The rules can be circumvented or complied with depending on your perspective quite readily.

The purpose of TARP was to get financial institutions lending again. And not just to each other.

The $15 billion of TARP money can go to an agreeable bank who will lend the Big 3 $14.5 billion and pocket $500 million for themselves for a quick day’s work. Seems compliant with the rules to me.

That is actually what TARP was meant to do. It wasn’t meant to for financial institutions to sit on or invest for their internal benefit.

Since the executive and legislative branches have already acted unconstitutionally, why should breaking a law mean anything to them?

This is what lawyers refer to as “precedent”, and is used as cover for any similar behavior which happens hence.
