They’re free, but it’s still a travesty. Anyone that decides to apply for the Border Patrol or ICE is a prime target for any misstep or trumped charge. Believe one of these families has lost their home. Bet no one offered them free rent.
God bless their wives who remained strong and loyal in the face of a terrible injustice.
Now they need to get their names cleared by getting their case before the US Supreme Court and having the convictions overturned.

Until you’ve been in a situation like Ramos and Compean were, you can’t comment on what they did or didn’t do wrong. Things happen fast when you’re under fire and people don’t always make the best decisions. Given that they were in a life or death situation with someone who would have no moral qualms about killing them, I think they did the best they could.
You don’t wonder at all about the motives of a prosecutor that offers a cross the border free card to a known drug runner in exchange for testimony against those who are here to protect us?
…in the mean time, the illegal drug runner was given immunity for his testimony. I think that is the part “WE” have a problem with.

I thought law enforcement was trained in how to react when things happen fast. And they were not “under fire” as the suspect was not armed.
And “fast” cannot excuse picking up their casings (wasn’t it 18 shots fired?)and not reporting the incident. It’s the cover up that gets you.

Letting border patrol agents know that they were targets was Johnny Sutton’s goal all along when he decided to go after these excessive sentences.

Prosecutors make these types of deals every day. These were corrupt agents, and it’s best to secure a conviction to get them off the force, and make an example of them. I don’t think this drug runner has been offered citizenship status and a job at the local Walmart. His testimony was needed to bring the corruption to light.
If you want to take the tools of immunity away from proscutors, you’ll be living in a much, much more dangerous and corrupt nation.
Now, how long before you folks start bashing the jury for weighing the evidence and following the law.
George W. Bush’s political epitaph shouldn’t just include the fact that he turned his back on free market principles. It should also include the fact that he failed these two men when he didn’t pardon them two years ago.

I know Compean and Ramos were convicted but I am not convinced they actually committed a crime.
And certainly, if they committed a crime, they can’t be more guilty than Bill Ayers who did commit a crime and yet got away with it and without a day in jail.
Scooter Libby was convicted because his memory differed from the memory of the now deceased Tim Russert. I didn’t realize that was a crime but somebody does.
No, I am glad Ramos and Compean are free. I am sad they didn’t get a full pardon. I am outraged they were ever prosecuted to begin with.

Having been a security officer in the Air Force, I can say, it’s impossible to say how you would act in the same situation unless you are there. Darkness, fear, adrenalin, knowledge of the enemy. . . all factors that make you want to shoot first, ask questions after.
As someone else noted above, if the government would just secure the border, these guys wouldn’t have been in that position in the first place.
I am a conservative but these guys were bad actors who deserved what they got. No tears for them from me.

Committing a crime should not be excused by hassles of doing the paperwork. Law enforcement officers should not shoot unarmed, non threatening suspects in the back, and when they do I hope they are prosecuted and if found guilty, sentenced, and serve their time. I expect better from them.

The problem for the Agents was complicated by not being members of the BP union. I’m not a fan of Unions, for sure, but the Agents would have been afforded very comprehensive and able council if they had belonged.
After the incident with the Agents, nearly all Border patrol Agents not previously members of the Union joined, and they did so for self-protection.
Why be unarmed in a case where the prosecution will take the word of a drug smuggler over yours? Better arm yourself with the Union.
My son is a Border Patrol Agent along the southwest border and while the Agents understood the two Agents should receive some sort of sanctions, they were almost in revolt over the unfair prosecution and the zeal Sutton went after one of their own.

What’s even more galling is that the drug smuggler filed a $5 million lawsuit against the federal government because his “rights” were violated.

If those who are bad-rapping Ramos and Compean knew what they were talking about (and had actually followed the case) they would know the “crime” was committed at the orders of their superior, who told them what to do after the shooting.
Jorge Boosh should never have had to pardon these men, but he did because his pit bull, Johnny Sutton, was following Boosh’s orders to rack them up in the first place. And crimes were committed in doing so. Boosh, in turn, was doing what his amigos in Mexico City told him to do.
Dubya’s legacy will always be stained by this travesty of justice. For the good he did, he also proved himself to be a weak tool of his buddies from outside our borders.

Some questions about the case:
Some commenters here have opined that Ramos and Compean deliberately covered this up, but I personally wonder about this section of the BPA handbook. If Ramos and Compean did, in fact, report the shooting to their supervisor and this is the rule (I’m still searching on this)… it does seem to be a bureaucratic issue and not a cover-up.
Also, the prosecution’s witness surgeon (who removed the bullet) testified that Aldrete-Davila was in the bladed position, didn’t he? That seems inconsistent with the “shot in back” argument.
Lastly, why did Mr. Sutton present Adelete as a one-time criminal?
While it seems as though Ramos and Compean could certainly have done a much better job of reporting the incident, it does seem as though they became a scapegoat for the debate over border security.
Should law enforcement be exempt from the law? Certainly not.
However, even the prosecutor has made a statement showing his “highest respect” for the decision to commute their sentence.
Good news in dark times. Let’s hope someday post-Obamessiah they’ll get full pardons.
The only thing those two could have done better was to better place their shots. Some people just need killin’ and that would apply to the illegal drug runner. He is a pox on society.
Well, this should continue to play out. If there is anything that I can’t stand it is the pure arrogance of Johnny Sutton. He has an attitude that he couldn’t possibly be wrong about anything. I’m just glad that these two agents are back with their families.

