9/11 families to corruptocrat AG Eric Holder: “We will fight you all the way;” Updated

By Michelle Malkin  •  December 5, 2009 10:52 AM

Update: Video and pix at Urban Infidel. Keep the heat on! See also: El Marco’s flashback photo essay of the kind of “peers” who may well end up on the jihadists’ juries. Crikey.

At high noon (EST) today, 9/11 families will rally in NYC against the Obama/Holder jihadi show trials. The interest-conflicted, security-undermining AG didn’t bother consulting with DHS on the terror trials. 9/11 family member Greg Manning speaks out.

If you are in the area, please join the protest and show your support. Every voice counts:

NEW YORKERS TO ATTORNEY GENERAL HOLDER:
“WE WILL FIGHT YOU ALL THE WAY!”

What: December 5th rally protesting the NYC based trial of 9/11 conspirators
Where: FOLEY SQUARE, MANHATTAN
When: Saturday, December 5th, 2009 12:00 noon
Who:

The 9/11 Never Forget Coalition, a diverse group of 9/11 victims, family members, first responders, active and reserve members of the military, veterans, and concerned Americans, is holding December 5th rally protesting the plan to bring the 9/11 terrorist conspirators to trial in New York City.

The Coalition formed to fight the decision of President Barack Obama and Attorney General Eric Holder to try the 9/11 co-conspirators in New York City’s federal court, effectively giving war criminals the same rights as American citizens while endangering the safety of all New Yorkers.

Two weeks ago, we sent a letter signed by 300 family members of 9/11 victims to the President, Attorney General and Defense Secretary Robert Gates asking them to reverse course. The letter has now been signed by over 120,000 Americans and is posted below.

Debra Burlingame, founder of 911 Families for a Safe and Strong America, said “Our rally on Saturday, December 5 will tell Attorney General Eric Holder, President Barack Obama and their supporters in Congress: We will fight you all the way!”

The Obama administration should have stuck with the original plan to try the terrorists in a military tribunal. This plan, approved by the United States Congress, is a fair, safe and effective way to bring these men to justice. They would be tried in a secure facility, far from the United States. They would be offered a defense team, but would not have access to classified data. They would be denied the media exposure their cause craves. The conspirators had signaled their intention to plead guilty under a tribunal. The dog and pony show that Holder wants to hold in downtown New York will drag on indefinitely, prolonging the agony of the 9/11 families in what will be the second wave of the 9/11 terror attacks while risking national security.

My best to the 9/11 families. There is no valid reason to hold these trials in the US civil courts system other than to appease the Dems’ liberal base with political retribution against the prior administration and intimidation of America’s intelligence gathering apparatus.

This act really is a war on everyone in America. Anyone who has a heart & a soul lost their brothers & sisters that day. I take that very personally. I take what Obama & Holder have done here (no matter how hard Obama makes it seem like he had nothing to do with it) as a direct insult to the victims, the families, & the extended family called America, as a direct act of war against us. They are on the side of Terrorists now. They are foxes guarding the chicken coop.

Hold the rally, but plan for enough time for the entire rally to visit every congressman and senators office demanding a binding resolution to cut off funding for this stupidity.

The left has threatened that for taking action against various things they oppose….pass a resolution cutting off funding, he!!, Little Dick Gebhart (thanks BS) even threatened this for the first Gulf War and I believe there were several threats for the WoT, why not a simple resolution for this?

Holder has said he did not even consult the President before making his decision

Holder is either lying or exceeding his authority. While he has authority when it comes to civil trials in this country, he does not have any authority over defendants in the military justice system. The only person with the authority to transfer a defendant from military to civil custody is the President himself. So, either the President is directly involved in this decision (which means he can’t shield himself from responsibility if things go wrong), or Holder should be fired for exceeding his constitutional authority.

“There are no neat or easy answers here,” Obama said in a speech in which he pledged anew to “clean up the mess at Guantanamo.” Speaking at the National Archives, Obama said he wouldn’t do anything to endanger the American people.

“The record is clear: Rather than keep us safer, the prison at Guantanamo has weakened American national security.”

“It is a rallying cry for our enemies… By any measure, the costs of keeping it open far exceed the complications involved in closing it.”

Those are some of the reasons Obama gave for ordering the closing of Gitmo. But it is becoming clear that he was wrong on all counts. The complications of closing Gitmo are going to far exceed the costs of keeping it open.

Suppose the neighbors complain about an old outhouse in your backyard; so you promise to get rid of it. Do you “clean up the mess” by taking the contents of the outhouse and dumping them into your living room? Why not? If you’ve successfully handled a few dirty diapers in the past why can’t you handle a truck load of crap?

That’s what Obama is doing. He’s taking the mess from Gitmo and dumping it into America’s living room. That is not cleaning up the mess, it is not making us safer, and it will not make our neighbors respect us more.

Even if no terrorist acts occur in New York during these civil trials, only two things can happen. Neither of them are good.

First, Holder could win a conviction after a long and expensive trial. But to do so would require a suspension of the normal rights given to civilian defendants, such as change of venue, impartial jury, Miranda rights, disallowal of tainted evidence, right to confront witnesses, and so on.

So, such a conviction would be obtained with loaded dice and would be viewed by the world as a mockery of justice. It would not instill confidence in our judicial system nor would it encourage respect for American values.

Second, all rights normally given to the accused could be carefully bestowed on these terrorists. This would include throwing out all tainted evidence obtained by force or without a lawyer present, providing confidential documents to the defense, and allowing the defense to confront all witnesses (including waterboarders) and thus put them and their families at risk. The result would be a platform for the terrorists to put America on trial. It would end in either a hung jury or an acquittal.

In this case, the world would view us as a bunch of weenies who bow to our enemies and let them push us around. They would not develop a new respect for American values, nor would our security be improved by such a process. And if Holder decides to hold acquitted defendants indefinitely, there will be an outcry from the ACLU and other groups around the world that will make Gitmo look like a picnic. Any way you look at it, civil trials for these terrorists are a lose/lose proposition.

I really don’t think any of these buffoons have given any detail of this a thought. Again, I think they plan on winging this.

They’ll make decisions as they go along.

Yes, they can have access to this evidence, no that appeal is not allowed.

If they would have thought of this, Holder would have consulted more than a couple people with nothing to do with anything. He would have consulted Obama (which I believe he did anyway), he would have consulted DHS, the FBI, etc.

It will be much worse than a kangaroo court.

They may let a lower level jihadi off, and give some higher level one a slap on the wrist and claim the system worked.

They may also allow this farce to go on forever, paying off the traitorous attorneys defending them who would allow convictions in the end anyway…as long as they are paid.

Nothing would surprise me with these nitwits.

Will anyone in DC stand up to this?

Not from the left. They want Bush/Cheney on trial.

From the right? They’re too busy sucking up to the left to be concerned over security of the peons.

name one communist gubmint anywhere in the world which listened to the peasants. as stalin said, i don’t care who votes for whom, that is irrelevant, it is who counts the votes that is relavent. washington state, minnesota, new york 23, the list goes on forever. how does a nitwit like chavez become el presidente for life, promise the stupid and gullible two chickens in every pot, then stop dissent, intimidate dissenters, bribe the media and fawning sycophants, nationalize enough business until you have a majority working for you, then like new york city, change the rules to allow the savior to run forever. he is counting the votes, so wins are guaranteed. thugocracy is born, and thy name is social justice.
