Obama’s shamnesty distraction

By Michelle Malkin  •  April 9, 2009 12:13 AM

I’m not sure why Drudge is hyping the New York Times’ stenography piece on Obama’s plans to carry through on his promise to pitch a shamnesty bill. It’s not news. It’s a White House-planted distraction sourced mainly to La Raza/The Race lobbyist-turned-White House open borders czar Cecilia Munoz.

I pointed a few weeks ago to Obama’s meeting with Latino groups pushing for faster action on paving the pathway to citizenship for millions of illegal aliens. You know that the DREAM Act has been reintroduced in Congress. You know about the Obama Census plan to Leave No Illegal Alien Behind. And you know that Nancy Pelosi has been banging the “stop the unpatriotic raids” drum.

You also know that there is already a de facto shamnesty plan already in place — overseen by DHS Secretary Janet Napolitano, who is eroding interior immigration enforcement. A West Coast source tells me that customs and border patrol agents have been ordered not to confiscate Washington state IDs from illegal aliens. ICE agents are feeling pressure to curtail workplace investigations. And illegal alien deportation fugitive Zeituni Onyango, aunt of the president, is going nowhere.

What is more newsworthy is the rising tide of voices standing up against lax immigration enforcement and its costs.

It’s not just conservative immigration enforcement activists.

It’s politicians who have to answer to their law-abiding constituents demanding to know why scarce resources should be allocated to illegal aliens over citizens. Like the five Democrats in Colorado who helped kill the state version of the DREAM Act. And the local health officials in northern California who are finally ending taxpayer subsidies for non-emergency illegal alien care.

It’s citizens who have suffered the loss of loved ones as a result of bloody sanctuary policies. Like Ray Tranchant, who testified on Capitol Hill last week on how failure of local and federal immigration officials to cooperate contributed to the death of his daughter and her best friend at the hands of a revolving door illegal alien drunk driver. Or like Daniella Bologna, who filed suit against the open-borders government of San Francisco on Tuesday:

The family of a father and his two sons who were gunned down last year have filed a lawsuit against the city of San Francisco, claiming its sanctuary policy contributed to their deaths.
Anthony Bologna, 48, and his sons Michael, 20, and Matthew, 16, were gunned down in the Excelsior District on June 16 after possibly being mistaken for rival gang members, according to police.

Edwin Ramos, 22, a suspected member of the MS-13 gang, has been charged with their murders.

The Bologna family lawsuit alleges that the city’s sanctuary policy shielding illegal immigrants – even those charged with a crime – allowed Ramos to stay in this country illegally. Ramos had a history of violence and several prior contacts with San Francisco police as a minor. But city policy prevented officers from turning him over to federal immigration authorities for deportation.

“What we’re saying is that the city adopted and enforced a policy that was actually inconsistent with and prohibited by federal law,” Michael Kelly, an attorney for the Bologna family, said Tuesday.

Since the last immigration battle, more and more citizens and local and state officials have begun to recognize the ravages of lax enforcement. When Obama moves forward with his official shamnesty legislation, he better be prepared. We’ve been there. Done that. And the White House should know that we are ready to stop the Open-Borders Express again.

Stick that on your front page, Fishwrap of Record.

    They are passing legislation that has not been read.
    They are taking over private industry.
    Their smart diplomacy is looking like limp wristed Jimmy Carter redux.
    They cut sucessful defense programs while increasing all other facets of givernment entitlements.
    And thier hypocrisy on so many subjects is the only think transparent in the government.

    Sooner or later this radical leftist agenda will loose the support of the moderates who wanted to give Obama a chance. Granting amnesty now while the Americna economy suffers will not be popular.

    Yep, agreed AlohaGuy.

    Great work as always MM for the addressing this subject.

    The last time a major amnesty was considered by Congress, the phone system failed by sheer volume due to the outrage by Americans. What do you suspect looms for the next ‘try’?

    Note for Obama, his Administration and Congress: we’re watching, and despite what you might like to believe, most Americans adamantly do not even want to consider another Amnesty because, they, unlike you, know that it is a failed policy and will only do damage to the country in the long run. Just don’t do it.

    Instead, tell us how you’re going to secure the border, effectively do immigration enforcement in the interior of the country and help ensure that people coming to the US do so for all the correct (’right’) reasons and not the wrong ones. After all that happens, I *might* be willing to hear your pleadings…

    This one subject is perhaps the most poignant one in demonstrating just how out of touch or alienated the political machinery (especially the Executive Branch) is, in regard to the ordinary lives of most Americans. A majority of Republicans, Democrats, Independents, etc. DO NOT WANT AMNESTY! Get a clue people.

