While you were sleeping: The Vampire Congress strikes again; Update: 2:43am Senate adjourns, parliamentarian ruling will send Wreckonciliation bill back to the House on “minor” GOP points of order; 2:16pm Eastern – Senate passes Wreckonciliation 56-43, Ds Nelson/Lincoln/Pryor vote no; Obama taunts GOP: Repeal? “Go for it”

By Michelle Malkin  •  March 25, 2010 01:18 AM

It ain’t over ’til it’s over…and it’s only just begun.

As you all know, I’m on semi-vacation with my family. It’s 10:00pm Pacific time and after putting everyone to bed, I decided to check in online and turn on the TV. I flipped through C-SPAN thinking I’d be able to catch up on re-runs of the day’s business…only to find the Senate still live and in session at 1:00am Eastern voting on Demcare amendments.

Yes, the Vampire Congress is back in business again — shirking the glare of daylight as it tables Republican motion after motion. A final vote on the wreckonciliation bill is expected at around 3:00-6:00am Eastern Thursday morning.

Here’s a list of some of the GOP amendments to the wreconciliation bill (click on link for more info):

* Senator Gregg: Protect Medicare Savings
* Senator McCain: Remove Sweetheart Deals
* Senator Crapo: No Tax Hikes for Families Earning Under $250,000
* Senator Enzi: Strike the Employer Mandate
* Senator Barrasso: Requires Legislation Not Increase Premiums
* Senator Grassley: Requires President, Congress Enroll in Exchange
* Senator Alexander: Reduce Student Loan Interest Rate
* Senator LeMieux: Members On Medicaid
* Senator Coburn: Bars Sex Offenders from Receiving E.D. Drugs
* Senator Hutchison: State Opt Out
* Senator Hatch: Block Medicare Advantage Cuts
* Senator Collins: Waive Employer Mandate Tax
* Senator Thune: Strike CLASS Act
* Senator Cornyn: Remove New Taxes on Investments
* Senator Hatch: Protect Wounded Soldiers from Medical Device Tax
* Senator Inhofe: Protect Pediatrics and Disabled from Medical Device Tax
* Senator Crapo: Protect Cancer Patients from Medical Device Tax
* Senators Roberts, Inhofe, Brown, Crapo: Strike Medical Device Tax
* Senator Burr: Tricare and Veterans Health Programs
* Senator Roberts: Rationing
* Senator Roberts: Critical Access Hospitals
* Senator Vitter: Repeals Democrats’ Health Care Bill

Go here for the roll call votes.

Among the more noteworthy votes taken so far:

Sen. Coburn’s attempt to bar Viagra for sex offenders was tabled by 57-42. Democrat Sens. Bayh and Nelson voted with the Republicans.

Sen. Vitter’s motion to repeal the Demcare takeover was tabled by 58-39.

The Hill is also up tonight covering the dwellers in darkness:

As of 11:30 p.m., the chamber had defeated 19 straight Republican proposals and adopted none.

There were no Democratic amendments proposed, and Majority Leader Harry Reid (D-Nev.) is under pressure to preserve the bill intact, which would prevent it from having to be sent back to the House. The House already approved the reconciliation bill in its session last weekend.

A spokesman for Reid’s office said instead of adjourning, the evening’s continuous voting has put the chamber within reach of a final vote in the wee hours of Thursday — possibly between 3 a.m. and 6 a.m. Although 20 hours of debate are normally required, Democrats surrendered their half of that time on Wednesday morning, and GOP leaders decided later in the day against a strategy of filing repeated amendments.

Democratic leaders are moving the bill through the Senate under special parliamentary rules, known as the reconciliation process, under which they only need to amass 51 votes, meaning they can afford to lose several members of their party. Senate Parliamentarian Alan Frumin, whose rulings were critical to the state of the bill, had not issued any rulings to adversely affect the bill as of 11:30 p.m.

I’ll update through the night. Stay tuned.

***

Update 2:10am Eastern. They are now voting on the Hutchison amendment to make permanent certain sales and marriage tax provisions that were set to expire. The amendment falls, 40-55.

Oh, dear. Al Franken has taken over as presiding officer.

Update 2:43am Eastern After tabling more GOP amendments, a pale, hoarse Harry Reid calls for adjournment. Befuddled Franken announces: “I guess we’re adjourned.” Official adjournment gaveled at 2:56am Eastern.

