The climate change e-mails EPA doesn’t want you to see

Another day, another Obama cover-up.
The Competitive Enterprise Institute has obtained internal EPA e-mails that show the agency willfully and recklessly disregarded scientific data that undermined the bureaucracy’s global warming zealotry.
This information is especially relevant as Congress rushes to pass the cap-and-trade nightmare on Friday.
CEI general counsel Sam Kazman has notified the EPA and requested that the internal communications and suppressed study be released to the public and added to the public record. Will another whistleblower be disappeared? Note especially this warning to the dissenting scientist: “The time for such discussion of fundamental issues has passed for this round. The administrator and the administration has decided to move forward on endangerment, and your comments do not help the legal or policy case for this decision… I can only see one impact of your comments given where we are in the process, and that would be a very negative impact on our office.”

CEI is submitting a set of four EPA emails, dated March 12-17, 2009, which indicate that a significant internal critique of EPA’s position on Endangerment was essentially put under wraps and concealed. The study was barred from being circulated within EPA, it was never disclosed to the public, and it was not placed in the docket of this proceeding. The emails further show that the study was treated in this manner not because of any problem with its quality, but for political reasons.
CEI hereby requests that EPA make this study public, place it into the docket, and either extend or reopen the comment period to allow public response to this new study. We also request that EPA publicly declare that it will engage in no reprisals against the author of the study, who has worked at EPA for over 35 years.
The emails, attached hereto, consist of the following:
1) a March 12 email from Al McGartland, Office Director of EPA’s National Center for Environmental Economics (NCEE), to Alan Carlin, Senior Operations Research Analyst at NCEE, forbidding him from speaking to anyone outside NCEE on endangerment issues;
2) a March 16 email from Mr. Carlin to another NCEE economist, with a cc to Mr. McGartland and two other NCEE staffers, requesting that his study be forwarded to EPA’s Office of Air and Radiation, which directs EPA’s climate change program. The email notes the quantity of peer-reviewed references in the study, and defends its inclusion of new research as well. It states Mr. Carlin’s view that “the critical attribute of good science is its correspondence to observable data rather than where it appears in
the technical literature.” It goes on to point out that the new studies “explain much of the observational data that have been collected which cannot be explained by the IPCC models.” (Emphases added);
3) a March 17 email from Mr. McGartland to Mr. Carlin, stating that he will not forward Mr. Carlin’s study. “The time for such discussion of fundamental issues has passed for this round. The administrator and the administration has decided to move forward on endangerment, and your comments do not help the legal or policy case for this decision… I can only see one impact of your comments given where we are in the process, and that would be a very negative impact on our office.” (Emphasis added);
4) a second March 17 email from Mr. McGartland to Mr. Carlin, dated eight minutes later, stating “ I don’t want you to spend any additional EPA time on climate change.”
Mr. McGartland’s emails demonstrate that he was rejecting Mr. Carlin’s study because its conclusions ran counter to EPA’s proposed position. This raises several major issues.
A. Incompleteness of the Rulemaking Record: The end result of withholding Mr. Carlin’s study was to taint the Endangerment Proceeding by denying the public access to important agency information. Court rulings have made it abundantly clear that a rulemaking record should include both “the evidence relied upon [by the agency] and the evidence discarded.” Ethyl Corp. v. EPA, 541 F.2d 1, 36 (D.C. Cir. 1976), cert. denied, 426 U.S. 941 (1976).
B. Prejudgment of the Outcome of the Endangerment Proceeding: The emails also suggest that EPA has prejudged the outcome of this proceeding, to the point where it arguably cannot be trusted to fairly evaluate the record before it. Courts have recognized “the danger that an agency, having reached a particular result, may become so committed to that result as to resist engaging in any genuine reconsideration of the issues.” Food Marketing Institute v. ICC, 587 F.2d 1285, 1290 (D.C. Cir. 1978).
C. Violations of EPA’s Commitment to Transparency and Scientific Honesty: Finally, the emails suggest that EPA’s extensive pronouncements about transparency and scientific honesty may just be rhetoric. Shortly before assuming office, EPA Administrator Lisa Jackson declared: “As Administrator, I will ensure EPA’s efforts to address the environmental crises of today are rooted in three fundamental values: science-based policies and programs, adherence to the rule of law, and overwhelming transparency.” Jan. 23, 2009, link. See also Administrator Jackson’s April 23 Memo to EPA Employees, “Transparency in EPA’s Operations”. These follow the President’s own January 21 memo to agency heads on “Transparency and Open Government”. And in an April 27 speech to the National Academy of Sciences, the President declared that, “under my administration, the days of science taking a back seat to ideology are over.”
Because of ideology, however, it was this back seat to which Mr. Carlin’s study was relegated; more precisely, it was booted out of the car entirely.
For these reasons, we submit that EPA should immediately make Mr. Carlin’s study public by entering it into the Endangerment docket, and that it should either extend or reopen the comment period in this proceeding to allow public responses to that study. It should do so, moreover, while publicly pledging that Mr. Carlin will suffer no adverse repercussions from agency personnel. Mr. Carlin is guilty of no wrongdoing, but the tenor of the emails described above suggests he may well have reason to fear reprisals.

