Part of the job of those confirming/not confirming these judges is evaluating the prospective nominee’s philosophy of judicial review in light of the Constitution. Does the nominee feel the Constitution is a “living, breathing document” because the judge says so or because the Congress can amend said Constitution? Is the Constitution set in stone up until the the judge says it’s not or until the Congress says it’s not? Ginsburg was the former political director of the ACLU. Her credentials speak for themselves. So does her philosophy as well.
