“Amendment IX

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.”

As I read it, the rights are retained by the people. (People have rights, the federal government has enumerated powers.) Further, by the tenth amendment: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

So, in context of the original question by chapoutier asking if education were a right, it could be at the state level. It is not, nor is universal health care, at the federal level.
