2nd Circuit restores ACORN funding ban

Connie Hair at Human Events has the news:
The U.S. Court of Appeals for the Second Circuit has issued a stay on the December 2009 injunction by Clinton-appointed Judge Nina Gershon that declared the Association of Community Organizers for Reform Now (ACORN) funding ban was unconstitutional.
The result of the stay is that the Congressional funding ban will go back into effect, and ACORN will not receive taxpayer dollars while the court reviews the case.
“I applaud the Court of Appeals for immediately addressing the effects of Judge Gershon’s attempt to legislate from the bench,” said Rep. Darrell Issa (R-Calif), top Republican on the House Committee on Oversight and Government Reform. “Today’s action immediately restores the congressionally mandated ban on funding ACORN and its affiliates as a result of their criminal conduct and wasting of taxpayer dollars. Congress does have the constitutional right to deny an organization the benefit of taxpayer dollars.”
In related news, ACORN’s Bertha Lewis proclaims the resurrection of the community organizing racket and Matthew Vadum reports that the “dissolved” ACORN is still grubbing for money from donors.

The Federal Government can cancel any deal it makes, it’s only the penalty they must pay. I know we did a lot of government contracting, they had specific cancellation rules.
Now, to defund SEIU…..
Acorn will just ignore all laws and do what they want to do. Kinda like illegal immigrants do.
Thankfully, this did not go before the 9th Circuit.
Perhaps Cardinal Mahony in Los Angeles can become the protector of Acorn, just like the illegals and migrant workers.

I have a feeling that it is just a ‘branch’ of the seiu. The seiu is like acorn, there are so many ‘branches’ it is almost impossible to track them all down. That is their intent! I hope your governor signs the bill, btw.

And HB 2441, the one requiring Presidential Candidates to provide documentation proving they are Constitutionally eligible to the office.
The bill appears to leave interpretation up to the Secretary of State. I think they should have defined “natural born citizen” within the bill. I would love to see a lawsuit over the definition make it to the SCOTUS!
Regardless, if this bill becomes law, Obummer will suddenly decide he has done all he can do in one term.

I think Congress will eventually pass a resolution defining “natural born citizen”, but with a grandfather clause stipulating that all those previously elected to the office are eligible.

I always ask the liberals, “Name me one successful socialist country.”
They seem to like France and Sweden, though I have gotten Australia and even got China, on one occasion. Of course, when you give them those outstanding examples of socialist utopia like, North Korea, Cambodia, Hitler’s Germany, the USSR, Zimbabwe, they just say it’s not the fault of the type of government. My response is, “Then why do all of the murdering b@stard dictators flock to to socialism like moths to a light?”
And they never seem to be able to answer why socialist East Germany was very eager to join free West Germany when they re-unified. Why wasn’t it the other way around? Hmmm?

After hearing of this I rushed over to DU to see how the DUmmies were taking the news. Not a peep. Either they are keeping with their habit of not discussing bad news, or it is too poppin’ fresh.
The religion Marx chose was Darwinism. It gave him his ideas about revolution being a substitute for “survival of the fittest.” Marx saw the struggle between the different classes. Hitler chose Darwinism as well and believed the struggle (Mein Kampf = My Struggle) was between the races.
Jonah Goldberg, in his book Liberal Fascism, believes that fascism is not a type of government but a form of religion for secular socialist governments. Read the book.

The courts in this country are suffering from the same affliction as the rest of the nation . . . they are rotting from the core.
TooMuchTime – Good points, and it is a given that a “religion” does not necessarily include God. Secular Humanism was and is all the rage in the progressive mindset. I think Hitler, though, held a rather warped theology – that he had some sort of divine mandate to be the liberator and leader destined to bring the Aryan race to it’s “proper” place as the dominant world race. He applied Darwinism insofar as it demonstrated his theory that Aryans are the highest evolved humans, but that this was divinely ordained – i.e. natural selection brought Aryans to the pinnicle of evolution because that was God’s will. Or something. The man was deeply warped in so many ways his exact worldview is difficult to nail down.
Flyoverman – Great article and very interesting site. I bookmarked it for reference. I’ll concede Marxist victimization and liberation are at the heart of Liberation Theology, but still see a key difference between LT and Marxism. Marx keyed on dialectic reason that capitolism and resultant “upper class” had to be destroyed by proletariat revolution – dissolution of “private property” etc. Liberation Theology sees Jesus as the quintessential oppressed revolutionary and that race, rather than economic class is the key issue.
If Marx were around today, I have to think he would reject LT based on its claim of divine intervention in the race (class) struggle for equality – and moreover, Wright et al don’t seem to have a problem with capitalism, as long as it is blacks that are cashing in. (He seems to like his suburban mansion) Black LT seems more interested in reversing class (racial) roles than pursuing the fundamental Marxist ideal of eliminating class entirely.
How do the rest of us shop for a judge who’s default presumption is that Fedzilla owes us money???