    NumbersUSA has posted an analysis about the newly introduced (but re-hashed) attempt at the ‘DREAM Act’.

    It is anything but a DREAM and includes loopholes so large just about an illegal alien (and parents, regardless of age) could claim and be approved ultimate legal residency in the US. If you care anything about this subject, please do check it out. I highly recommend the reading above.

    In MA, there are two new measures being introduced.

    Drivers License for Illegals. Why:

    State Rep. Tom Sannicandro, D-Ashland said the measure, if approved, would help identify undocumented residents and require that they, like other drivers, know and follow state vehicle laws. Allowing illegal immigrants a legal means to drive would also cut down on police stops and court time used to deal with immigrants who are driving without a license, he said

    .
    And Another to Extend Voter Rights for Illegals. Why:

    State Rep. Pam Richardson, D-Framingham said “We have a large population of people living here who don’t have the same rights and opportunities of the rest of us. I’m talking about undocumented immigrants.” Most “unfair,” she argues, is their exclusion from our democratic process. “They don’t feel that they have anyone to represent them [in government]. It’s because they’re not part of the democracy.”

    Both will likely go down when the dust settles, but just the fact that these are introduced – most likely to just test the waters for the Odumbo administration – is incredibly insulting.

    This shouldn’t surprise anyone. We knew this was coming whether Obama or McCain won. This should require nothing more than pulling the plan off the shelf, blowing the dust off, and going to work. Small problem though: since folks didn’t really put much thought into the truly important elections last year (e.g. the Congressional races), I doubt there will be many that listen to the anti-illegal immigration rants. Bottom line: Congress just doesn’t care what you think.

Certain groups vote for democrats ALL THE TIME. We are less than two years out from the next election and the republicans are in complete disarray. The collectivists in congress know this.

    SEC. 2. FINDINGS AND PURPOSES.

    (a) Findings- Congress finds that–

    (1) the manufacture, distribution, and importation of firearms is inherently commercial in nature;

    (2) firearms regularly move in interstate commerce;

    (3) to the extent that firearms trafficking is intrastate in nature, it arises out of and is substantially connected with a commercial transaction, which, when viewed in the aggregate, substantially affects interstate commerce;

    (4) because the intrastate and interstate trafficking of firearms are so commingled, full regulation of interstate commerce requires the incidental regulation of intrastate commerce;

    (5) gun violence in the United States is associated with the majority of homicides, over half the suicides, and two-thirds of non-fatal violent injuries; and

    (6) on the afternoon of May 10, 2007, Blair Holt, a junior at Julian High School in Chicago, was killed on a public bus riding home from school when he used his body to shield a girl who was in the line of fire after a young man boarded the bus and started shooting.

    (b) Sense of the Congress- It is the sense of the Congress that–

    (1) firearms trafficking is prevalent and widespread in and among the States, and it is usually impossible to distinguish between intrastate trafficking and interstate trafficking; and

    (2) it is in the national interest and within the role of the Federal Government to ensure that the regulation of firearms is uniform among the States, that law enforcement can quickly and effectively trace firearms used in crime, and that firearms owners know how to use and safely store their firearms.

    (c) Purposes- The purposes of this Act and the amendments made by this Act are–

    (1) to protect the public against the unreasonable risk of injury and death associated with the unrecorded sale or transfer of qualifying firearms to criminals and youth;

    (2) to ensure that owners of qualifying firearms are knowledgeable in the safe use, handling, and storage of those firearms;

    (3) to restrict the availability of qualifying firearms to criminals, youth, and other persons prohibited by Federal law from receiving firearms; and

    (4) to facilitate the tracing of qualifying firearms used in crime by Federal and State law enforcement agencies.

    Chap, ok, lets let the government force us to register every gun we own, fingerprint us (cause, you know, the criminals and the illegals are going to follow the law…oh wait…) and HOPE they do not then expand the rules into forcing mental health exams at will.

    Yes, you are right, right now they can only be privy to your mental health exams to date

    And of course, the govt has every right to take away a constitutional right and then also invade our privacy while doing so.

    Once the guns are registered, a new law can pass, they now know where the guns are, and they can take those, too. Then we can all sit back and wait to be overrun by criminals, illegals, terrorists, sharia law…whatever.

    c) Child Access Prevention- Section 924(a) of such title, as amended by subsection (a) of this section, is amended by adding at the end the following:

    `(9) Whoever violates section 105(a)(2) of Blair Holt’s Handgun Licensing and Record of Sale Act of 2009, knowingly or having reason to believe that the person is prohibited by subsection (g) or (n) of section 922 of title 18, United States Code, from receiving a firearm, shall be fined under this title, imprisoned not more than 10 years, or both.

