eHarmony forced to offer same-sex dating services; Update: And now, a class-action lawsuit

So, this is “progress?” eHarmony, a Christian-targeted dating website, gets sued by a gay man demanding that the business match him up with a same-sex partner. The New Jersey Attorney General intervenes on behalf of the gay plaintiff and forces eHarmony to change its entire business model. To be clear: The company never refused to do business with anyone. Their great “sin” was not providing a specialized service that litigious gay people demanded they provide. This case is akin to a meat-eater suing a vegetarian restaurant for not offering him a ribeye or a female patient suing a vasectomy doctor for not providing her hysterectomy services. Sadly, eHarmony has settled . I wish they hadn’t, but I understand the decision given the chilling antics of the anti-Prop. 8 mob. The company agreed not only to offer same-sex dating services on a new site, but also to offer six-month subscriptions for free to 10,000 gay users. Behold the submission:

The Pasadena-based dating website, heavily promoted by Christian evangelical leaders when it was founded, has agreed in a civil rights settlement to give up its heterosexuals-only policy and offer same-sex matches.
EHarmony was started by psychologist Neil Clark Warren, who is known for his mild-mannered television and radio advertisements. It must not only implement the new policy by March 31 but also give the first 10,000 same-sex registrants a free six-month subscription.
“That was one of the things I asked for,” said Eric McKinley, 46, who complained to New Jersey’s Division on Civil Rights after being turned down for a subscription in 2005.
The company said that Warren was not giving interviews on the settlement. But attorney Theodore Olson, who issued a statement on the company’s behalf, made clear that it did not agree to offer gay matches willingly. “Even though we believed that the complaint resulted from an unfair characterization of our business,” Olson said, “we ultimately decided it was best to settle this case with the attorney general since litigation outcomes can be unpredictable.”
The settlement, which did not find that EHarmony broke any laws, calls for the company to either offer the gay matches on its current venue or create a new site for them. EHarmony has opted to create a site called Compatiblepartners.net.
Warren had said in past interviews that he didn’t want to feature same-sex services on EHarmony — which matches people based on long questionnaires concerning personality traits, relationship history and interests — because he felt he didn’t know enough about gay relationships.
eHarmony had been previously sued by a lesbian looking to force the company to match her up with another woman and by a married man who sought to force the company to hook him up in an adulterous relationship.
Perhaps heterosexual men and women should start filing lawsuits against gay dating websites and undermine their business. Coerced tolerance and diversity-by-fiat cut both ways.

Update 4pm Eastern 11/20. Geez. Now, a California judge has approved a class-action lawsuit by gays against eHarmony. When it rains, it pours:
(onlinedatingmagazine.com – November 20, 2008) A California Superior Court judge has certified a class action lawsuit against eHarmony.com for discrimination against gays and lesbians in California. The news comes one day after eHarmony settled a case in the State of New Jersey where a gay man accused the company of discrimination. In that settlement, eHarmony agreed to open up a service that matches gays and lesbians.
That announcement had no affect in the California case, which is moving forward.

For all out there wondering why the LDS (Mormon)Church and other churches asked their members to support Prop. 8 and take a stand to define “Marriage”, this lawsuit is an example of what is coming. There is a active frontal assault on the family unit and the principles that go with it. The LDS Church rarely approaches it’s members to support a cause such as Prop. 8. Having said that I will say the LDS Church does encourage members to be involved politically choosing for themselves ideas they want to support.
California’s Prop. 8 is not the only battleground. The war is all around us for the hearts and souls of men.
It’s long overdue that individuals speak up.

I wish eHarmony wouldn’t have settled, because I would be interested to see how the case would turn out. Does the internet qualify as “public accommodations”? Is it a “place” under the meaning of the statute? (By the way, federal law does not prohibit discrimination based on sexual orientation.)