Yes, the documents should be released. Not only because the law requires it but because we paid for it. Like it or not, public work product is paid for with our tax dollars. Any study paid for with the taxpayer dime, including commissioned outside studies, and research grants must be made available to the public.
Whatever it is, it goes to the GPO (Government Printing Office), save National Security type documents.
Didn’t we have this discussion several years ago? It primarily concerned Government financed medical research and private companies who were concerned about proprietary data. If you don’t want the release of proprietary data, don’t take the research money. OK, that is more of an aside.
The truly sad thing is that the emails included the actual study that is in question. Too bad the actual emails weren’t available, vice photo copies, because then the document would have become public knowledge.
Note to ‘Leakers’ – accidentally send the emails globally (hit the ‘reply all key’) in the future. Ooopsies happen.

What’s especially ironic about this matter is how the “science” of
The Coming Ice AgeGlobal Warming“Climate Change” works in perfect reverse of what has for centuries been the scientific model: instead of gathering all evidence and following it where it leads, they begin with the Cherished Preconclusion then filter and manipulate the evidence to “support” what they just “knew all along.”Then, just like donks do when they’ve ginned up enough fake votes to overtake a Republican with a slim lead on election day, they’ll declare a “Consensus” to have been reached and spend their remaining efforts on squelching further debate by silencing those who still haven’t got with the narrative.
Under the Hope-a-Dope regime, one by one every instrument of the state is being turned into a political club with which to bludgeon the American People into “correct” ways of thinking, talking and behaving. If they are ultimately successful in their efforts, this Republic will die not with a bang, but by the “Death of a Thousand Cuts.”
Turning the EPA into a pseudo-science propaganda ministry is just one more slice.

FWIW, I sent messages to both by senators (both Ds…ptooey!) and my congressman (one of the good guys). I urged all to vote NO on Cap & Trade, and to push for an investigation of the politically motivated suppression of scientific studies that don’t support their agenda.

Before reading of the latest EPA outrage, a letter was already composing itself to the Fresno Bee, stirred up by the most recently posted gasoline prices. Here in CA we pay on average 30 cents more per gallon than the other 48 states, adding up to a significant sum for drivers like me who average 27-28,000 miles per year. This price differential is apparently due to the unique “environmentally friendly” blend brewed only by CA refiners. The point I was planning to make in my letter was that if CA sheeple enjoyed paying that much more for our cleaner gasoline, they will be ecstatic when the obamanation gets their Cap & Trade and carbon emission plans passed so we can pay MUCH more for utilities winter and summer forever and ever, amen. Few believe me when I shout that the whole global warming scam is just politics and a means to get and consolidate power. Science has little or nothing to do with it.

Obama’s EPA is still sitting on a number of mining permits – permits that may well mean the difference in determining how much of an increase (minimal or max) each of us pays for electricity this winter – with no clue as to when they might move on them.
Oh, I’m not suprised by any of TEH ONE’s actions. Just expecting them. As for as a 100% tax, just google “imputed income taxation” and see what you discover for what some in CONgress hope for and just may have planned for us in the not-too-distant future on the way to the 100% tax.

Anyone that has worked with any governmental agencies (FDA, EPA etc) knows that if your studies are skewed in any way, or if you’re found out to omitted crossing a T, your study equals sh!t and you don’t get no money or go-ahead.

Never forget that Bush, Clinton and Bush bear a significant responsibility for the economic chaos that threatens our country. Bush and Bush expanded government at every opportunity. The GOP governed as “socialist-lites” for the 12 years they held power in this nation.
Bush 43 in effect pre-socialized the economy in an incredible manner and degree in the last two to three months of his term. The GOP has become the “other socialist party” in America. This gave Obama plenty of cover to accelerate the socialist nonsense.
This is why I no longer consider myself a Republican. I am tired of big-spending socialists regardless of which party they belong to.

This Mr. Al McGartland, (Office Director of EPA’s National Center for Environmental Economics)…. might need to be charged with some sort of crime. I would think that obstructing data that would determine the outcome of national policy is a BIG no no. At the very least, he should be out of a job.

This just shows the utter stupidity of socialists. If taxes are at 100%, everyone would stop working because they would earn nothing. If no one works, then no tax revenue. So, the government has to stoke up the printing presses and inflate the paper money supply. But no one is working so no one is earning any money. So the government just gives it away so you can buy what you need. But business has folded because no one is working. So the government has to provide for everything. 100% tax = 100% socialism.
It’s obvious that socialists have never understood the Laffer Curve. The B.O. will do anything to turn the U.S. into a 3rd world country.

Do people here follow the Surface Stations project at wattsupwiththat.com? It certainly made a global warming skeptic out of me. I personally feel that it should be a much bigger story than it seems to be. The US temperature record is not reliable. Tell your congress critters.
The Old Garbage In Garbage Out. From what I have seen on tehir stations are in direct sunlight next to a forestation with asphalt, A/C units, etc. among the other locations.
We DON’T KNOW what the temperature is. We cant predict it a few days out how cam we predict it years out?
My Congresscritter will be hearing about this, though I doubt it will change his mind.
