Rothenberg moves MA Senate race to “Toss-Up;” Obama sends e-mail/video SOS for Coakley

Democratic desperation and other compelling evidence strongly suggest that Democrats may well lose the late Senator Edward Kennedy’s Senate seat in Tuesday’s special election. Because of this, we are moving our rating of the race from Narrow Advantage for the Incumbent Party to Toss-Up.

Whatever the shortcomings of the Coakley campaign (and they certainly exist), this race has become about change, President Obama and Democratic control of all of the levers of power in Washington, D.C. Brown has “won” the “free media” over the past few days, and if he continues to do so, he will win the election.

My take on Fox & Friends this morning:

Well, I didn’t get my full reverse-Midas wish for Obama to campaign in-person for Coakley. But Virtual Barack is riding to the rescue:

President Barack Obama’s making a personal pitch for fellow Democrat Martha Coakley in next Tuesday’s Senate election in Massachusetts.

The president is putting out e-mail and Web video in support of Coakley, the Massachusetts attorney general, who’s running in the special election to serve the final three years of the late Sen. Ted Kennedy’s term. The e-mail and video will be sent out Thursday to the Massachusetts distribution list of Organizing for America, the president’s political arm at the Democratic National Committee.

“I am supporting Martha Coakley. As your attorney general, she’s taken on Wall Street schemes, insurance company abuses, and big polluters,” Obama says in the e-mail. “She’ll be your voice, and my ally. And she needs your help.”

    BTW, I read McConnell talked him out of it, but Dr. Tom Coburn, who I hope runs for POTUS in 2012 and stood in the way of consent and made the clerk start reading the Sanders amendment, supposedly wanted the entire Reid Senate Marxist Medicine bill read by the clerk.

    If the Mass SecState does delay certifying a Brown win, I hope Coburn again refuses to consent to waiving reading the bill.

    BTW, I suspect, after all of Mothra’s gaffes, Brown wins a majority of the votes of Massachusetts citizens who are alive and voting only once and legally, the real question, as in Minnesota, where Norm Coelman won the election but lost his seat, is if Brown can win by a big enough margin that even with ACORN type fraud a recount isn’t in order.

    Democraps always win recounts when the SecState is a Demonrat. Always. They just keep finding ballots in the funniest places…

    If they do this and the Senate does not seat him like the House did with the winner of NY23 even though that race had not been certified it will only add more ammo for the 2010 mid term elections.

    What is so terrible about a national ID card? Just wondering. If not that, at least make it mandatory to have a photo ID at the polls and have them checked for every voter. A good cross-reference database so no one votes more than once would be good too. I can’t understand why these things haven’t been done long ago! Without free, honest elections, we are no better than third world countries voting for an unopposed dictator.

    Don’t focus on the NY race, remember what we did in VA and NJ! The NY race was a third party candidate who, within a few weeks, stomped the Republican candidate out of the race and almost won.     He didn’t say he would delay certification if Brown wins. He said he had to wait 10 days so that absentee ballots could be counted, and didn’t say it in the context of a potential Brown win.

    Frankly, he CAN’T certify until those votes are counted. People point to Tsongas getting seated by the House in 2007 as hypocrisy. However, in that case he hadn’t certified Tsongas when she was sworn in. He had sent a letter to the House of Representatives saying that the unofficial results indicated no contest. Galvin’s entire point is that Brown, if he won, may not be able to be sworn in because the Senate insists upon actual certification. A similar letter, even if issued, would be worthless per Senate rules.

    If you can find examples of the Senate seating someone without having yet been certified then have at them, but that is still not Galvin’s doing or his hypocrisy.

    Here is the rule (MGL %4-116):

    Section 116. The governor shall, in the presence of at least five councillors, certify to the results of the examination of the copies of the records of votes cast for governor and lieutenant governor, for councillors, for state secretary, state treasurer, state auditor and attorney general, and for senators and representatives in the general court, and shall issue his summons to such persons as appear to be chosen to said offices. The governor shall issue certificates of election to such persons as appear to be chosen to the offices of senator in congress, representative in congress, clerk of the courts, register of probate, sheriff and district attorney, which shall be countersigned and transmitted by the state secretary. No certification shall be made or summons or certificate issued under this section until after five o’clock in the afternoon of the fifteenth day following a state election, or, in case a state-wide or district-wide recount is held in accordance with section one hundred and thirty-five, until the tabulation and determination under the preceding section have been revised in accordance with the results of such recount; provided, however, that such certification may be made or summons or certificate issued on or after the seventh day following a special state election, unless a candidate who received votes at that election files with the state secretary, not later than five o’clock in the afternoon of the sixth day following the election, a written statement of intention to seek a recount or otherwise to contest the election.

    And this only AFTER the Secretary of State has received all of the results sealed and certified from the Town or City Clerks. Apparently federal law says that you have to count absentee ballots up to 10 days after election day.

    Okay, this winner of a Mass Senate seat may not have been formally certified by the Mass Sec of State, but he certainly was sworn in and seated within 24 hours of being elected:

    Now that is interesting. But it goes back to the issue of whether or not the Senate is sincere in its rules to only seat someone that has been certified. Based on two very recent examples (Burris and Franken) where Reid was pressured to seat them prior to official certification (and in Franken’s case, even after he was certified because the legal challenges continued), I’d say that they have a pretty strong case for consistency.

    Wouldn’t an interconnected database from state to state solve that? I think voting should be done by computer anyway. That way, the computer would not allow the vote if you have already voted. And you must slide in your ID card in order to vote. Now, that doesn’t preclude someone having more than one ID card. There are always ways around things, especially if you have an evil, crooked mind and no scruples. Oh, I guess it wouldn’t work after all because we are dealing with liberals.

    I’d love to see a secured computer voting system. Heck, if Ebay can do it, why can’t our gubmint?

    One of the biggest holes is after the polls close and all those beautiful boxes full of votes head to the counting stations with only one or two people taking them in. Wasn’t it New Mexico that found several alongside the road after Nov 2008′s vote? Those boxes have seals and are numbered. How could they not have missed them? Perhaps they don’t number them? Oregon has a mailed ballot system, just like an absentee ballot. I don’t know how to fix it, but do know it has to be done.

    The current governor of Washington state was finally determined the winner in her 1st race for governor after 3 recounts and a liberal judge, but by god she won…oh yeah, she’s a demorat.

    Bubba is due here tommorrow – in Worcester, to be precise. The Worcester Telegram & Gazette reports:

    The Coakley camp, meanwhile, continued plans for rallies around the state intended to mobilize the state’s Democratic establishment in support of Ms. Coakley. The events include appearances by former President Bill Clinton Friday in Boston and Worcester. U.S. Rep. James P. McGovern, D-Worcester, is lending his help for the campaign event featuring Mr. Clinton at Worcester Polytechnic Institute in Worcester.

    A report on the radio said that John Kerry is supposed to show up too.