You’re missing the point. eHarmony is a dating site. That is a single service. They are not offering it to some people based on sexual preference. That is discriminatory. There’s no difference between a man looking for a woman on the site and a man looking for a man. The service offered is the same – dating. Men date women, men date men, and women date women. All the same. All equal.
And yes, the courts can tell you how to run your business because your business is part of a society that LETS you run that business and has rules that you have to follow to be ALLOWED to operate. Safety rules, licensing rules, tax rules, and rules against discrimination.
eHarmony folded because they knew that they would lose. Because they knew that they were wrong.
Again, this is a civil rights issue. Go back and look at some of the things segregationists said in the 1950s and look at what you’re saying. Sounds familiar? These people are as equal as you and me and are entitled to all the same things you and I have, including that you have to serve them if you operate a business.

Not really. Civil Rights laws have not swung back on race discrimination, sex discrimination, suffrage, accommodations for the disabled, or anything else. Once a minority group gets rights, the majority comes around pretty quickly to see that the world is a better place for it. For instance, I don’t hear nearly as many conservatives since Lawrence v. Texas who say homosexuals should not have the right to do what they want behind closed doors, whereas at the time of the decision all I heard was how sodomy was the end of civilization as we knew it.
It happens that young voters — who know many more open homosexuals than their parents did — are moving overwhelmingly in support of gay rights. It is only a matter of time before gays everywhere are protected by discrimination laws, and marriage bans are lifted. I’m not trying to say what should happen, but that’s my opinion of the irreversible tide of minority protection.

Civil rights of same-sex couples have not been threatened because there never has been a civil rights for people of the same gender to be able to marry one another.
On the other hand, my civil rights have already been threatened. In practicing my rights of freedom of religion and freedom of speech, there has been much persecution by the No on Proposition 8 group. Preachers and religious people are being threatened and sued just for their beliefs.
It’s not and never has been a civil right for people of the same sex to be married, but freedom of religion is a civil right. My preacher should be able speak against the idea of homosexuality without the fear of being sued for hate speech.
This is just the tip of the iceberg of what is already happening in California and other states and what will continue to happen if marriage is not protected. Likewise, freedom of speech is in the Constitution as right.
The people of the state have spoken to uphold marriage between a man and a woman because, among other things, they recognize that if Proposition 8 had failed, many more of our true civil rights would be taken away or jeopardized. Those who are protesting need to recognize and respect the will of the people who made the right decision to protect our freedoms.
The scariest thing in America is the ignorance of the American populace. If we don’t know what our own freedoms consist of, then they will be taken away.

This is not a civil rights issue nor Equal Protection Clause under the 14th amendment because gender isn’t covered.
I see what you’re saying, but I think this is like a bar trying to get around sex discrimination laws by having urinal-only bathrooms. They can just as easily provide the same service to homosexuals, but because they choose to discriminate (which they openly admitted to for years), they shut out gays.
I’m personally reluctant to tell any private organization what they can and can’t do for religious reasons, but then again the Mormon church was officially racist until the 70s, barring blacks from becoming bishops, and I wouldn’t let them off the hook.

I was parodying the eHarmony commercial, with several glowing wives saying in succession, “I met MY husband at eHarmony dot com”. Replace those images with glowing gay guys saying they got THEIR AIDS at eHarmony dot com. There’s some humor there.
Considering stats saying the average lifetime number of different partners of a gay male is around 300, and given that gay sex often involves an abnormal, unnatural, extremely unhealthy act which tends to spread disease, AIDS is certainly a possibility. If you cast a wide net, you’re gonna catch some weird stuff. Just sayin’.

Civil Rights has been one of the most destructive bills ever passed.
It has created the PC problem we have which is slowly killing freedom of speech in this country.
It forced people to be tolerant of something they should not have been forced to do which by the way when you force people against their will they become angry!

Just to reiterate, eHarmony CHOSE to settle this suit and CHOSE to offer same-sex services. As an earlier poster noted, they probably would have won at trial but CHOSE not to risk it.
This is a pretty good example of a private organization exercising THEIR RIGHT to run their business they way they want. You simply disagree with the manner in which they exercised that right.
