Ohio snooper who targeted Joe the Plumber resigns

Finally, something more than a slap on the wrist. Lead Ohio government snooper Helen Jones-Kelley resigned from her job and two of her cohorts were canned as a result of their plundering through Joe the Plumber’s records.

Good.

Glad to see some heads roll.

Before the news came down, Glenn Reynolds and I had a chance to chat with Joe Wurzelbacher for Pajamas TV. We talked about his book, JTPDS in the media, and the disgusting spectacle of pro-bailout Republicans like John McCain and George “Destroyed the market to save it” Bush. Watch here (free!).

    The truth is that the Hawaiian officials have NEVER claimed that Obama’s CertificatION of Live Birth is authentic.

    The only thing that these two officials “verified” is that they had seen Obama’s original birth certificate and “verified” that it is “on record in accordance with state policies and procedures”. That’s it. Nothing more.

    The original birth certificate (OBC) and the forged CertificatION of Live Birth (forged COLB) are two different documents.

    The OBC and forged COLB aren’t even central to the Natural Born Citizen issue, because Obama is already disqualified by the admitted fact that he was born a British subject. But the forged COLB is very relevant to judging Obama’s content of character (or the lack thereof).

    Congress must certify the vote first.

    And since:

    1) Every member of congress has sworn an oath to support and defend the Constitution of the United States,

    2) The Constitution not only requires a President-Elect to be a Natural Born Citizen but also specifies what is to happen “if the President elect shall have failed to qualify“,

    3) The only document Obama has produced in regards to his Birth is a clear forgery which has NOT been authenticated, and

    4) Even if Obama produced an authentic, original vault Birth Certificate, he has acknowledged that he was a British subject at birth, and therefore was at best a dual citizen and therefore not a natural born citizen of the U.S. (born on U.S. soil to two U.S. parents)

    I expect the Legislative branch to do its Constitutional duty and enforce the Constitutional requirements of the office of President of the United States.

    I believe that if the Legislative branch fails to do so, then the Judicial branch will have to do so. The Supreme Court has denied applications to stay in three different cases, but they have not denied certiorari in any of the three. Two have already been distributed for conference (Donofrio on Dec. 5, Wrotnowski on Dec. 12) and the third (Berg) was just distributed for conference on January 9th. So if Congress certifies the Electoral College vote for Obama on January 8th, expect the court to act.

    And each and every member of Congress who failed to uphold their oath should be impeached.

    The Supreme Court has, by their denial of the stay applications, made it clear that they are not going to intervene in the Presidential Election process at THIS POINT, but they have also made it clear (by discussing multiple cases in conference and NOT denying Certiorari in any of them) that they are leaving options open to act if the Congress fails to uphold their oath to support and defend the Constitution.

    I guess the appropriate title for Obama now is:

    President elect who has failed to qualify

    20th Amendment, Section 3

    … if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified…

    This is not a case of “guilty until proven innocent”. It is a case of “unqualified until proven qualified”.

    The 12th amendment makes it clear that both the the Vice-President must qualify, as well:

    But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.

    Unfortunately for Obama, he has already proven that he is UNqualified because he openly admits that both his father and he were British subjects at the time of his birth.

    Since the Congress has already made it clear that they believe John McCain is a natural born citizen, the correct thing for them to do is to certify John McCain for President and Joe Biden for Vice-President (assuming that Biden can prove that he qualifies as a natural born citizen).

    The Supreme Court could still rule that McCain does not qualify as a natural born citizen. If that happens, we would have the first time in our nation’s history when all of the candidates for President who received Electoral College votes are constitutionally ineligible to hold the office. There would be no eligible Presidential candidates on the “list of those voted for as President”, so it would be impossible for “the House of Representatives shall choose immediately, by ballot, the President” from this list.

    The 20th Amendment gives Congress the freedom to

    by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.

    But the 20th amendment does not make it clear how to get a qualified President when the list is empty.

    Perhaps the states would be told to recall their Electors and vote again for President, this time only voting for qualified candidates.

    By the way, most people think there are only three qualifications for President:
    1) natural born citizen
    2) 35 years old or older
    3) minimum 14 years residence in USA.

    There is something else that can disqualify a candidate…

    Violation of Section 3 of the 14th amendment.