    `(10) Whoever violates section 922(gg) shall be fined under this title, imprisoned not more than 5 years, or both.’.

    and, you know, the AG has these little caveats built into the system:

    SEC. 402. REGULATIONS.

    (a) In General- The Attorney General shall issue regulations governing the licensing of possessors of qualifying firearms and the recorded sale of qualifying firearms, consistent with this Act and the amendments made by this Act, as the Attorney General determines to be reasonably necessary to reduce or prevent deaths or injuries resulting from qualifying firearms, and to assist law enforcement in the apprehension of owners or users of qualifying firearms used in criminal activity.

    SEC. 102. APPLICATION REQUIREMENTS.

    (a) In General- In order to be issued a firearm license under this title, an individual shall submit to the Attorney General (in accordance with the regulations promulgated under subsection (b)) an application, which shall include–

    (7) a certificate attesting to the completion at the time of application of a written firearms examination, which shall test the knowledge and ability of the applicant regarding–

    (E) any other subjects, as the Attorney General determines to be appropriate;

    Sure, pardon the stretch Chap. Why would I ever allow myself to believe that our dear government might try to take away our Constitutional rights?

    NO WAY will I hand over guns, register them, or even admit I own them, till i NEED them. Then they can pry them out of my cold dead hands if they really want em.

    reminder, who is the AG?:

    Mr. Eric Holder recently joined in an amici curiae brief in District of Columbia v. Heller arguing that the Second Amendment does not guarantee individual rights and supporting the D.C. handgun ban. It states: “Amici disagree with the current position of the United States Department of Justice that the Second Amendment protects an individual right to keep and bear arms for purposes unrelated to a State’s operation of a well-regulated militia.”[1] The brief relies in part on arguments by an attorney for the Violence Policy Center, a firearm prohibitionist lobby.[2]

    The brief supports a 1968 Office of Legal Counsel analysis of a bill to “[r]equire the registration of every firearm in the United States” and to “[p]rovide a Federal system for licensing possession of firearms.” It opined that the Second Amendment “does not affect regulation of individual possession as proposed in this bill.”[3]

    President-Elect Obama stated that he agrees with the Supreme Court’s decision in Heller confirming the Second Amendment guarantee of individual rights and invalidating the D.C. handgun ban. Mr. Holder has a career-long track record opposing those rights.

    When Mr. Holder served as Deputy Attorney General (1997-2001) and Acting Attorney General (2001), the Department of Justice implemented policies hostile to Second Amendment rights. In the establishment of the national instant criminal background check system (“NICS”) in 1998, the Department claimed the authority to keep records on lawful firearm purchasers for an alleged “audit log” for six months, despite the law’s requirement that such records be destroyed and its prohibition on registration of firearm owners.[4] The record retention period for auditing was reduced to a mere 24 hours by regulation in the next Administration, and has since been so restricted by Congress in appropriations riders.

    …In a 1999 interview with ABC, Mr. Holder was asked whether the Second Amendment recognizes “that citizens have a right to bear arms,” including the right to “buy a firearm?” He responded: “No court has ever said that the Second Amendment actually says that. I think, if you look at it, it talks about bearing gun in a well regulated militia. And I don’t think anywhere it talks about an individual.”[5] To the contrary, as Heller notes, State courts and the Supreme Court itself repeatedly stated that the Amendment guarantees throughout the nineteenth and twentieth centuries.[6]

    After terrorists struck with box cutters on 9/11, Mr. Holder responded with an op-ed arguing for “background checks on all gun sales,” which would have extended felony penalties to the otherwise innocent, intrastate conduct of law-abiding private individuals. He added: “Congress should also pass legislation that would give the Bureau of Alcohol, Tobacco and Firearms a record of every firearm sale.”[7] Under the guise of combating terrorism, every American firearm owner would thus be registered with the government.

    Mr. Holder served as the United States Attorney for the District of Columbia from 1993 to 1997. In that role, he asked the D.C. Council “to strengthen a law making possession of an unregistered firearm a felony and increasing the maximum prison term from one to five years.”[8] The Council kept the current misdemeanor penalties instead.

    …In sum, Eric Holder has taken a constricted view of Second Amendment rights. Millions of law-abiding Americans exercise the right to keep and bear arms. Mr. Holder’s opinion is that the people have no such right unless they are commanded to exercise it in a formal militia, which renders the right meaningless. He has advocated requiring that all firearm owners be registered with the government and that failure to comply be punished as a felony with substantial imprisonment. The restrictions he favors threaten civil liberties.

