It’s baaaack: The DREAM Act returns

The shamnesty crowd is ready to roll again. The illegal alien college tuition discount bill known as the “DREAM Act” has been reintroduced — with bipartisan support, as usual:
Congressmen Howard Berman (D-CA) and Lincoln Diaz-Balart (R-FL), announced the reintroduction today of the DREAM Act in the U.S. House of Representatives. This legislation will restore the States’ rights to determine residency requirements for higher education benefits – giving states the option to provide in-state tuition. The American DREAM Act seeks to facilitate access to postsecondary educational opportunities for immigrant students in the United States who currently face barriers in pursuing a college education.
Last year, the DREAM Act fell eight votes short of cloture in the Senate (see Donny’s detailed post for more). As with several other pieces of legislation in the 111th Congress, however, this time around the bill has a supporter in the White House. President Barack Obama helped to pass similar legislation while in the Illinois state legislature, and has voiced support for the federal legislation on the campaign trail.
Critics contend the legislation would spend federal money on undocumented immigrants at the expense of American citizens, and that the bill would encourage illegal immigration. They also argue that citizens and residents would be forced to compete with undocumented immigrants for spots in college and university classes.
Of course they would. DREAM is the camel’s nose under the comprehensive shamnesty tent. This assessment of the previous DREAM legislation sponsored by GOP Sen. Hatch in 2003 is exactly right:
“This bill is a crass political calculation aimed at selling an amnesty disguised as an educational initiative,” charged Dan Stein, FAIR’s Executive Director. Stein noted that Democrats have already publicly stated that the DREAM act is just the beginning of a larger amnesty bidding war, and the bill will be used as a vehicle to extend amnesty to millions of illegal aliens.
Stein noted that since the number of slots at universities is fixed and tuition dollars are short, that for every illegal alien admitted an American student, or legal resident was being turned away. “This massive give-away of higher education to illegal aliens comes at a time when every state university system is raising tuition and cutting education benefits,” Stein continued.

One other reminder: Recall that last fall, a California court ruled that the state’s version of the DREAM Act conflicted with federal immigration law.
A state appellate court has put a financial cloud over the future of tens of thousands of undocumented California college students, saying a state law that grants them the same heavily subsidized tuition rate that is given to resident students is in conflict with federal law.
In a ruling reached Monday, the state Court of Appeal reversed a lower court’s decision that there were no substantial legal issues and sent the case back to the Yolo County Superior Court for trial.
“It has a huge impact,” said Kris Kobach, an attorney for the plaintiffs and a law professor at the University Missouri at Kansas City. “This is going to bring a halt to the law that has been giving in-state tuition to illegal immigrants.”He said it is a big win for California taxpayers who have been subsidizing education for undocumented immigrants.
The suit was filed in 2005 by out-of-state students attending California colleges. They challenged the state’s practice of allowing illegal immigrants to pay significantly lower tuition than they pay at the University of California, the California State University and the California Community Colleges.
UC charges out-of-state students nearly $18,000 a year more than it charges resident and undocumented students who graduated from California high schools. At CSU, out-of-state students pay about $8,000 more. And at the state’s 110 community colleges, they pay an average of about $160 a unit instead of $20 per unit – or $1,920 for a full load instead of $240.The suit was dismissed by the Yolo County Superior Court in 2006, setting up the appeal.
On Monday, three justices of the Third District Court of Appeal in Sacramento said that a 2001 state law, AB540, conflicts with federal law. The state law provides the benefit of in-state tuition to undocumented students while the federal law says an illegal immigrant cannot receive that benefit unless the same benefit is extended to all U.S. citizens without regard to California residency.The three California college systems specifically limit the benefits to students who attended a California high school for at least three years and graduated from a state high school.
In the ruling, the appellate justices said: “The state statute allows the benefit to U.S. citizens from other states only if they attend a California high school for three years. Thus, the state statute does not afford the same benefit to U.S. citizens ‘without regard to’ California residence,” as required by the federal law.

What people behind this scam never admit is the cost to the American taxpayer. Not only do they have to make up the difference in granting illegal kids in-state tuition, often thousands of dollars a semester more than out-of-state LEGAL citizens, but taxpayers have to make up the difference. Already some dozen or so states offer this idiocy, including Texas who offers in-state tuition to Mexican kids who live CLOSE to the border on the Mexican side. Not only are the not in-state, hell, they’re not even IN COUNTRY. It is BEYOND idiotic.
We already know where Juan McAmnesty stands on this issue. So the NIGHTMARE Act may pass this time.
Just more proof that our borders are racist while the Southern border of Mexico is paramount to their security. Heck, we are so danged rich we can pay for their border security AND their kids college educations. What’s the problem? National security? We are rapidly losing our national identity, what’s a little more gasoline on a really big fire?
We need to start our own BUTTSWAB act and wipe these idiots out of Congress.

