Thune concealed carry reciprocity amendment fails
Sen. John Thune sponsored an amendment to the defense authorization bill allowing concealed carry permit holders to carry their weapons across state lines as long as they abided by other states’ CCW rules and regulations.
The Senate just voted down the measure by 58-39, falling two short of the 60-vote threshhold needed to block a filibuster.
Several Democrats voted for the amendment, including Sens. Feingold, Dorgan, Bayh, and Webb.
Sen. Pryor switched his vote from “nay” to “aye” at the last minute.
GOP Sens. Lugar and Voinovich voted “nay.”

While it’s not universal, most states with CCW laws on the books already excercise reciprocity with other states that have CCW laws.
I guess instead of a federal law on this, I’d like to see people put the pressure on their state goobermints to enact full reciprocity with ALL states. Keep the federal goobermint out of the picture on this.
Frankly any federal goobermint involvement in firearms laws outside of what is stated in the 2nd amendment is, to me, something to be avoided. The feds should do nothing more than see to it that our right to keep and bear arms isn’t infringed on by state or local laws. Other than that, stay the heck out of it.

Is this really a conservative position, other than that it involves firearms? I don’t believe that anyone on either side is taking a principled stand on this. If the vote were about gay marriage, I would expect the vote to flip and would not expect Schumer to issue a similar statement.
Maybe a “gun rights” Democrat (yes, I know…a contradiction in terms!) could pull a Pelosi/Waxman, and slip in an amendment in an unrelated bill? You know, an “in the dark of night” moment, and have stealth passage? (They’ve admitted they don’t read the bills, right?)
Nah…that’s crazy talk! That kind of action might help protect American freedom, and we can’t have any of that!

Apples and oranges. There is nothing in the Constitution which guarantees the right to homosexual marriage, however the right to bear arms is explicit, and shall not be infringed upon.
I disagree. There is an enumerated right to keep and bear arms in the Constitution. There is no Federal right to marry, unless 5 justices smell a right from the emanations of penumbra of several parts of the Constitution… perhaps in “free association”, but that’s reaching.
I plan to support “Up and Out!” I am spreading the word in my community to get support for the idea.
For those of you who haven’t heard about it, it’s pretty simple;
When any elected official’s term is “up,” they should be voted “OUT!” This should apply to local, state, and federal representatives, regardless of party affiliation.
These selfish politicians who have enriched themselves and their families on the backs of the taxpayers MUST go. No if’s, and’s, or but’s!
They are destroying America, and we keep electing them back into office. Enough is enough!
I purchased a 5-year NRA membership in January. I would like to take this opportunity and thank the Dems for sparking my interest in firearms.
This is actually a good thing. If you violate a states 10th amendment right by imposing reciprocity on them, you can also make a case to violate the tenth amendment in other places. The Feds already have too much unjustified/unconstitutional influence over the states. We have to be consistent. To tell the Feds to get out of the way of our States Right selectively, would set a dangerous precedent. THAT is why so many Democrats actually wanted this.. Now you know..

I have given NRA memberships to family members (when NRA has offered discounts) just to bump the membership totals. They loved them, especially the choice of magazines. Some didn’t own a firearm then, but have since purchased one and going thrugh the drill of classes.
Dan, I thought the same thing…it’s a good thing. Once the feds get involved in any thing they can also pull a 180 & take back more than the original intent of the law.

I think this was a bad idea, and I have a CCW. I don’t want the federal government telling the states what they have to do about regulating guns. If its fair for them to say you have to abide by one state’s laws, across all borders, then they can just as easily turn around and ban concealed carry altogether. I’m for states’ rights.
And yes, states do regulate their own reciprocity. Not all play fair, but many do.

Following Heller, it seems that the Thune bill really represents the next domino that must ultimately fall – to the chagrin of anti gun libtards everywhere.
The three stooges quotes are in honor of the current administration. I post them because I find that they are in many ways apropo to the topic at hand. Myself and others like them. I’m sorry you either don’t like or understand them, but then, it’s a guy thing.
Ron and Dan, I think that you are missing an important point here. The Constitution guarantees the right to keep and bear arms. This is a right of every citizen. The states, nor the Federal government have any right to make laws restricting that right, period. There would be no 10th amendment infringement since the right is guaranteed by the constitution which trumps states rights. The Federal governments function in this case is to protect the right of citizens to keep and bear arms. Simple! Except both the federal government and the states have endeavored to strip and/or regulate that right away from the people.
This amendment would simply have been a step in the right direction, whereby the Federal government steps up to protect a constitutionally guaranteed right. Our Constitutional rights are not determined by the boundaries of states or their laws, just as the federal government cannot make laws that and infringe on the states in areas not specifically given it in the constitution. There is a lot of infringement by both the states and the feds when it comes to our rights as We The People.