Andy Levy tweets in reply to my report on Reid’s grim appearance: “‘And I looked, and behold a pale hoarse Harry Reid.’ (Revelation 6:8)”

…And Hell followed with him.

After 10 hours, the Senate voted on 28 GOP amendments and rejected each and every one, including a Vitter amendment to spare mobile mammography units from punitive tax treatment.

Um, who’s the party of no now?

Also: Guess it’s the Dems now making womanhood a “pre-existing condition” again, eh, Nancy Pelosi?

Meantime, wire services are reporting that a Senate parliamentarian ruling agreeing with GOP points of order will send the Wreckonciliation bill back to the House.

The points of order deal with Pell Grant provisions that violate budget rules. More here. Dems are characterizing the points of order as “minor.”

Question: How “minor” is it?

It was initially unclear how much of a problem this posed for Democrats hoping to rush the bill to Obama and avoid further congressional votes on what has been a politically painful ordeal for the party. Democrats described the situation as a minor glitch, but did not rule out that Republicans might be able to remove additional sections of the bill.

The president, who signed the landmark legislation into law on Tuesday, was flying to Iowa later in the day for the first of many appearances he will make around the country before the fall congressional elections to sell his health care revamp.

So: “The time for talk” is not over.

***

Senate resumes at 9:45am. Roll call votes are expected to continue until 2:00pm.

Like I said: It ain’t over ’til it’s over…and it’s only just begun.

***

Update:2:16pm Eastern – Senate passes Wreckonciliation, Nelson/Lincoln vote no.

The only thing bipartisan was the opposition.

More: Obama taunts GOP: Repeal? “Go for it.”

To a large extant this is the same group of leftist scum we had to listen to then-arrogant, vulgar and rude. Pelosi and Reid are EXACTLY that kind.

This is all confusing on purpose. The new Obozo transparency.

The federal government needs a Constitutional Amendment on transparency and bribes. Like Florida finally did, when the Democrat backroom deals stunk so bad everybody in the State was getting nauseous.

The bill they are working on in the Senate is the reconciliation bill — It violates the Senates Byrd rule, but who cares as long as the useful idiots are told they get their freebies. What Obozo signed was the un-Constitutional bill where the taxes originated in the Senate not the House as required by the Constitution — Article 1 Section 7.

Stalin was the first to use the term “useful idiots” to define people like Obozo voters. He also used the phrase “peace, jobs and democracy” to describe his tyrannical Communist regime to the very same useful idiots. I think he hung signs saying same, right outside his Siberian gulags.

Why would you want to work? If you work you have to pay taxes, and by the time you pay your bills and health insurance you have nothing left anyway. If you don’t work Barry will pay your mortgage/rent, all your bills and give you free health care. Then all you need to pay for is your big screen TV and steal cable from your neighbor. Maybe you can just steal the TV too. Note that the “certain unalienable rights” are not limited. The founders said “…among these are life, liberty and the pursuit of happiness” implying of course that there many more – thus the entitlement mentality.

    Steyn – America’s Greek Tragedy
What’s happening in the developed world today isn’t so very hard to understand: The 20th century Bismarckian welfare state has run out of people to stick it to. In America, the feckless insatiable boobs in Washington, Sacramento, Albany and elsewhere are screwing over our kids and grandkids. In Europe, they’ve reached the next stage in social democratic evolution: There are no kids or grandkids to screw over. The United States has a fertility rate of around 2.1 – or just over two kids per couple. Greece has a fertility rate of about 1.3: 10 grandparents have six kids have four grandkids – i.e., the family tree is upside down. Demographers call 1.3 “lowest-low” fertility – the point from which no society has ever recovered. And, compared with Spain and Italy, Greece has the least-worst fertility rate in Mediterranean Europe.

Truth be told, our Greek Tragedy is already upon us vis a vis Social Security, Medicare and Medicaid. We all knew this would crash and burn when us Baby Boomers hit retirement, but there is no politition (left or right) who will adress this if he has any desire for re-election. So the thing to do is pour more fuel on the fire? God help us. Washington won’t.

I’m NOT a moonbat (and I don’t play one on the ‘net) nor do I agree with the rejection of the amendment, but I’m going to “guess” that the issue is that the amendment was bundled together as:
To reduce the cost of providing federally funded prescription drugs by eliminating fraudulent payments and prohibiting coverage of Vi#gra for child molesters and rapists and for drugs intended to induce abortion.

MUST protect, AT ALL COSTS the “right” of women to induce abortion.

