Here is the cap-and-tax “placeholder:” Where’s the fine print?
When I live-blogged the House debate on cap-and-tax last Friday, I noted the existence of a “placeholder” in the bill. Rep. Joe Barton mentioned it was unprecedented to have such a mechanism (allowing bill-writers to insert language to be determined after the law was approved) in a bill up for final passage. Later, I noted that Barney Frank explained on the floor on Friday that the placeholder in the cap and trade bill apparently will deal with regulations of financial derivatives market associated with reducing carbon emissions. Frank said he was confident a “good system will be in place.”
Well, I looked up the placeholder in Waxman’s late-night, 300-page manager’s amendment.

Now, since everyone in Washington is so concerned with fine print, why don’t they show us the fine print of the missing section of this bill.
Where is it?
Has the Energy Czar seen it?
Will the members of the Senate see it?
How about the GOP’s Cap-and-Tax 8?
Call them. Ask them.

I just heard, and this is the way of the future in Obammy Land, a State of the Art, Coal Fired Power Plant was finally authorized to be built in SouthEast Kansas earlier this year. The EPA has stepped in, nullified the whole deal and basically demands the whole process begin again from the beginning.
Just caught the guy at Rep. Smith’s office off guard by asking why Smith would vote for smething that has an unwritten clause. He said Rep. Smith passed the bill because it was in line with his environmental stance. I pointed out that the unwritten clause could end up going against his stance and what would he do then? “I’ll pass your comment along.”
If you can in good conscience vote on a bill that you have NOT read, and so do NOT really have any idea of what it is you voted yes for, then it is not a really big step to leave large sections blank…after all you are not repeat NOT going to be allowed to read it anyway. They have “higher” ideals than the simple little stupid oath they took upon taking their office. They have betrayed their office, they betrayed their country, they no longer be called “honorable” . At some time something will have to be done about this…….
Just got off tthe phone with Castle’s office. Andy says it has been written and I can find it at thomas.loc.gov. He asked where I was reading that it wasn’t. I told him a blog and on Waxman’s site. He asked that I call my representative because there are many out of state people calling and constituents can’t get through. I pointed out to him that Congress represents all Americans whether they can vote for that representative or not and that I have the right to redress my government.
The section is written on Thomas:
SEC. 788. SUPPLEMENTAL AGRICULTURE AND RENEWABLE ENERGY INCENTIVES PROGRAMS.
`(a) In General- Emission allowances allocated pursuant to section 782(u) shall be distributed by the Administrator at the direction of the Secretary of Energy and the Secretary of Agriculture in accordance with this section. Not less than 50 percent of the allowances shall be available for the program established pursuant to subsection (b).
`(b) Agriculture Incentives Program-
`(1) ESTABLISHMENT- The Secretary of Agriculture shall establish by rule a program to provide incentives in the form of emission allowances for activities undertaken in the agriculture sector that reduce greenhouse gas emissions or sequester carbon. Under this program, the Secretary of Agriculture shall provide incentives for projects and activities that–
`(A) reduce or avoid greenhouse gas emissions, or sequester greenhouse gases, but do not meet the criteria for offset credits established under the American Clean Energy and Security Act of 2009;
`(B) support actions to adapt to climate change; or
`(C) prevent conversion of land that would increase greenhouse gas emissions (including projects and activities that complement or supplement conservation programs administered by the Secretary).
`(2) CONSIDERATIONS- In designing this program, the Secretary shall ensure that it provides support for–
`(A) development and demonstration of practices to reduce greenhouse gas emissions or sequester carbon in agricultural operations where there are limited recognized opportunities to achieve such emissions reductions or sequestration; and
`(B) projects that reduce greenhouse gas emissions or increase sequestration of greenhouse gases and also achieve other significant environmental benefits, such as the improvement of water or air quality.
`(3) RESEARCH- The Secretary shall establish by rule a program to conduct research to develop additional projects and activities for crops to find additional techniques and methods to reduce greenhouse gas emissions or sequester greenhouse gases that may or may not meet the criteria for offset credits established under the American Clean Energy and Security Act of 2009.
`(4) USE OF INFORMATION- Information and data generated by this program should, where relevant, be used to inform the development of additional offset practices and methodologies.
`(c) Renewable Energy Incentives Program- The Secretary of Energy and the Administrator shall establish by rule a program to provide allowances to State and local governments to support the deployment of renewable energy infrastructure.
I am sure the place holder section under Barney Franks tutelage will add another decimal point to the total cost to the taxpayer.
The conservative model for loss of GDP by the year 2035 stands at $9.4 trillion just by implementing this one bill.

With all the other deficit spending,accumulation of debt, and the massive entitlement of universal health care threatening- not only does it appear that the perfect storm is forming to kill a massive economic machine, you can smell how rotten it is.
Since changing election rules after the fact has worked out for them lately, it stands to reason they would insert details into laws after the fact too.
Soon they will figure out how to make all these tax bills retroactive, so they can send a bill to you for the past.
It is amazing so many people fall for the transparency facade of these crooks who wrote the book for dirty tricks, and public theft, and how to blame someone else and make them appear guilty for their own behavior.
Glad someone got through to Congresswoman Mary Bono Mack’s office. A lot of effort was put into their response. Too bad the letter did not mention the direct benefits to her district, the ones with the New Jersey-like odor.
Back around 1990, my then employer, authorized a group I was part of plus the CHP, put together a program to see what we could do about diesel smoke. Two enforcement officers, myself, five CHP officers and a supervisor chasing down smoking vehicles. We all had an impact, but trains, ships and planes were all off limits. Big, big polluters. What will be the benefit of offsetting emissions of all those trains and trucks when the energy producing sites are already contributing less pollution than those sources?
