘No? okay…’
Charges dropped against the father… That is AMAZING… Suspect can not be located, NOW THAT IS REALLY SHOCKING, SHOCKING I SAY!!!!!
