Putting on a great show: Kabuki in the House; Update: 328-93, 90 percent bonus tax passes

By Michelle Malkin  •  March 19, 2009 01:56 PM

Scroll for updates…

If you haven’t been watching the AIG bonus debate in the House, you really should tune in.

Barney Frank is shrieking. Jumping up and down over parliamentary procedure. Blaming Bush, Bush, Bush, and then attacking GOP for “partisan attacks.”

John Boehner just finished statement: “Are you kidding me? This is joke. Vote no.”

Very effective: Almost all House GOP members have text of Dodd/Treasury/Obama AIG bonus protection clause on paper or in poster board home.

Frank has no response but to blubber.

Hensarling: “What we have here is a legislative cover-up. The Democrats could have prevented this. All of sudden, the [bonus protection] appeared and it has no parents…Here’s a newsflash: No more federal money, AIG, until bonsues are repaid. What happened to the most open, honest Congress in the history of America?”

1:59pm Eastern. Nancy Pelosi praises Democrat leadership for “protecting the national interest.”

KABUKI!

***

GOP Reps. LaTourette and Bachus press Frank on what he knew about Dodd provision insertion in conference committee. After blustering, Frank confesses he didn’t know what was going on — and then goes back to huffing about Bush, Bush, Bush!

Just fyi: Here’s the Fishwrap of Record’s coverage for compare/contrast.

***

Update 2:45pm Eastern. The 90 percent bonus tax passed 328-93.

With a few minutes left, some Republicans are changing their votes on a separate sense of congress resolution regarding the bonuses.

John Hinderaker at PowerlineBlog has an interesting (and pro-bonus) take on this whole thing:
    http://www.powerlineblog.com/archives/2009/03/023114.php

    * All of these payments, as to AIG’s troubled financial products division, are retention bonuses, not performance bonuses.
    * The money is not going to anyone responsible for the implosion of AIG–those people, who were in the credit default swap area, are gone.
    * These retention bonuses were promised to AIG employees who are responsible for winding down the company’s financial products division. At the beginning, this division had a potential exposure of $2.7 trillion. Winding down AIG’s book of business in this area was a dead-end job, and there was a great likelihood that the people responsible for the work, who knew the most about the products involved, would take jobs elsewhere.
    * In late 2007 or early 2008, AIG made a deal with these employees: if they would stay at AIG until specified conditions were met, i.e., either certain business was wound down or a given period of time had elapsed, they would receive a specified retention bonus.
    * As to all of the employees involved, they satisfied the terms of the bonus by wrapping up a portfolio for which they were responsible and/or staying on the job until now. As a result of the efforts of this group, AIG’s financial products exposure is down from $2.7 trillion to $1.6 trillion.

In fact, this entire exercise was just a distraction to fool people into thinking the Obama administration and congressional Democrats are angry that tax money went to fund bonuses when, truth be told, they knew it would all along but are now too afraid to accept responsibility for their crafting the legislation that allows it to happen.

Welcome to “The Living, Breathing Constitution”(TM).

When the Japanese invaded the Philippines, and all we still held by April of 1942 was Corregidor Island, Douglas MacArthur tried to put the best face on the situation by saying, “They may have the bottle [i.e., Manila and Subic Bay], but I have the cork.”

Well, right now we’re in much the same situation. The donks have overrun the White House and Capitol Hill, but for now they don’t have the “cork” — the Supreme Court has it.

That body is the only thing left standing between the Constitution as it’s written, and “It means what we need it to mean for the moment” version that the donks want.

Pray that none of the conservative Justices leave the Court before 2013, and don’t be surprised if Hope-a-Dope and his masters Nancy & Harry don’t revive Franklin Roosevelt’s court-packing scheme before then.

    * All of these payments, as to AIG’s troubled financial products division, are retention bonuses, not performance bonuses

The American people hear the word “bonus” and go ballistic!! If they would take one minute to try and understand what these really are, perhaps they would calm down. Instead of rentention bonus, they should be called “contracted labor” or “salary for services rendered”. These morons in congress know darn well what these so-called bonuses are. That makes what they are doing even more reprehensible. Seriously, folks, these corruptocrats need to hear from the “chattering class” loud and clear about what we think of their treatment of the citizens of the country they are supposed to be working for! And the bill that passed to retro tax the contracted payments to these people is unlawful and unconstitutional. They are shredding our founding documents. Can we call it TREASON yet? What does it take to arrest someone for treason???

The Democrats gave out these bonuses over strenuous Republican objections.

President Obama’s $789 billion stimulus package contained the following provision, which deals specifically with executive compensation at AIG and other companies that receive TARP money:

The prohibition required under clause (i) shall not be construed to prohibit any bonus payment required to be paid pursuant to a written employment contract executed on or before February 11, 2009, as such valid employment contracts are determined by the Secretary or the designee of the Secretary.

Rep. Ed Royce (R., Calif.) read this statutory language to the subcommittee twice during the hearing’s early-afternoon session, just in case anyone was unaware. The executive compensation loophole was not merely a holdover from President Bush’s original bailout plan. It was laid out in clear statutory language that was enacted and signed by Democrats over vigorous Republican opposition. The provision was inserted in conference committee by Senate Banking Committee chairman Christopher Dodd (D., Conn.), one of the biggest beneficiaries of political contributions from AIG employees.

As Royce noted, “Some Democrats were aware of the bonuses, and went out of their way to protect those bonuses.” President Obama was one of them, but you would not know it from his dramatic performance on Monday, when he addressed the issue of AIG bonuses. “I mean, how do they justify this outrage to the taxpayers who are keeping the company afloat?” Obama asked. “This is not just a matter of dollars and cents. It’s about our fundamental values . . . excuse me, I’m choked up with anger
    here.”

    …..

.. even as the Financial Services Committee hearing was still taking place, the full House had the opportunity to vote on a measure that would stop payments to AIG until the bonus money is returned and require future bonuses at TARP-assisted firms to be approved by Treasury.

House Democrats defeated the bill with a procedural motion in a party-line vote, 221 to 182. Among those voting to block consideration of the bill were Frank, Hodes, and Rep. Gary Ackerman (D., N.Y.),

    Link.

This is the scandal, people. The Democrats rammed this bonus approval through over GOP objections, and are now pretending not to know how it happened.

It ADDS a further 90% tax on this bonus money.

As this money is still standard taxable income, and this bill does NOT make it exempt from standard income tax…

This money will be taxed at 90% AND your INCOME TAX RATE.

So…. add up state, local, Fed, Soc Sec, and 90% and this money will be taxed at about 150% tax rate.

It will never hold up, nor do they want it to. However, the very act of passing something illegal, should have recriminations. This attitude that they can do anything that suits them regardless of it’s legality, is in itself, illegal I would think.
