2nd Circuit restores ACORN funding ban

Connie Hair at Human Events has the news:

The U.S. Court of Appeals for the Second Circuit has issued a stay on the December 2009 injunction by Clinton-appointed Judge Nina Gershon that declared the Association of Community Organizers for Reform Now (ACORN) funding ban was unconstitutional.

The result of the stay is that the Congressional funding ban will go back into effect, and ACORN will not receive taxpayer dollars while the court reviews the case.

“I applaud the Court of Appeals for immediately addressing the effects of Judge Gershon’s attempt to legislate from the bench,” said Rep. Darrell Issa (R-Calif), top Republican on the House Committee on Oversight and Government Reform. “Today’s action immediately restores the congressionally mandated ban on funding ACORN and its affiliates as a result of their criminal conduct and wasting of taxpayer dollars. Congress does have the constitutional right to deny an organization the benefit of taxpayer dollars.”

In related news, ACORN’s Bertha Lewis proclaims the resurrection of the community organizing racket and Matthew Vadum reports that the “dissolved” ACORN is still grubbing for money from donors.

    And HB 2441, the one requiring Presidential Candidates to provide documentation proving they are Constitutionally eligible to the office.

    The bill appears to leave interpretation up to the Secretary of State. I think they should have defined “natural born citizen” within the bill. I would love to see a lawsuit over the definition make it to the SCOTUS!

    Regardless, if this bill becomes law, Obummer will suddenly decide he has done all he can do in one term.

    I wonder about this too. If at some point it is proven that he was not eligible to be President, what happens to the laws he signed?

    Flyoverman – Great article and very interesting site. I bookmarked it for reference. I’ll concede Marxist victimization and liberation are at the heart of Liberation Theology, but still see a key difference between LT and Marxism. Marx keyed on dialectic reason that capitolism and resultant “upper class” had to be destroyed by proletariat revolution – dissolution of “private property” etc. Liberation Theology sees Jesus as the quintessential oppressed revolutionary and that race, rather than economic class is the key issue.

    If Marx were around today, I have to think he would reject LT based on its claim of divine intervention in the race (class) struggle for equality – and moreover, Wright et al don’t seem to have a problem with capitalism, as long as it is blacks that are cashing in. (He seems to like his suburban mansion) Black LT seems more interested in reversing class (racial) roles than pursuing the fundamental Marxist ideal of eliminating class entirely.