To be clear, I prefer the amendment as written, but I’d like to see if the amendment would pass if that was out of the bill and if the same jokers who rejected the amendment would STILL reject it.

I continue to be unable to explain O’Reilly’s ratings. Doesn’t no one actually listen to what he says and how he says it? Does no one bother to consider he embraced Geraldo and dumped MM?

The “right” isn’t going off any rails. The media is trying to make folks think the right is going off its rails. That is what the media does.

The result will be an increase of the proper and appropriate anger folks have about how our Congress and President are ignoring the people and the Constitution. And you will see NO blame directed toward the Congress, the President and the media of course. But the fault lies with those three sources, not with the people.

People have the right to and are appropriate in their anger.

No, last night the Senate Republicans just provided themselves with a treasure trove of things to club their Democrat opponents with in the fall.

Most of their proposed amendments were based on the promises Obmama and the Democrats made regarding what would be in the bill.

Grassley, submitted an amendment to ensure the Congress and President and their staffs were not exempt from Obamacare. Voted down by the Democrats on a party line vote.

The GOP tried to restrict pedophiles from getting erectile dysfuntion drugs. Voted down by the Democrats on a party line vote.

Last night the integrity of the Democrats was put on full display and with that they slipped their necks into the noose.

    Well done GOP Senators.

Should the Republicans ‘go for it’ they should consider replacing their leadership which did not serve them, or the Nation, well.

Boehner, Cantor, McConnell, and Jim ‘Waterloo’ DeMint should be compelled to step down. In going for it, better tactics and a new approach will be necessary. ‘Repeal’ is just lip service to solicit an emotional response. Not very practical. Emotions are important, but useful practicality is far more useful.

To get to the position to actually ‘repeal’ will require getting enough new members elected (in the House and Senate) to overcome a veto. Not impossible, but how likely is that to happen? Yes, it is possible to build a highway to Hawaii, but how likely is that to happen? And, then it may require defeating Pres Obama, if he elects to run again.

Boehner, Cantor, McConnell and Jim ‘Waterloo’ Demint have met their Wellington and von Blucher. Time for some new leaders with some new ideas that stand a chance to succeed.

The new strategy may require less the solicitation of emotion and far more conversation, negotiation and practicality. Heck, let the States Attorneys General deal with it.

The healthcare bill is terriffically flawed and requires some serious tweaking. Maybe it might be better to get the bill to a better place, for the Nation, than doing the same things that have failed?

Throwing down a gauntlet failed. Waterloo? Whose Waterloo was it?

    That is not the case.

Wrong. I do not believe the fight is over. I believe new leaders with a realistic way to approach the situation are necessary.

Did you happen to notice that I said the States Attorney Generals should ‘go for it’?

When your Generals (Boehner, Cantor, McConnell and Jim ‘Waterloo’ DeMint) fail, you replace them with someone with new ideas and a new approach that has a greater chance of succeeding.

Advancing amendment after amendment after amendment with no chance of success is futile and a waste of time. These amendments only serve to solicit emotion and talking points for future campaigns. That is called lip service. I prefer a more substantiave approach that has a realistic opportunity for success.

A leader with less ego who is prepared to cheer on the Attorneys General from the States that are Constitutionally challenging the bill would be a good start. Get the Waterloo losers from out front, and put someone in there who will be more effective.

What do you think has a greater chance of success, repeal with all the bumps in the road it has to overcome, the Attorneys Generals, tweaking the bill, or repeating what has already failed?

Mind you, repeating a failure and expecting a different outcome is the definition of insanity.

New leaders, new strategy and a different outcome. Go for that.

    1) Give full support to the AG’s legal effort, even though it’s odds are slim.

    2) Campaign against the new law based on its REAL cost, its pocketbook impact, the disintegration of care, and its unfair protection of government workers, unions etc.

    3) Seize at least one house of Congresss in 2010, likely The House. Both would be great.

    4) Defund the heinous parts of the bill under the banner of controlling spending and saving Medicare. Pacakage it with needed spending and dare the President to veto it.

    5) Use your majority to launch investigations into Democrat corruption, illegal activities and root out the radicals. Hit the Dems and Obama from every point on the compass. Seize the initiative.

    6) Be absolutely truthful with the people. Give them the facts.

Repeal is akin to Patrick Henry saying :

Tweak is akin to Percy B. RINO saying:

“Give me a tad more liberty,or let me have the influenza.”
