Related breaking news this morning from SCOTUS:

The Supreme Court has refused to take up an appeal from former Guantanamo Bay detainees who say they were tortured and denied religious rights.

The justices rejected the appeal without comment Monday. Four British men say they were beaten, shackled in painful stress positions and threatened by dogs during their time at the U.S. naval base in Cuba from 2002 to 2004.

The Court’s denial of review of Rasul, et al., v. Myers, et al. (09-227) leaves intact a federal appeals court ruling that former Defense Secretary Donald Rumsfeld and ten military officers are legally immune to claims of torture and religious bias against inmates who were at Guantanamo but have since been released. The Obama Administration had urged the Court not to hear the case, saying that, whatever claims the four ex-detainees were now making, they had no legal basis for those challenges at the time they were at the U.S. military prison in Cuba — that is, between January 2002 and March 2004.

The D.C. Circuit Court had ruled in favor of immunity, and in doing so avoiding a repeat of its earlier decision — vacated by the Supreme Court — that Guantanamo prisoners had no constitutional rights. The Justices had ordered reconsideration of that conclusion.

    Holder did not mention when he testified in Congress that the reviewing court of any legal decisions made by the trial judge in the KSM trial is the very liberal US Court of Appeals for the Second Circuit. This is a court that is frequently overturned by the US Supreme Court on security issues but the judges on the second circuit court know that only a small number of their decisions can be reviewed by the USSC, which has ten other circuits to review cases from. So the second circuit judges feel free to do as they want. This is the Court that ruled against the New Haven firefighters and ruled that exam results are trumped by the need for “affirmative action”.     Lets see if they can surprise the world and petition for the terror trials in NYC to be behind closed doors and transcripts sealed. While I feel that the military courts were the correct venue I could live with the approach.

    While I respect your sentiment, you have to remember that it is the Obama administration that is responsible for KSM being brought to trial on U.S. soil in the first place. That the Obama administration recognizes that terrorists had no constitutional rights during 2002-2004 is but a half-measure. They have no constitutional rights, period.

    I do believe that the court which has standing for terrorists caught “in combat” is a military tribunals (which should be done in NYC for poetic justice).
