It’s a page long, but the footnote is the important part. Judging from a quick skim of the syllabus in this case from 2002, which the Court cites as precedent, it boils down to the fact that the voting statute confers exclusive power upon Brunner and the head of the DMV to deal with mismatched forms, which means the Ohio GOP can’t force them to do anything by suing.

If I get this straight, they said that the law is only enforceable by Brunner, the Ohio legislature or the Governor. So essentially, if you are all on the same team, there are no checks and balances. This is what Washington will be, one party system, no checks or balances. I did not used to pray much, I am going to start now, alot.
The GOP screwed up this election cycle betting on taking this stuff to the courts.
We would have been better served to build the party up than waste time on lawsuits and ineffective campaign tactics.

McCain has always been VERY popular in the hispanic community for numerous reasons. With all of that going against Obama, he’s still dominating the hispanic support in the polls. So yes the domination is a surprise. If you disagree, fine enough.

The GOP can still challenge ballots. This rulling simply states that it cant force the Ohio Secretary cant be foreced to do her job.
The bottom line is the GOP has to pay for people to go over every ballot in this state. The Ohio secretary of states office wont do this.
So GOP the ball is in your court. If you want to protect this election here in Ohio you have to do the job that Brunner wont do.

You are most certainly splitting hairs here. Is that an insult too, seriously? “Activist” judges believe that a statute/amendment/law is living, breathing and open for intepretation. Strict constructionists believe that you should follow the rule of law as created by the legislature. It’s up to the legislature, or the people to change the law. I learned this stuff from your side. Now, in this per curiam opinion, the judges decided to follow the law. I most certainly believe that it’s intellectually dishonest for any strict constructionist conservatives to complain, or whine about this decision.

I watched a PBS special last week, young Latino man, very on fire for Obama. He was really inspiring, good head on his shoulders, good ability to explain his support for BHO. I respected him in spite of our disagreement about his candidate.
He was going door-to-door in a southern New Mexico town. Lotta support for McCain. A whole lotta support for McCain in that town. Gotta say…it was refreshing.
Here is what the GOP need to do.
Set aside about $20 million dollars. Send out invited to hire people to go over the ohio ballots. PAY these people for doing the parties work and train them.
GO OVER EVERY BALLOT CAST. If Pakestra.net can catch phoney ballots then the GOP can train people to do the same.
After the election is over have this army of trained ballot watchers go into action. Contest every phoney ballot they find. If the dems in ohio government complain take it to the press or get the message out.
Id be willing to join such an effort but it would take months to do and I cant sit around without pay for that long doing this. I have no problem fighting for the GOP I cant afford to go broke doing this.
Its a simple request GOP put the money into this effort and you can still win.
The Ohio GOP needs to be on those registrations now.

I’m having a hard time with this one. It seems to me SCOTUS had no CHOICE but to rule for Brunner. The Ohio statute is very clear. Bad statute? You bet. But it is still the law. These are the kind of things that slip under the radar. Nobody pays attention until it comes into play. Be very careful what you vote for or support. It can come back and bite. This time it has.

SCOTUS did NOT rule on voter fraud, it ruled on an OHIO statute that forbids private entities from suing the state. Voter fraud had nothing to do with this. Read the ruling. The court said it had NO opinion on the merits of the case. It only ruled on what Brunner asked for. Yes, hanky-panky is alive and well in Ohio and other states, but give the court a break. This time it ruled on the law, not emotion. I too believe Obama will be very BAD for this country, but we can’t subvert the LAW just to suit ourselves , can we?

A lawyer knows, or should know, that no matter what law a legislature may pass, it is worth absolutley nothing if a court finds it unconstitutional.
The only law that is not unconstitutional is the Constitution.
Therefore, unless Constitutional amendments are passed, the people and the legislatures are at the mercy of the courts.
And that is exactly the problem that exsists, and has existed for decades, since courts (judges) became activist; and have applied off-the-wall (penumbras? emanations? “interpretations” of the Constitution or other laws when it suits them; and have spectacularly not applied judgment when it suits them (”fruit of the poisoned tree”, or whatever).
The “video game rules” metaphor stays.
And, unfortunately, only judges and the courts get to say what the rules are…what they “mean”.
So, if pointing out facts deserves insults, I accept them proudly.
The courts have been controlled by activist judges for forty years. There is a good chance McCain will appoint constructionist judges.

I believe Brunner hatched some scheme to keep Republican observers away from the polls as well. It was mentioned in early reports, anyway.
Perhaps the suit should be amended with new plaintiffs and refiled immediately.
Is Brunner an elected or appointed official? If appointed, the governor has the best shot at shutting her down, and had better take it now.

If we’re going to be upset at anyone over this particular judicial dead-end, my first nominations would be the attorneys for the Ohio GOP. “Standing” is not some little-known, arcane bit of legal trivia when it comes to filing lawsuits in Federal courts. The lawyers should’ve been prepared for this outcome.
If I were the Ohio GOP lawyer, and I couldn’t tell for sure if the law in question allowed for a private cause of action for enforcement, my first piece of advice would’ve been, “We can give it a try, but we need to be thinking concurrently about a ‘Plan B’ in case the court doesn’t go for it.”
“Plan B” in this case needs to be pressure on the US Attorney General to initiate action based on Federal law. But then, given the “turn-the-other-cheek” philosophy of the Bush Administration, that’s probably a non-starter, too.
So, now you’re down to “Plan C.” Which will probably involve gathering the resources necessary to demonstrate vote (as opposed to registration) fraud as the foundation for legal challenges.
In other words, if it’s a close election nationally then Ohio is well-positioned to be the next “Florida 2000.”

It is quite obvious that the Supreme Court has been blinded by The One’s Light. I however, am still votin for McCain and Palin….YOU BETCHA!
The Help America Vote Act of 2002 requires that states compare information contained on voter registration apps to information in the states motor vehicles databases and the Social Security database in order to confirm that it is an accurate and valid registration (Sec. 241(b)3) - clearly states requirements for making information available to polling sites. The Ohio Sec. of State has been “performing” these confirmations (she claims) but in secret, and will not share the information with election boards locally or the public (Sec. 206). This is a clear attempt to withhold information, which would probably prove ACORN as a fraudulent organization and cut their funding + include some jail time. In court, withholding information is considered criminal.
This is not some new law (since she claims that she didn’t have time to prepare to validate these registrations), she had plenty of time to comply with the law - but she thinks that she is above the law and wants to protect her party and friends.
You know (on a personal note), I have to now question who does she owe the favor to that she needs to be protecting possible criminal actions? Is it the Democrat Party, Obama or Satan himself?

I can’t wait till the rich libs are faced with higher taxes and they will say “this is not the change we were looking for” or when their favorite website is shut down because of some fairness doctrine, or certain media outlets are shut down again because of the fairness doctrine, they will be screaming. The conservatives won’t be shocked because we will be already expecting it.
Bush’s Attorney General can take on Brunner any time he chooses. Numerous congresspeople asked AG Mukasey to investigate ACORN in a letter sent weeks ago…no response!
