    Remember when the torture memos were declassified and released to the public? One of the reasons they gave for the release was to satisfy the demands of an ACLU lawsuit. This is what the ACLU said about the memos at the time:

    In response to litigation filed by the American Civil Liberties Union under the Freedom of Information Act (FOIA), the Justice Department today released four secret memos used by the Bush administration to justify torture.

    So, they released the torture memos because of litigation, but they refuse to release Cheney’s memos because of litigation. It sounds like they want to have it both ways. Maybe Nancy is right on one point. Someone is trying to mislead us. But I don’t think it’s the CIA; it’s the Obama Administration pulling the strings.

    Good question: it depends on who is the original classification authority of the document. Also, as per Executive Order 13292, signed by President Bush:

    PART 3—DECLASSIFICATION AND DOWNGRADING
    Sec. 3.1. Authority for Declassification. (a) Information shall be declassified as soon as it no longer meets the standards for classification under this order.
    (b) It is presumed that information that continues to meet the classification requirements under this order requires continued protection.
