Today, it’s the SCOTUS ceremonial dance with the Senate.

Republicans will delicately challenge Sonia Somotmayor on racial preferences, Second Amendment rights, property rights, sovereignty issues, and her extracurricular speechifying.

Democrats will bloviate about pet causes (“consumer-friendly” laws, the environment).

Sonia the Wise will assuage skeptics with repeated insistences that she’s “fair,” “impartial,” and committed to the rule of law.

Absent that “meltdown,” Lindsay Graham will pronounce himself satisfied with her ritual reassurances.

And Sotomayor will be one cleared hurdle closer to overcoming yet another set of “incredible odds” to complete her “compelling personal story.”

Ritual reassurances, ritual reassurances.

Soto re-explains her wise Latina comments: It was a “bad play on words” that “fell flat.”

So bad she repeatedly used it a half-dozen times before friendly audiences.

When Sen. Sessions was grilling Judge Sotomayor on why her panel gave such shoddy treatment to such an important case, the judge kept saying they relied on a “thoughtful 72-page opinion” from the district judge. What she didn’t mention was that before her panel attepted to bury the case in an unpublished ruling, the district judge dug the grave by attempting make certain that no one got to see how “thoughtful” the 72-page opinion was — it, too, was unpublished. This was not an effort to “explain why the law requires what it does”; it was an effort to make the law go away.

    On another note, I don’t know why this just occurred to me last night in regards to Sotomayor’s comment of “I would hope that a wise Latina woman with the richness of her…blah, blah, blah.”

    This comment just isn’t one denegrating the judgement of men, but of other women. If she meant women in general, she wouldn’t have made a point to say “Latina.” So, she’s putting herself as a Latina above other women, be they white, black, Asian, etc.

    Too bad no one at Fox hasn’t picked up on this.

    These hearings are a joke. Pretty much all hearings are a joke in D.C. The various interet groups have made up their minds and nothing will change. The person being questioned will say whatever she/he thinks the people want to hear and then, once confirmed, go right back to deciding cases the same way they always have.

    Why not just looks at a person’s decisions over the course of their working life and then see if those decisions are consistent with what you want on the SCOTUS. If so, vote them in or not.

    I would say, regardless of what Sotomayor says under questioning, her decisions do not represent someone I would want on the Court.

    These “hearings” are really just for the congress-critters to hear themselves talk and be seen on TV.

    Yesterday, Judge Sonia Sotomayor made her opening statement to the Senate Judiciary Committee and moved another step closer to taking a seat on the United States Supreme Court. In case you missed it, watch the video of her opening statement here:

    As President, there are few responsibilities more serious or consequential than the naming of a Supreme Court Justice, so I want to take this opportunity to tell you about the qualifications and character that informed my decision to nominate Judge Sotomayor.

    Judge Sotomayor’s brilliant legal mind is complemented by the practical lessons that can only be learned by applying the law to real world situations.

    In the coming days, the hearings will cover an incredible body of work from a judge who has more experience on the federal bench than any incoming Supreme Court Justice in the last 100 years.     I am very concerned about the lines of questioning about the Commerce Clause…it seems to me that the U.S. Congress is trying to use that to enact laws in contravention to the Constitution. Democrats want supporters of this position on the SCOTUS. It is insidious!
