House Republicans to force vote on Pelosi’s Slaughter House solution; Update: Democrat condemns “deem and pass”

Just heard from GOP Hill folks:
“House Republican leaders will announce this morning a plan to force a vote this week on a resolution that would require the Senate health care bill to be brought to an actual up-or-down vote. The likely text of the measure is below. If passed by the House, the resolution would prohibit Speaker Pelosi from implementing the “Slaughter Solution,” the scheme by which House Democratic leaders are seeking to “deem” the Senate bill as passed without an actual vote in the House. More details to come.”

Ensuring an up or down vote on certain health care legislation.
Resolved, That the Committee on Rules may not report a rule or order that provides for disposition of the Senate amendments to H.R. 3590, an Act entitled The Patient Protection and Affordable Care Act, unless such rule or order provides for—
(1) at least one hour of debate, equally divided and controlled by the Majority Leader and the Minority Leader, or their designees; and
(2) a requirement that the Speaker put the question on disposition of the Senate amendments and that the yeas and nays be considered as ordered thereon.

Andy McCarthy weighs on self-executing rules, precedent, and the Slaughter rule:
At the Examiner, Mark Tapscott points out that when the Republican-controlled Congress used a “self-executing” rule very similar to the “Slaughter rule” to raise the debt ceiling in 2005, Rep. Louise Slaughter — along with Rep. Nancy Pelosi and Rep. Henry Waxman — went to court to try to reverse it, arguing that it was a blatant violation of the Constitution’s procedure for passing legislation (art. I, sec. 7).
The bad news for present purposes is that they lost the case. The D.C. Circuit in Public Citizen v. U.S. District Court upheld the procedure. Upheld in this case does not mean endorsed. The Court did not say the self-executing rule was constitutional. It said it could not reach the question due to the standards of deference that apply between departments of government: If the presiding officers of both houses of Congress attest that their respective chambers have passed a piece of legislation, the Court is required to accept those representations as conclusive.
That doesn’t mean it is proper for government officials to execute a procedure that violates the Constitution, nor does it mean that a presiding officer should attest something that is not true. It does, however, suggest that it may be an uphill battle to get a court to declare the process null and void.
Mark is correct to point out that raising the debt ceiling is (regrettably) a routine, uncontroversial practice. Byron made a similar point yesterday in running down the handful of times the “self-executing” procedure has been followed. The key here is that in each instance, at issue was something that was non-controversial or almost ministerial — not, as with heathcare, an unpopular, bitterly opposed, ragingly controversial socialization of the private economy.
I think Democrats are mistaking a customary short-cut for a substantive precedent.
… Sure, we don’t make lawmakers dot every “i” and cross every “t” every time. But that doesn’t mean we’ve abandoned the right to make them play it by the book when it comes to a controversial matter. When there’s a real dispute, they have to pass the bill the regular, constitutionally mandated way: Both houses on the exact same text, with every legislator accountable for his vote.
If, instead, the legislative process becomes a farce that departs from the constitutional procedures we are entitled to enforce, then it no longer represents the consent of the governed. It is the first American principle that government derives its just powers only from the consent of the governed, and when it takes on a form that becomes destructive of the fundamental rights of the governed, it is no longer legitimate.

Update: Democrat Rep. Jason Altimire condemns his leaders’ “deem and pass” strategy:
A plan that would allow House Democrats to bypass a direct vote on the Senate’s healthcare bill is causing “discomfort,” a key centrist Democrat said Tuesday.
Rep. Jason Altmire (D-Pa.), a member of the Blue Dog and New Democrat Coalitions, said that the plan to pass the plan using the so-called “deem and pass” procedure is “wrong” and unpopular among his constituents.
There’s a lot of discomfort with the reconciliation process, the self-implementing rule, where you wouldn’t have a formal vote on maybe the most important policy of the past 40 years,” he said on Fox Business Network. “I have a big issue with the way they’re doing the process. I think it’s wrong and my constituents don’t like it.”
Altmire, a no vote on the House’s healthcare bill in November who is now undecided, is seen by many as critical to passage.

