Attention, NYC: White House still stuck on stupid

By Michelle Malkin  •  February 8, 2010 12:06 PM

The dream of Cirque du Jihad in the Big Apple lives. The White House won’t rule out multiple Gitmo civilian trials in NYC, despite bipartisan opposition and massive public outrage over the costs, risks, and recklessness.

Still stuck on stupid, via the NYDailyNews:

The feds may still try the 9/11 terror thugs near Ground Zero, President Obama said yesterday, shocking critics.

“I have not ruled it out, but I think it’s important for us to take into account the practical, logistical issues involved,” Obama told CBS News anchor Katie Couric.

…Julie Menin, the chairwoman of lower Manhattan’s Community Board 1, said Obama needs to say where he stands on the issue once and for all.

The President “should unequivocally state that he will not hold these trials in New York City and then figure out where they’re going to move the trial,” she said.

Related: Team O’s civil-liberties woes

White House spokesman Robert Gibbs declared last week that 9/11 kingpin KSM “is going to meet justice, and he’s going to meet his maker and he’s likely to be executed for the heinous crimes that he committed.”

And President Obama himself said something similar last November, declaring of KSM: “I don’t think that it will be offensive at all when he’s convicted and the death sentence is applied to him.”

Now, obviously KSM is guilty, and richly deserves to die.

Indeed, he and his comrades offered to plead guilty before military tribunals — and to accept the death penalty.

But now that Obama and Attorney General Eric Holder have decided, in order to prove that America really is committed to civil liberties, to try these killers in civilian court, they need to . . . well, respect civil liberties.

Loose talk like that from Gibbs and Obama is a hanging curveball for defense lawyers determined to exploit every single one of KSM & Co.’s new constitutional rights.

That defense lawyers’ cabal, I remind you again, includes a cadre of Attorney General Eric Holder’s old colleagues at Covington & Burling.

Nice assist, eh?

The obstinate track taken by Obama is a clear indication he has another agenda, than just proving “that America really is committed to civil liberties.”

I have to agree with Granite on this one.
Remember, there is no rush to bring these enemy combatants to trial. Obama can wait this out until the day before he leaves office in January 2013 (at which point he’ll just pardon them).
Seriously, this is just a distraction. He will drag it out a very long time because he cannot easily back out of it. It needs to drop to page 8 or lower so he can just move the venue to Gitmo with no fanfare. Or, he’s waiting for the “inevitable” attack we’ve been promised so he can say “Well, NOW I can’t have the trials there”.

Asked and answered. Its all about the hook-ups and feeding money back into the liberal machine. Obama makes even Tricky Dick look good by comparison- after all, he only lied about knowing about someone else’s crime.

Personally, I hope Obama keeps pushing for the trials in NYC. The way I look at it is it will force Congress to act by denying the funding for the transfer of detainees to NYC from GITMO.

They will either have to vote with the voters and deny the funding or vote with Obama and face the voters down the line. Either way it is a lose lose situation for the Democrats as a whole.

Notice that Obama used the expression “when the death sentence is applied to him”. He did not say “when KSM is put to death”. Obama knows that federal judges will delay the death penalty for years, even if KSM ever gets the death penalty in the trial. It is also highly unlikely that a federal jury in NYC would give the death penalty anyway. To avoid the death penalty, KSM only needs one holdout and the holdout only need to hold out for a few days before the federal judge (almost all liberal activists on the federal bench in NYC) declares a hung jury and then gleefully gives KSM a life term. So it is highly unlikely, given the liberal nature of the jury pool in New York and given the liberal nature of federal judges, that KSM will ever be given the death penalty in the first place. The other thing that Obama did not mention is that Holder is planning on giving KSM and all defendants special death penalty defense lawyers. These lawyers are only used for the penalty phase and they are very skilled at avoiding death sentences. This is what they do all day and all year long. They need only concentrate on the juror(s) that the jury selection expert (also to be paid for by taxpayers) tells them are likely holdouts. Obama should be compelled to answer: “Will you consider this case a failure if KSM is spared the death penalty?”. Holder was not asked that question. I wish I could have crossexamined Holder instead of the dummies in the Senate that allowed Holder to glide right on by.

Grounds for a mistrial, possibly. The President has tried and convicted him, in the news, exposed to everyone. Anyone remember Nixon and Manson? The defense might get away with it, this time.

The idea of having trials for jihaddis in NY, particularly famous jihaddis, is stupid if you are concerned about the welfare of the nation and concerned about the welfare of NY in particular. It might not be if you don’t care about such things.

I wouldn’t assume that Red Hussein is necessarily stupid to that degree.

    His priorities lie elsewhere.
