Gloves off: Now, Obama calls for prosecuting GOP donor; Update: AIP responds

I noted this morning that the Obama campaign’s Chicago-style thug effort to shut down the independent ad on Bill Ayers is part of the larger effort to intimidate conservative donors and curtail the free speech of The One’s critics.
It’s getting uglier, people.
Obama’s lawyer has sent a second letter to the Justice Department calling for the head of Dallas billionare Harold Simmons, who funded the Ayers ad that the Obama campaign doesn’t want the public to see.
Feel the chill:
Obama general counsel Bob Bauer today sent a second, sharper letter to the Justice Department, directly attacking the Dallas billionaire funding a harsh attack ad, Harold Simmons.
“We reiterate our request that the Department of Justice fulfill its commitment to take prompt action to investigate and to prosecute the American issues Project, and we further request that the Department of Justice investigate and prosecute Howard (sic) Simmons for a knowing and willful violation of the individual aggregate contribution limits,” he wrote.
He called the group’s activities “patently illegal.”
Bauer made the case that Simmons’ group [is not] fulfilling its [...] nonprofit charter because it hasn’t spent any money on anything other than attacking Obama. Simmons’ spokesman, Christian Pinkston, told me yesterday that plans to, and dismissed the complaints as an effort to lawyer away charges the campaign can’t rebut.
I posted AIP’s rebuttal here yesterday. And as I’ve noted today and will note again: Obama has some nerve whining about campaign finance integrity after getting caught hiding $800,000 in ACORN payments.
What’s going on? Simple: The Left has its George Soros sugar daddy and can’t stand that conservatives have their own committed benefactors. They’ve got a massive non-profit infrastructure funded with taxpayers and operating flagrantly in an illegal, partisan manner (hello, ACORN Watch!). They want the playing field all to themselves. And they are fighting for that turf by any means necessary.
Can they do it?
No, they can’t. Not if you don’t let them.

AIP Responds to Second DOJ Letter from
Obama Campaign Demanding Donor Prosecution
Washington, DC – August 26, 2008 – The Barack Obama campaign has now sent a second letter to the Department of Justice calling for the prosecution of one of American Issues Project’s donors for his role in funding a political advertisement in full compliance with all election laws.
“Having failed in its attempts to get our legal, factual and fully-supported ad off the air, Barack Obama’s campaign now wants to put our donors in prison for exercising their right to free speech,” said Ed Martin, American Issues Project’s president. “These over-the-top bullying tactics are reminiscent of the kind of censorship one would see in a Stalinist dictatorship, with the only difference being that those guys generally had to wait until they were in power to throw people who disagreed with them into jail.”
In addition to two letters sent to the Department of Justice asking the government to investigate American Issues Project, its officers, board of directors, and donors, the Obama campaign has been contacting stations running American Issues Project’s ad in an unsuccessful attempt to compel them to pull the spot. With no success on either front, the campaign has also begun running its own ad in response. Notably, this ad fails to dispute a single fact in the American Issues Project’s initial ad.
American Issues Project is a 501(c)4 organization, similar in structure to NARAL and the League of Conservation Voters, two liberal organizations that have claimed status as “qualified nonprofit corporations” for two decades. In accordance with federal law, American Issues Project only solicits and accepts contributions from individuals and not from any business corporation. The FEC also sets out specific regulations for the activities of a qualified nonprofit corporation, which American Issues Project follows.
The American Issues Project’s ad began airing Thursday, August 21, and will continue through the Democratic Convention. An electronic version of the ad and full documentation of all statements made are available at American Issues Project’s website: www.americanissuesproject.org.

Harold Simmons can subpoena the Obama/ Ayers papers for evidence.
Since the Obama campaign is so high minded, perhaps they would welcome the DOJ to looking into a few other things:
1. Obama’s campaign contributions from foreigners, particularly those received from Gaza;
2. The over the limit contributions received by the Obama campaign from doozens of donors;
3. The activities of Obama’s “bundlers” as to whether these were in fact over the limit contributions disguised as bundling;
4. The relationship between Obama and ARCORN;
5. The activities and tactics of George Soros and MoveOn in this election;
6. An in depth look at Obama’s ties with Rezko and Saddams money men;
7. Obama’s relationship with the Nation of Islam and his employment of its members in his campaign.
Fair is fair.

Isn’t this straight out of the so-called “AccountableAmerica” playbook? Threaten those that donate. You had a separate thread on that. That was a letter to the donor threatening prosecution. I guess this is them starting to follow through on the threat (at least as to this one donor).
Sadly, more of the same. If you can’t beat them with your ideas, threaten and intimidate them. Counter to everything for which the Democrats purport to stand.

This is nuts. The Obama camp is really stepping in it, don’t you think? The more attention they bring to this group, the more airtime that ad, and the Ayers-Obama connection, is going to get.
The bottom line is the ad is right on target and Obama doesn’t like it. The connection with Ayers is just as disturbing as his 20 year relationship with the racist Rev. Wright, and the American people have a right to know about it. I hope this blatant attempt at curtailing free speech is seen for what it is, and I hope it backfires on ‘em big time.

It used to be that misconduct was constrained, if not by any ethical consideration then by a lively concern about avoiding retribution. The long string of blatent violations we have witnessed without a serious response has changed that. The wheels completely fell off after the laughably light sentance handed down to Sandy “Docs in his socks” Berger. The rule now for these people is do more and the greater the violation the more the need to be brazen and pile on.
I believe it is a federal court, probably the DC District Court, as prosecuted by the DOJ.

chapoutier, if the American Issues Project is found guilty of violating campaign laws then I will condemn them. This condemnation will be independent of anything that Soros, etc. is doing. (I might do so prior to, or despite, an actual ruling on a prosecution.)