It seems that the Republicans have passed legislation in the moment, without thinking of precedent setting behavior, and left it to: Let The Devil Take The Hindmost.
I have been thinking a lot lately about that old saying.
“It’s every man for himself, and the Devil take the hindmost.”
I don’t think they are planning on fair elections anymore.
I think they are working every way they can to rig the playing field.

The founding fathers knew exactly what they were doing when they wrote the Constitution. They had seen this stuff before.
I think that it’s not so much that they’re too stupid to see the possibility, but rather that they’re gambling on a number of outcomes:
1. They’re gambling on the two great weaknesses of the American People today: a short attention span, and a short memory. By November, if there’s any good economic news, they think that all will be forgotten.
2. They’re gambling that even if Republicans/conservatives take back the majorities in Congress, that they won’t have the super-majority in the Senate required to roll back donkey-care.
3. They’re gambling that after a few years the American people will become even further infantilized by the nanny state, and will keep electing donks to majority status to “preserve” the “rights” that those nasty old Rethuglicans will try to take away.
Of the three gambles, #1 is relatively safe. So is #2: there are no “Gangs of Fourteen” when the donks are running the show, but there will be when the Republicans are. Gamble #3 will work until the whole federal government and many of the states go totally bankrupt.
That’s when the donks will make their move to sweep away the “old order” with a new, one-party state — and when the Second American Revolution begins.
The simple fact is about 80 to 90 percent of what the Federal Government does is UNCONSTITUTIONAL! We are so used to these clowns doing anything they want, any way the want, any time they want that we have been asleep at the voting booth for decades. Now, we wake up and find ourselves like that proverbial frog in the hot water….
This is insanity and I am not so sure it isn’t by design on the part of Obama et al….
Time and again, the Dem leaders keep finding new ways to amaze me with their chutzpah. I would just love to see one of the founding fathers rise from the grave to condemn these power-mad libbies!

It is unfortunate, but with an observation of current events, I must declare that if the House “deems” this legislation as “passed” without actually voting for the Senate version, then the legislative branch of our government becomes illegitimate.

They have never planned on fair elections. The only thing fair to them is they win. As long as I can remember they do everything possible, legal or not, to ge elected and stay in power from the local level on up. Its just got more blatent and open nationwide. They are working fast to entrench themselves in permanent power in DC.

My Congressman is Emanuel Cleaver .
Lock step Democrat. He’s just along for the ride, and certainly enjoys his ‘ride’ these days. Congress’s highest spender of tax payer money for his official car.
We once had more balance in our congressional district. It often flipped parties depending on the mood of the voters and how the candidates presented themselves. The district was redrawn to favor the dems back in the mid 90s when we had a GOP congressman. He was a moderate, but even he saw the writing on the wall and didn’t run for reelection. In no election since has the GOP candidate even come close. Even the state GOP considers my district too far gone to aggressively back any candidates but for a toket effort. Not that the CA GOP is anywhere near an effective organization as it needs to be.
All orders emanating from a “no longer legitimate” government would be considered unlawful. Our military would not be duty-bound to obey such orders. Hence the Oath Takers movement. The survival of our Constitution may someday rest on whether our men in uniform honor their oath “to defend the constitution against enemies foreign and domestic”.
This is so depressing. I think we have killed the bill and it just keeps coming back. I have never seen such focus on getting a bill passed. I understand why. They have majorities, they have wanted it for 50 years, they recognize they are so close and if they don’t get it, they may NEVER get it.
They are sacrificing their political careers. Uh..well Nancy isn’t. She will be reelected from that cesspool district no matter how looney she is.
They may need 216 but what amazes me is they still have 200 or so that will vote for it. Also, amazingly, no republicans will vote for it. There are also 60 in the Senate that will vote for it. That means that almost half of our elected reps will vote for this monstrosity no matter what the public says. They don’t even have a real bill. They are voting on a moving target.
Are they that stupid or so ideologically driven that they will damn the torpedoes and press full steam ahead? I know they think this is good for the people as far as health care is concerned? Do they think that bankrupting the country is not going to happen? Seriously?
By the way , where do they stop? If having health care is good, then how about free education, free housing, free transportation, free meals?
Doesn’t everyone deserve to have the exact same things in life? Why do I as a poor person have to take the bus when the rich zip by me in BMW’s? How is that fair? I don’t get that. 30 minutes seems way too short, and I don’t know enough about the “Senate amendments” to know why they are only asking for “the yeas and nays” on the Senate amendments, and not on the Senate bill itself.

