    Right there is one of the differences between docs and attorneys.

    I can’t tell you how many times, when I was in private solo practice, that I provided diagnoses; but then either got paid say, only 20% of my bill, or nothing at all, because of insurance “intricacies”, or because the patient didn’t have the bucks.

    And the diagnoses were of the same “quality” and extent as that of any other case/patient.

    And when the treating doc would say that the patient was of limited means, I’d tell him to tell the patient to get done what he needed to get done; we’d worry about the bill after, structure a payment plan, “write off” some of the bill, whatever it took. (I’d typically send out bills 1-3 weeks after rendering the service; and get paid 2-6, sometimes more, months after rendering the service.)
    Only people who threw the bills away, and whom my billing service never heard from after 3-4 notices, got sent to a collection agency.

    Not complaining.
    Still practicing.
    Still doing the same thing.

    Ninety-nine percent of the doctors and dentists that I have met truly went into their professions primarily to help people. I have several friends that are attorneys, and they do not say the same of most of their colleagues.

    When I entered college, I told my Dad that I was going to study dentistry. He thought that was a good choice. He was a WWII vet he that was captured at the Battle of the Bulge; he was held by the Nazi’s and briefly by the Russians before he escaped and found his way to American forces. He told me become anything you want to be. Just do not become a lawyer he cautioned. He figured that in a worst case scenario in which the communists took over the country, they would keep the Doctors alive, but the first thing they would do would be to shoot the lawyers.

    I do not know the exact numbers in 2010. A few years ago, American Universities were graduating 3600 dentists per year, 13,000 physicians per year, and 38,000 attorneys per year.

    Based on those ratios there are way more lawyers looking for work than there are doctors. Many nuisance malpractice suits are filed based on the chance of an out of court settlement. It costs the plaintiff nothing but 40% of his settlement plus his attorney’s expenses. Insurance carriers are inclined to pay out on these because they look at how cost effective a settlement is versus going to court. Ultimately, the insurance company does not care about the doctor’s reputation.

    Of course, there are legitimate malpractice cases, but for under employed attorneys the current system is cash cow. Throw enough sh*t on the wall, and some of it is going to stick. Any legitimate attempt to bring down medical costs must include meaningful tort reform.

    Once, in the mid 70s, we got naively involved in an Estee Lauder suit. Yes, we won. The lawyers got millions, the plantiffs, like us, got $5.00, once the rest, after the lawyers, was divided.

Maybe that’s something that ought to be – y’know – debated, like, publicly, instead of having a bill get cobbled together in the back halls of Congress of by who-the-hell-knows-who and rammed through without a chance for members to even read it. Maybe there ought to be (and I’m probably getting really radical here) committee hearings with things like expert testimony – you know, all the things that are supposed to be part of the normal legislative process.

    It was no more than 60 years ago that the doctor came to your home, treated you, and then you payed him a chicken, maybe even and a pig. If you had money, you offered him more than the chicken and pig. Fast forward -

    Naaa, no matter what happens in Washington DC, we are still the United STATES of America. South Carolina is already considering the potential for default and just the mere mention of it in an actual state legislative initiative is going pique the interest of other states. All it takes to wipe the slate clean is for enough states to call a new Constitutional Convention and re-write a few phrases of our existing Constitution to revert BACK to the founders orginal intent of having a LIMITED federal government.

    They can NULLIFY every wrong Supreme Court decision ever made such as those concerning the collosal abuse of the commerce clause , ignoring the enumeration of powers, the creation of the Federal Reserve Bank, the IRS, etc..

    But in reality – the states only have to threaten Washington in order to get them to HEEL. The federal government is supposed to be serving the states and the people – NOT THE OTHER WAY AROUND.