I do not know the strength of their argument. I admit that the Obama campaign is probably more concerned with seeing the ad off the airwaves than it is with upholding and enforcing campaign finance laws. I also admit that attempting to enforce campaign finance laws is probably its most effective means of achieving this goal. none of this is relevant to whether or not campaign laws are actually being broken.
I doubt they are but i don’t support breaking the law.

What’s “funny” about all of this is that you have a man running for POTUS who counts among his current friends/acquaintances/benefactors unrepentent domestic terrorists who hate this country.

I wouldn’t think Obama would really want to go there…I have read reports that indicate that the sources of many those “small contributions” that Obama’s campaign is always crowing about are somewhat questionable.
It doesn’t make sense, to me at least, that if America’s poor and middle classes are suffering so much monetarily, and economically under the Bush Administration’s policies, that they would have the means and inclination to contribute money to the Obama campaign, rather than buy food, pay bills, including those “poor souls” whose mortgages are in foreclosure.
I’d like to see an investigation into the true sources of those contributions.

I’ve been watching Fox News reports about the shenanigans going on behind the scenes at the DemCon, and it just occurred to me that we may be seeing the evolution of Obama’s new Democratic Socialist Party…delegates being told they cannot now cast votes on the floor…speakers being scripted on what they may or may not say…limitations on free speech…
This is very troubling…for the libs.
This is an example of The Obamessiah’s domestic policy on dealing with dissenters and critics, with whom he will deal with an iron fist. Well actually, his disciples. He personally won’t soil his hands and will keep a careful distance in such matters.
The Obamessiah will be far more cordial in his foreign policy. He will send off “pleasant” notes in the tone of Mr. Rogers – “Won’t you be my friend?” : )to nations hostile to us.

What I think is being missed here is that for Obama to make a huge fuss about this ad is strategically unsound. First, it can’t work. The genie is out. The ad is already viral. Meanwhile, his caterwauling and calling in the DOJ adds fuel to the fire. Soon, with so much smoke, the MSM will not be able to ignore the story. The smart play is for him to say “Yes. Yes. The conservatives say I love terrorists. What’s new?” Strategically, Mayor Daly has the right response. “So what? That was 30 years ago.”
The conservatives should be saying “Just think folks, when he’s president, he won’t be making a request that the DOJ investigate his critics. He’ll order them to. Make your last vote count! Vote Obama.”

This is great. The Republicans do not have to gear up their “attack machine”, they can just replay clips of Biden, Clinton, and other democrats commenting on Obama’s lack of accomplishment.
It can be factual and accurate and still in violation of federal election laws if it is determined that the ads represent a contribution to the campaign over the allowable limit.

1) this isn’t a serious attempt to stop a wrong, or to seek redress of having been wronged. This is a fishing expedition to sic the Justice Department – with unlimited funds – on a group that should be protected under the 1st Amendment of the US Constitution.
2) Can I start suing you chapoutier? No real reason, I just want to start filing lawsuits against you until I drive you broke and silence your internet presence because you can’t afford to get online anymore.
Plus, if I can find a friendly judge, I can get your house (do you have a house?), your car (do you have a car?)), and force you into bankruptcy.
with regards to your red herring about comparing it to the perfectly legal foreign enemy intelligence intercepts – I’m glad you show such support for terrorists. We can send that to the DoJ too, and have them do an investigation. There’s actually more to back up that investigation than there is the one that The One is trying to foist off as legitimate.
I think a citizen has the right to air anything they feel like funding. One can well imagine Obama sending DOJ after everyone who disagrees with him. It could be a very long dark winter…

I don’t think Obama “knows what he’s dealing with.” There are huge numbers of dems that may agree with some of his agenda, but are not Marxists. Mr. Obama may have done more harm to their party than they realize. Even the communist Robert Redford admitted that if Obama loses, it will be the end of the Democrat party. Most on the left don’t advocate Marxism, although the messiah and his minions are too stupid too realize that fact. Or worse, they think their voters are too stupid to know what he is advocating.
The legal complaints surrounding this ad are masking the basic point. Obama associates and consults with self-admitted radical extremists that proudly state their hate for America. That fact must be understood and perpetuated. There is no excuse. “You are who you hang out with,” as the saying goes.

Rush Limbaugh featured this issue on his 8/26 show. The Obamination might learn not to pick on a big guy that knows what a lawyer can do and especially not to pick on a rich big guy. The Obamination needs the ACLU help here, DNA experts, and once again shows what a fool he is. But back to Rush, regional coverage is now national and no amount of hope can save his a$$ on this one.

I guess in fairness to Mr. Redford, I should correct that flame to read, typical communist-leaning actor, in my opinion. He has been known to support a Republican (probably RINO’s) in his past.

I seem to remember when Clinton was running for his first term and he and the ‘lil misses were having an interview on 60 Minutes. The Clinton’s were plagued by questions regarding his infidelity at that time. Finally Hillary said ‘look, if you don’t trust him, don’t vote for him.’ Or something to that effect. Of course, in hind sight – we now know those inuendos proved true.
Now we have good ‘ol Barack and the inferrences of his relationships. Not extramarital in nature, but with terrorists. I suspect where there is smoke there is fire..like with Clinton.

A much preferable result would be for this to be pursued to the Supreme Court, and have the entire McCain-Feingold mess thrown out.
OTOH, for those who are trying to benefit the McCain campaign with this kind of advertising, they won’t get any thanks from McCain. He’s already made it clear that he doesn’t appreciate outside interference in his campaign.