I’d also like to make this point to liberals like my sister and brother-in-law and those sainted Dem constituencies who think they’re so precious that you can get something for nothing: Your entitlements will eventually bite you in the a$$. You will lose whatever “rights” you thought you had and those entitlements that you thought made you free.
I hate to break it to babyboomers out there like my mother: if we don’t create 100,000 new jobs each MONTH to keep pace with population growth, how do you think you will get your medicare, medicaid, and social security? They’re all going broke and I won’t shed tears for those too weak to take care of themselves.

We have also seen the compassionate euthanasia of the handicapped whose lives are deemed as useless to themselves and society at large (Terry Schiavo).
The utopian socialist does not value the individual and certainly nothing sacred. The world being built will by obama and his administration will look a lot like the failed socialist states of the past and, at best, the failing Euro-socialist states of the present.
I am not at all convinced that all this is not happening by design. It is pretty obvious that Obama and his Marxist friends don’t care about the “consent of the governed” or “limited and enumerated powers” or that pesky old document hideen away somewhere in the National Archives.

I’m not an expert on the rules, but I would guess that the rules themselves say that if you want to change the rules mid-stream, that requires a 2/3 vote.

To be a representative government, it must represent the will of the people. When the government is only representing the minority, then it no longer represents the people and can be deemed oppressive. It is at this point the constitution declares it is our duty to dispose of it and replace it with one that represents us.
This is not a call to action, but merely an observation to remind us this situation has been covered in our founding document, the constitution, and no amendment has removed its authority.

Thanks for putting the Slaughter Solution and reconciliation under perspective, Michelle (and Andy M., Mark T., and Byron Y.). I’m glad the Right concedes that the method has been used before yet makes the argument that it has never been used to pass such important, society-transforming legislation. Even with these explanations, I can’t get my head around it all.
The GOP in the House Rules Committee rebutted the Democrats’ memo with one of their own. The GOP refutes the amount of times this procedure has actually been used. The Democrats want people to think that “deem and pass” has been possible since 1933, where, according to what I’ve read, the procedure really came about after the Congressional Budget Act of 1974. I linked to that information on this site a couple of days ago, so to avoid repeating the link on someone else’s blog too many times, I won’t do it again.
Can we get some accurate, unbiased fact-checking and clarification on the matter? After my own reading, and after what the two memos tell us, I’m more confused than ever on the subject. There are far too many convoluted and contrary ideas on how to legislate with legitimacy, which is an indication of how supersized our government is and how much it needs to simplify itself.
The rhetoric I’m reading in comments by the Left (such as the kind I read in the CNN comments in the Jack Cafferty story Laree just provided) on this issue is “by any means necessary.” They’re not even hiding their insistence on using underhanded methods to pass the bill anymore. The unmitigated gall blows my mind. If one of those means is by perplexing the public on proper procedures (say that five times fast), mission accomplished. What’s not perplexing is that citizen confusion is exactly what they’re counting on to pass this piece of exquisite crapoleum.

For all of the talk from the “progressives” about G. W. Bush behaving as a dictator, this attempt to ram through Obama-Care without a vote, simply “deeming” it passed is as dictatorial as anything that has ever been resolved in our nation’s history. I mean, this is like the Nazi Reichstag passing a resolution from the office of the Reichschancellor himself, simply because Der Fuhrer wanted it passed.
The Democratic Party has ceased to exist as it used to be, although I suppose it could be argued that as it has evolved since the earliest days of the 20th Century, its becoming a totalitarian party was inevitable, and it will only get worse. If the GOP had any brains, they’d be heading as far away from ALL aspects of the DNC’s agenda as fast as they could.