    Now take 12,000,000 illegals becoming legal. If you don’t think they won’t bring their relatives over to become legal citizens you have to be living in a dream world.

    And with the liberals desire for benevolence using other people’s money and their propensity to sue the government for violating their civil rights if we don’t give them free healthcare, food and housing, all of the social services and healthcare we do have will be in jeopardy of collapsing rendering it useless for everyone.

    Well said.

    If amnesty passes, the country will be irrevocably changed for the worse. There is at least 20M-30M illegals here. With amnesty, these “new citizens” will be eleigible to abuse chain migration (aka family reunification). After the 1986 amensty, it was estimated an average of 3 immmigrants were brougt in under chain migraiton by the new citizens. 100M new citizens within a decade, of mostly uneducated illiterate immigrants, is what we can expect. That will be the death knell for our country.

    I MIGHT consider amnesty for select individuals (no criminal offenses, parents of anchor babies, etc) ONLY with the following conditions:
    1. Elmination of “birthright citizneship” at a minimum. Possible revocation of anchor baby citizenship back to the last amnesty (1986)
    2. No welfare, or gov’t assistance of any kind, for illegal aliens.
    3. Full workplace enforcement with heavy fines and/or jail for offenders.
    4. Legal immigration reductions to offset the impact of those amnestied
    5. Tougher restrictions and requirements on H1-B visas
    6. A visa tracking systme that flags someone as soon as their visa expires without having left the country through proper channels. An arrest warrant is then issued.
    7. An amendment to the constitution stating amensty can never be provided in the future under any circumstance.
    8. A limit be put in place for the number of amensty spots. Can not be open ended. Say 5M or so.

    Basically, ELIMINATE THE MAGNETS that draw and keep them here. Frankly, these actions need to be done to stop the bleeding anyway. I don;t support amensty period but will compromise with the right incentives. Appeasement has never and will never work.

    I don’t know… I still like Patriot Party. It says exactly what it is. Do acronyms really matter when you’re trying to save the last best hope of the world? Really?

    Call me biased, but I kinda like “Patriot Party”. Maybe because it implies something that libtards can never be confused with.

    Libs can easily usurp the word Patriot. Look how they did it by saying paying higher taxes is patriotic. Patriot Party would just get turned into jingoism. Right now with the Dems in power, they see any dissent as unpatriotic.

    However, there can be no mistake how the founders felt.

    Amnesty is part of the plan. Its so the census can record a new wave of voters to keep the Dems in power forever. HOw you gonna stop this when the Dems in Congress have the majority. We can whine all we want to but this Amnesty is gonna pass this time. Nothing we can do.

    I agree with everything you wrote Michelle but we are living in the days of brazenly open corruption on daily public display from Washington and Wall Street.

    Our one-party system is just not responsive and has been openly at war with voters since their first amnesty bill loss. Every presidential hopeful of both wings of the United Establishment Party is firmly in the pro-amnesty camp with Romney coming out a few days ago prodding Obama to do this ASAP “to get it behind us”. I just don’t believe this is merely a distraction.

    Besides, it is beginning to look like participation in the April 15 Tea Parties is going to be boffo. We represent the heart of those 84% of Americans who made it clear in 2006 and 2007 that Americans just don’t want amnesty. We want border enforcement. Once our numbers appear in the streets next week, the media be forced to tell the story. We can then start expanding the narrative beyond the tax issue to include amnesty.

    The NYT is desperate to get their circulation up and siding with American citizens against a corrupt government could save their franchise.

    I have to respectfully disagree. Lib/marxists can steal anything they damn well please. But they simply can not steal the true Patriot philosophy. Everything they do is about sellling out the American ideal and American dream. They feel they have to apologize for patriotism, not stand for it.

    They do not, never will, and never have owned the term. It’s ours. It’s not my opinion, its fact.

    I can’t think of a better name for a new party based on Founding Fathers’ principles and adherance to Constitution and American sovereignty.

    We have uncounted millions out there, layed off or fired, whose benefits have run out and they are no longer on the roles. To a large degree it was the younger voter and the comfortably employed that put this moron in the White House. They now have no future and some are waking up to that fact. Even the dumbest dimwit voter will eventually see they have made a huge mistake and look for something else. Even the dumbest dimwit voter will eventually see this country is broke, the promises made on healthcare, redistribution of income, the trashing of civil rights, and the business owners that will flee this country – setting us up for third world poverty status. The one thing I count on is the youth of today loves toys, comfort and Stuff… We have to recruit them before the next election. In the meantime, go to the tea parties and get involved with your local groups. Be that agitating fly in the ointment.
