Another deportation abyss horror story, more ICE non-enforcement

By Michelle Malkin  •  May 24, 2010 04:11 AM

Catch, release, repeat.

Seems like I just wrote about our busted deportation system a week ago. And then again a few days ago.

And now this:

The KING 5 Investigators have learned that an illegal immigrant accused of raping a woman in Edmonds Sunday has been deported nine times. That’s much more than previously reported.

Immigrations and Customs Enforcement won’t comment on the case of Jose Lopez Madrigal. But KING 5 got the information through confidential sources and documents.

Larry Klein was the man who heard the alleged victim’s cries for help.

…Klein called police, who quickly arrested the suspect. But learning his identity took much longer because of some 30 aliases. It was only through fingerprints that they identified him as Madrigal, a Mexican citizen.

Madrigal’s arrest and immigration record includes a staggering number of contacts with law enforcement since 1989. That’s the year he was convicted of theft using a firearm in California. He was deported a couple of times after that. Then in 1999, he was arrested for drug sales in both San Diego and San Francisco. Records show that he was deported three times that year between April and August. He was arrested for drugs again in Stockton, Calif. in 2000. In 2002, he pleaded to third degree sexual assault in Denver. Later that year, he was deported again. And in 2003, records show he was deported three more times.

People who live near the scene of Sunday’s alleged rape wonder how it could keep happening.

How could it keep happening? Duh. Catch-and-release remains the order of the day. (See here, here, here, and here, for example). And as every savvy immigration lawyer who has gamed the deportation abyss knows:

“It ain’t over ’til the alien wins.”

Jihadists know it.

The open-borders racket knows it.

Prosecutors know it.

And the Obama administration knows it.

ICE chief John Morton’s suggestion that the feds may refuse to process illegal aliens reported by the state of Arizona is simply a validation of the feds’ longstanding policy of selective, politicized non-enforcement.

For further proof, take a look at the little-noticed ICE website unveiled last week with new policy changes and summaries of the major “detention reforms and accomplishments of the last year.” Click on the link and you’ll find that five of the seven new policies that Morton touts as “accomplishments” involve not enforcing immigration law by making it harder to arrest them, catching-and-releasing them, or creating new loopholes for avoiding detention and deportation.

What part of Article IV, Section IV of the U.S. Constitution don’t these people understand?

The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.

The sixty four million dollar question is without the Mexican gubmints willingness to keep it’s citizens in Mexico, we can deport until hell freezes over and they will keep coming back and robbing, raping, and pillaging. Why is it that we describe police as profiling when they are in HIGH CRIME areas, aka black and brown ghettos, and arrest criminals? This is reminiscent of the old quip from the bank robber “why do you keep robbing banks? Because that’s where the money is.” Why do the police patrol our minority ghettos heavily, because that’s where the crime is! Al Sharpton met in Chicago at the little girl’s funeral, but the question is, did the federales FIND the murder suspect they were looking for in the apartment. If so, then the people in the apartment are to blame for letting a murderer into their home. To me it’s the same in Afghanistan, you live with the taliban, you are the taliban and you are the enemy.

The women who are raped, the people killed, robbed, homes and jobs destroyed will just have to realized it is a cultural thing. Sadly that Cultural Thing is more Yanqui than Mexican; Jose Lopez Madriga would not do well doing this in Mexico.

That is the fence along the DMZ in Korea. The North has a similar fence on their side with mines etc. in the middle of the DMZ.

In terms of breaching the fence, a fence is an obstacle. In the military you are taught that all obstacles must be covered by observation and/or fire. Besides the fence you can be assured there are other anti-instrusion devices to include UGS (unattended ground sensors, cameras, motion detectors, as well as humans in observation posts.

The North Korean response to this fence has been to tunel under it.

Patton was referring to the West Wall. However, his observation was incorrect IMHO. Look at Verdun, WWI’s western front in general, Vicksburg, Leningrad, etc. If the fortification is taken at all, it is hugely costly to take if one cannot bypass or besiege it.

However, the invasion we are suffering from is not principly a military one. That our government, a supposed “superpower”, can’t defend its own borders or are unwilling to is an outrage.

Patton was particularly wrong about fixed fortifications. Review his campaign in Alsace-Lorraine in the autumn of 1944. It took him weeks and thousands of casualties to take the fortifications around Metz and those were pretty old forts by 1944.

But the problem isn’t that we can’t protect our borders. The central government refuses to protect the borders and they actively work to prevent others from doing so to!

This is the point I was making – perhaps Patton was not the right analogy – though a case could be made that recent weapons technology has made it more valid. Still, a fence with no resolve to enforce it is not the answer.

I learned a tough lesson in second grade. When you draw a line in the sand and double-dare someone to cross it – you’d better be willing and able to make it stick. Better?

Our politicians are still relying on “messaging” in lieu of taking coherent stands on specific principles. For instance, what ever happened to “Repeal Obamacare!”? Did it not bother anyone that Paul Ryan himself equivocated the very next day after vowing to see it repealed? The move died that day. Yet today’s polls tell us that 64% of Americans want to see it repealed.