I was amenable to a federalist argument against this amendment, but there isn’t one. Yes, some states could be too lax with CCW, just as they could be with drivers’ licensing. And as this applies to only resident permits, it is not as if criminals who reside in a state can just get a CCW from somewhere else.
So now I will remain defenseless when I cross over into Maryland, which doesn’t have CCW reciprocity with Virginia. As a result I will continue to cross rarely.

What if a state violated the 19th Amendment by not allowing white men to vote? If the Feds overruled that, re-establishing the 19th, would you take the side of that state?
I haven’t anything against the Three Stooges – I used to enjoy them quite a bit too before I grew up, and some quotes are apropos. 8-10 in every thread gets to be tedious.
The States are sovereign except where they trample constitutional law, as the Supreme Court has had to overturn state laws in the past. One would hope one would side with the Constitution.

I can’t believe both senators from VT voted against this. It doesn’t even affect their state. Anybody can go there and carry already with no permit at all.
In effect, you already have a legal right to carry concealed weapons across state lines in most cases – only a few states do not recognize Texas concealed carry permits, for instance. I used to travel back and forth across the country quite often. I generally carried my handgun under the seat, and I just made it a point not to get stopped in those states with recip agreements (or if I did, I didn’t act like I was guilty of something). I’ve never had my car searched for contraband of any kind, except at the Mexican border (but that’s another story).
I sure don’t understand why places like Chicago, New York City, and Washington, DC, all having very strong gun control, have so much crime where firearms are used. If it’s illegal for people to have concealed pistols in those cities, even with a CCW, there should be very little crime where firearms are involved.
And what about Seung-Hui Cho shooting all those people at Virgina Tech-That campus had a complete ban on weapons. If he would have just obeyed the law, there wouldn’t have been any shooting. /sarc

BTW, there is no reciprocity for CCW in the North East – or if so, very little. May as well not carry if you head that way. Thune’s amendment would have let people with CCWs from other states carry while visiting or traversing across the state.

I have a ccw from SC. I had to take a 8 hr. class and have a shooting score to pass the course. I work in GA where you can go to the kmart and get a CCW. GA and SC do Not recognize their respective CCW laws. Therefore I had to get a New Hampshire out of state CCW permit to be able to carry in GA. Figure that one out.

you are very naive! Criminals will always get the guns even in a very gun controlled atmosphere. Its a perfect situation for them because the citizens are unarmed. Do you think that a policy or sign banning guns is going to keep someone from murdering innocents? Guns don’t kill people, people kill people!
Never forget that once an unarmed person is atacked and robbed, or worse, they generally begin screaming for tougher laws, more government intervention.
The person who already has his/her own personal protection does not.
Think about that.
Also the police do nothing to prevent crime. They usually show up after the bodies hit the floor. The Police will not save you. Only you can be responsible for your own safety. In this world today you are asking for it if you are not armed someway!
For the record I carry, I shoot, am a life member of the NRA, retired veteran, love the environment, and am getting my soon to be teenage, next month, daughter her life membership to the NRA.
Plus she and I are planning a thru-hike of the Appalachian trail next summer.
I love the national park system, I love hiking, I love my family. I intend to always protect them all.
My driver’s license is good in all 50 states of the Union and the District of Columbia. I see no reason why my concealed handgun license should not be.

It is not my aim to overtly provoke, so I will table the Stooges for a while and find other ways to make my points, hopefully with humor, as humor may be our only salvation with regards to the current administration. For those who used drivers licenses as an example. It’s not because the federal government says that the states had to give reciprocity on drivers licenses. It is because they agreed on it.
My Firearms association founder is a constitutional attorney specializing in firearms & the second amendment. If he says screwing with the 10th amendment would be bad in this case, then I’m sorry, but I’m going to take his opinion over anyone here. No offense meant to anyone. After all, it’s because of him that the state of Tennessee finally loosened it’s tyrannical gun laws.
This is the wrong way to do it. Don’t force reciprocity. Force states to abolish their illegal anti-open-carry laws. The Constitution gives me the right to carry a gun—any state that denies me that is violating my rights. I’m willing to concede on concealed carry. There’s nothing in the Constitution about having the right to conceal a weapon. Indeed, “bear arms” implies open carrying. Open carry without a permit is illegal in many states.
