Open-borders lawsuit: English-only rule creates “hostile” school environment

A Catholic school in Kansas with a substantial Hispanic population wants its students to speak English only. The school had to deal with serious discipline problems. Requiring everyone to use the same language helped alleviate disruptions.

Enter the ethnic grievance-mongers and anti-assimilationist mob. They sued the school and were in federal court this week arguing that the English-only rule violated the Hispanic students’ civil rights. Yes, they’ve gone and made a federal case out of it– and they are demanding “court and attorney costs and unspecified damages for discrimination and emotional suffering:”

A lawsuit filed by three Hispanic families against the Catholic Diocese of Wichita challenging a policy that requires students to speak only English while at school goes to trial in federal court today.

“What happened at that school constitutes race discrimination under federal anti-discrimination laws — that is why it is important. That needs to be stopped,” said Christopher McHugh, the attorney representing three 12-year-old students named as plaintiffs in the civil litigation.

The lawsuit seeks an end to the policy and asks for an order barring similar policies at other Catholic schools in the Wichita diocese.

The plaintiffs are claiming the policy violates the Civil Rights Act and another federal statute by intentionally discriminating against the sixth-grade students and causing a hostile educational environment.

The diocese contended in court filings that the English-only rule is not discriminatory and did not cause a hostile environment. It contends the rule was implemented at St. Anne Catholic School as a legitimate response to inappropriate behavior by a few middle school students.

These families need to assimilate. The school does not have to accommodate. Families like these should quit balkanizing the United States in the name of diversity.     I read a statistic the other day, and will need to go back and find it. In a nutshell, 40% of hispanics in the US live in virtual enclaves where everything is conducted in Spanish. To the best of my knowledge, this hadn’t happened before in the US, even during times of mass influx from non-speaking countries (Germany, Italy).

    Either become an American or go home. We’ve become way too permissive.

Problem here for the plaintiff is that it’s a big time stretch to argue that the CRA covers, or creates, a right to speak a foreign language in school. Sounds like a loser to me. Keep in mind though that just because a school is private doesn’t mean that the school can operate in a discriminatory manner. A private school that banned students of a particular race for example would be in violation of federal law.

    Past tense…is the disciplinary problem solved?
    If not, discharge the disciplinary problems…end of problem.

    Sent my daughter to a highly touted private religious school in the 80’s, they didn’t tolerate disciplinary problems. 3 bad marks and the student was gone, didn’t matter who the parents were or what language was spoken at home.

    Amen. Get this: my mother is a legal us resident. She almost couldn’t get us down here when my parents decided to move from Canada, even though she is a US citizen.

    Then the paperwork for her children to be naturalized. I feel for you. Yours had to be 10 times worse.

    I tell her now that she should have just waltzed in with us and avoided saying anything!

    NavyMom, correct me if I’m wrong, but don’t most of them speak spanish already? So this program is to fix it so the 2 or 3% non immigrant Americans can understand the rest of the students?

    I think it’s the same problem as with the (former) mainline Protestant denominations. Some leaders of local churches and/or dioceses are nuts. But these individual goofballs tend to band together to claim a “victim status”.

Many Americans are fuming about this continued pushing by the illegal lobby and push back is coming and it will not be pretty.