No amnesty ever stopped or even slowed illegal immigration into the US in the past. Six amnesties of varying size have been enacted – none has slowed illegal immigration into the country.
The largest amnesty of 1986 was found to have been subject to rampant and widespread fraud and abuse – and that was pre-9/11; imagine the consequences of mistakes now.

You know, I get the racist hispanic congressmen who support this nonsense because the vast majority of illegals are hispanic (of course let a white guy try that and he/she will be crucified). But what I don’t get are the non-hispanic morons who buy into this drivel and nonsense. This act is horrible no matter which way you look at it (cost/preferential treatment/etc). Actually, as our de facto immigration policy exists now, it is inherently ‘racist’ (well, probably more accurate would be to say it is ‘ethnically’ or ‘culturally’ biased). Why??? Because we allow in (legally+illegally) people from Mexico/Central America in much larger numbers than the far poorer people from more distant regions – eg. Africa, parts of Asia, the Middle East, etc. Why should one group of people have an unearned advantage based solely on geography and not based on other more objective or ‘fair’ factors such as: willingness to assimilate, ‘need’, ‘merit’, etc?

This is a link to an article regarding a situation we had here in the Central Valley not too long ago.
When I first heard about it, I felt a sense of pride in the young man, and thought what a loss it would be if he wasn’t able to pursue his dream of higher education. I would feel the same even if Mexico was substituted for Armenia.
I do believe, as my posters here, that something needs to be done to tighten up our borders and reduce illegal immigration. But I’m sorry that I can’t share the sentiments of many of these posters on this particular topic, because I feel that most of these “illegal” young people in this country likely didn’t have much choice in the matter as to where they would live. If they have excelled in their academic efforts, then I would think that we would want to encourage them to become college educated, so that they will in turn become more productive members of society. Otherwise, these young adults could end up being a drain on government social services, as too many of the “undocumented workers”, or whatever the politically correct term for them currently is, end up being.
I believe that one way or the other, we’re going to be paying for them, so if that’s the case, I’d rather be investing the money in educating them rather than providing government social services. And if the young people have been in this country for a lengthy period of time, I don’t believe it’s reasonable to deport them to a country where they haven’t lived.

I was just reading Slate.com and read this article about how to change your kids’ behavior – reminded me of illegal immigration – you can’t reward bad behavior or you will get more, that is the bottom line!!!

The taxpayers are NOT “investing” in illegals, (no matter where they are from) we are “supporting” them. That means we feed, clothe, and pay for their medical needs. They live off the dole.
The 25-30 million illegals have had a great effect on the financial mess that we are in today because bleeding heart liberals wanted the TAXPAYERS to provide them with housing too. Housing they not only couldnt afford but don’t have a clue how to take care of.
The decisions of the parents of these kids to bring them into the US puts the responsibility of their children NOT being able to get a college education squarely on the shoulders of the parents. That doesn’t mean that the TAXPAYERS should have to pay for their college education too. They should be deported right along with their parents. It is just plain tough they will be going to a country they didn’t grow up in. It is ALL on the parents for making the decisions they made. It is called consequences. I have NO sympathy for their situation at all.
Just be wary of when the government finally wants to build a fence along the southern border, and carefully take note of which side the sharp stuff faces.

Here in Atlanta they are the future drug kingpins and gang leaders. Recent reports have shown that there has been a rapid increase in violence due to the presence of Mexican drug gangs. Rarely a week goes by anymore that I don’t see some young Hispanic men in my neighborhood being pulled out of their car and put in handcuff. (Police don’t do this for speeding or a broken light, even to illegals.)
Is that what liberals mean when they talk about the “lively and thriving” Hispanic culture?

The Supreme court is blatantly violating our constitution by turning to international law to make their decisions. Blatantly unconstitutional laws are declared constitutional, we no longer have any LEGAL recourse in our once great and proud nation. None with any legs anyhow. When people like sheriff Joe (Grandstander that he may be) are allowed to be sued for doing what they have been sworn into the office to do, when our borders are left open and people going to the border to do what our government will not … and one of the very few well and defined powers that it does have at that … are called the traitors, then legal recourse and a redress of grievances become oxymorons at best and irrelevant at worst.

Hmmm, thats a major stereotype. I was an engineer. Just off the top of my head, one frat brother is a surgeon and another is an architect. One is an Secret Service agent. One was a president of a bank until he got bought out. One other guy was my superior officer in the military. And trust me only one of those was “rich” when he was in college. Can you guess which one?
And its BS on just the immigrants studying. When I was a Graduate Assistant a few years ago, they went to the department head to complain that I made them do too much real work. They had a closed knit community who “studied” together and since I wasnt part of the educational establishment they could figure my testing methods. When I polled them as to their career intentions, most of them said they were going back to India to become rich (as managers).

This issue simply goes away when All students pay the FULL price for the education services. I just do not see any reason for the state or federal government to subsidize any of these universities. This simple action would actually bring the costs down to what it takes to educate people and not just feed an out of control, and clearly corrupt, government teaching union.