There is something about his manner that reminds me of Mike Nifong of Duke Lacrosse infamy.
Sutton (Bush’s tight buddyroo, let us not forget) convinced the judge to allow his to withhold evidence of Aldrete Davila’s previous (and subsequent) criminal activity from the jury.
Aldrete Davila was the only witness who testified that he was unarmed when the agents claimed he had a gun.
Sutton lied like Osama Obama and yet the appeals up to now have been turned down.
This kind of smarmy behavior is above Sutton’s pay grade. He needed help from above.
Southcoast, I was wondering if the guys had been trained to be out gunned and out numbered? I doubt that was the situation. Their training probably included on what to do on a normal border that is not facing an invasion of drug dealers and illegals everyday. I can’t think of a single nation in the world that lets its border go to crap like this southern one here. I am willing to bet that their training wasn’t enough and they have to put up with all this extra stress and I am speaking from the comfort of my own home and its hard for me to imagine what I would have done. People here are tired of these open border folks who live in gated communities and then have the gall to tell us not to mind how our neighborhoods have been run down, littered and tagged to death. I bet Nancy P., Harry R. and other advocates would change their tune if their backyard garage was tagged every other day.
Your lack of common sense and decency toward your fellow citizenry amazes me. You cannot see the difference between 2 sworn law officers (sworn to uphold and protect the constitution and our laws against the lawless) and a scumbag drug-dealer (who had illegally trespassed into a sovereign nation to commit his felonies by the way). Only after realizing that there may have been some procedural foul-ups, did they make what could be seen as potentially career ending mistakes in not properly documenting their actions. But, convicted felons? On the ‘sworn’ testimony of a piece of $hit drug-dealer who was given immunity! You were not there when the events transpired, nor was the judge or the prosecutor, so no one will ever really know. They should have at the worst had hearings and possibly suspensions or termination, if warranted by departmental rules but not felony convictions.
Personally, I could care less if they had blown his brains out and played slip ‘n’ slide in them. In fact that should be procedure for dealing with any scum-bag caught trying to bring drugs into our country.
According to trial testimony, the suspect was unarmed. At the scene after the shooting the defendants made no mention of the shooting or the suspect being armed to the seven other officers responding. Ramos was a trained member of the Sector Evidence Team and a firearms instructor Defendant Ramos was trained member of the Sector Evidence Team and a firearms instructor who teaches the discharge policy.(Which may explain why Ramos hit him with one shot, why Compeon missed with the first 15 who knows). After the stop all the agents new is that the suspect evaded their attempt to stop him, the drugs were found after the shooting. No other weapon was found.
At the time of Ramos shot he clearly new the suspect was not a threat and shot him from the rear, which is a violation of BP policy and federal law.
Both had been requalified in firearms and shooting policy on 02/16/2005, the day before the shooting.
I had not read the testimony and I believe people are upset with this situation is because illegals are coming over and littering and nothing is being done. The elites don’t care what happens because they are too far removed in their guilded homes and gated communities. People are just tired of the drug mess and the ever tiring tagging on every house and garage in their neighborhoods. Some places in Los Angeles the police won’t even go into and people fear the violence will expode on this side of the border soon.
To all the righteous liberals and your comments you are totally missing the point to this case:
Besides the obvious lawyer plays of getting evidence withheld due to it being prejudicial against the drug dealer; his former dealings including the ONE just before the trial, which happens all the time,the reason the judge was REQUIRED BY LAW to sentence them to more than 10 years for what should have been nothing more than administrative leave, was because SUTTON charged them with “using a firearm in the commission of a crime”.
Let me repeat that: Using a firearm in the commission of a crime. DO YOU NOT UNDERSTAND THE IMPLICATIONS OF THIS CASE TO EACH, EVERY, AND ALL LEO’S??? THEY were NOT committing the crime–Aldrete was committing the crime and Ramos and Compean used their firearms.
The law was written to force judges to sentence criminals to a minimum of ten years when a gun was used IN COMMITTING THE CRIME. It was NOT intended to include the responding LEO. Now do you understand why this situation has totally convoluted this particular law and the future implecations???
Slightly OT: The only person who said Aldrete didn’t have a gun was Aldrete. In an interview with Aldrete-Davila’s mother SHE stated she knew her son was a drug runner and that he ALWAYS carried a small gun with him when he was running drugs.
The doctor that removed the bullet said the trajectory of the bullet indicated that Aldrete was turned to the side when he was shot–why would he do that–because his arm was raised and he had his arm up pointing backwards–gee, do you think that was because he had a gun and was shooting back towards the agents?? nahhhhhh!!! Even looking backwords would NOT have allowed the bullet to enter in the way it did.
By the judge, first, allowing Sutton to charge Ramos and Compean with that law it also opens the door to every other police officer that pulls a gun to protect themselves against criminials. THEN, by sentencing them UNDER that law it further enforces the insane notion that any LEO could be charged with the same “crime”.
God forbid that any BP agent thinks twice about using their weapons, paltry as they are compared to the zetas, because of what happened to Ramos and Compean, because the slightest hesitation will cause somebody’s death!
These men should have never spent one minute in jail let alone in a court room and I hope to God that they will be totally vindicated and their rights restored immediately!!!! Iam so glad they are back with their families again.
