Shimauma2,
No, you can't sue the teacher.

100% of the responsibility for this falls directly on the nurse and the Department of Health. Period.

As someone who works in a prehospital and hospital environment, there are the " 5 Rights " that are supposed to be verified BEFORE ANY adminsitration of medications...

1) Right Patient
2) Right Medication
3) Right Dosage
4) Right Time
5) Right Route

To verify we are giving the medication to the right patient, we ASK the patient for their full name and birthdate and compare what they tell us to the chart/medication order from the doctor.

This is 100% a nursing error.

If any of these children who got this shot had died because of an allergy to eggs, I would hope the parents sue the daylights out of the school system.
L

uh, NO goofus, even if we don't want it, the school system is run on public tax money and that's what the winner of the lawsuit would get; their own money!

They need to sue the daylights out of the stupid teacher who sent the wrong kid and the stupid nurse who didn't check the name. I promise when you hold the actual person who screwed up personally accountable, people will start paying attention.

I will rewrite my comment without sarcasm. The difference between how the school incident was handled now and how it would have been handled in a socialized health utopia is dramatic. In the USSR, even in the 1990's sterile techniques were not observed. When I got injured, the kindergarden staff didn't tell my parents of how I got injured and they only found out days later from one of my friends there. If you think asking a parent to sign consent after the fact is bad, and it is, imagine a culture where consent is not even a consideration. Once your health needs are administered by low paid clerks who have limited education and want to use their post to feel some power over you, that will be socialized medicine. You will quickly surrender any notions of what is proper and deserved, because all you will care about is a real threat to your life and will focus on how you can please this "medicine clerk", so that he will grant you an audience. If you live in a big city, going to a dmv office should provide an illustration. In Russia, it is an established custom that if you want a doctor to treat you, you have to bribe him. If you want to see this doctor, you have bribe the receptionist. I think that many people in this country have been the beneficiaries of relative abundance and safety for so long that they do not know just how miserable the alternatives might be. They think that America can keep giving no matter how much they abuse this country. They don't really understand that the alternatives to what we now have in this country, are slavery and a meager subsistence in while living in fear. In that, they are spoiled. Still, it was unfair to direct this remark about spoiled Americans to the commenters here. I think that many people here are pretty well informed.

I fought this battle over hearing and vision screenings every year for my kids. When they were younger, I sent a note with them instructing the school that they were NOT to be taken out of class for the screening and that they were encroaching on our family doctor's territory.

When they hit high school, I instructed them to tell the teacher/administrator the same thing, with instructions to call me if there was an issue.

I also opted them out of D.A.R.E., the brain-wash your children to call the cops instead of their parents program. If you have read their booklet yet, please do. You will be appalled. Of course, the school didn't have an opt out program, I just wrote a letter and instructed them to have my kids do homework in the library.

I've also battled "counselors" over schedules and teachers. Once you point out that you don't have to have your kid in their school at all, or that you can sign up for the district online class, they usually capitulate.

I should have homeschooled, but I'm the main breadwinner in our family so it wasn't an option. But you are still the parent and still have the right to dictate some things in school if you stand up for yourself and your kids.

love2rumba,

It's true. WE82 and I are soulmates. We ARE rubbing off on each other. He begins to sound more like me and I begin to have strange dreams about fancy city boys that happened to run out of gas on a lonely, deserted dirt road, hogtied in a basement, and comments about how they have purdy mouths.

I'm sure these mistakes will be eliminated in a government run health program. Ad if they do, the people who screw up will be held responsive.

Vinny,

Evidently I misunderstood your point. I don't read Peggy Noonan much any longer but I'll take a look when I have time.

Our political class is largely composed of people who are educated beyond their intelligence, arrogant, callous, spoiled brats who desperately need to be reminded that they work for us. They govern in our stead. The do NOT rule us. It is time to drive that point home to these people.

wareagle, I believe you misunderstood my comment. I do not believe that vaccinating kids without parental consent is responsible behavior, and trying to get consent after screwing up is further proof that these folks behaved irresponsibly. What illustrated in my description of "advanced" socialized medicine is just how bad things can get. I also think that people pushing this form of utopia have no idea of what they are promoting. Peggy Noonan sometimes writes a good article and the last one she posted at WSJ is worth reading. That article explains much more eloquently than I can, that our political class is made of ignorant, callous, and spoiled brats.

Number 1. In pediatrics, you ALWAYS get signed permission, from child (if allowed) or parent/guardian. View it and verify it. Number 2. You ALWAYS verify the idenity of the patient prior to giving any medications or injections or treatments. Any patient. This nurse is going to find herself in front of the Board of Nursing for a disciplinary hearing, shortly. Since injury occurred, following the injection, she will probably face suspension.

There was a movie about this called, “My Cousin Vinny Got Sent to the Gulag.”

I really liked the part played by Marishka Tomeiski where she is first murdered by the Tatar Hordes, and then murdered by the vicious Cossacks, and then murdered again by the Bolsheviks. I laughed, I cried, my life was changed…
