House moves to repeal Obamacare individual mandate; Update: Measure fails, 187-230

Republicans in the U.S. House of Representatives have just announced they will move to force a vote in the next 24 hours on legislation to repeal the unconstitutional “individual mandate” at the heart of President Obama’s job-killing health care law. Americans can go to this link on the America Speaking Out website starting NOW to read about the idea, vote on it, start a discussion, and share their ideas. The GOP legislation, offered by Rep. Dave Camp (R-MI), is a first step to repealing ObamaCare and replacing it with common-sense reforms that will lower health care costs and protect freedom.
GOP leader John Boehner adds:
House Republicans plan to force a vote as soon as today on a measure that would repeal the job-killing, unconstitutional ‘individual mandate’ at the heart of ObamaCare. This proposal, to be offered by House Ways & Means Committee Ranking Member Dave Camp (R-MI), will be offered as the Republican motion-to-recommit on H.R. 5486, the so-called Small Business Jobs Tax Relief Act of 2010.
Rep. Camp’s idea has been posted here on the America Speaking Out website, and Americans are urged to visit, read about the proposal, and share their ideas. House Republican Leader John Boehner (R-OH) voiced strong support for this effort to strike at the heart of ObamaCare:
“House Republicans will force a vote to end the job-killing ‘individual mandate’ at the heart of ObamaCare during the debate on the small business deficit spending bill. We’ll highlight our effort using the ‘America Speaking Out’ website to call attention to what will be, literally, the biggest vote on the new health care law since it passed. This is a first step in Republicans’ efforts to repeal ObamaCare and replace it with commonsense, step-by-step reforms to lower costs.”
This move comes one day after the new health care law experienced its latest setback, this time in the form of new job-killing mandates that flatly contradict President Obama’s now-infamous ‘if you like it, you can keep it’ pledge. The coverage controversy is the latest in a growing list of broken promises that have solidified the American people’s opposition to this job-killing health care law:
“If You Like Your Health Care Plan” … Too Bad. In stark contrast to President Obama’s oft-stated pledge that, “If you like your health care plan, you can keep your health care plan,” his administration yesterday issued new job-killing mandates that will force a majority of the nation’s employers – including as many as four out of every five small businesses – to change or drop their coverage as the government sees fit. Even the Administration acknowledged its reversal, allowing “that some people, especially those who work at smaller businesses, might face significant changes in the terms of their coverage.”
ObamaCare Will Increase Costs, Not Lower Them As Promised. Despite President Obama’s claim that his health care plan would “slow the growth of health care costs for our families, our businesses, and our government,” analyses by both the non-partisan Congressional Budget Office and the Obama Administration’s Medicare actuary have confirmed that the new health care law will actually raise health care costs by $311 billion over 10 years.
ObamaCare Forces Millions of Seniors Off Medicare Coverage. Last week, President Obama re-launched his health care plan by promoting Medicare rebate checks that more than nine in 10 Medicare beneficiaries will never receive. An analysis conducted by the President’s own Medicare actuary indicates that the new health care law includes roughly $575 billion in Medicare cuts, which will be used to fund the creation of a massive new entitlement program. As a result of these cuts, enrollment in the popular Medicare Advantage program will be slashed in half.
ObamaCare Is Anti-Small Business. In April, Obama sought to reassure “jittery” small business owners by touting a health care tax credit in the ObamaCare bill that he claimed was “pro-jobs” and “pro-business.” But according to the National Federation of Independent Businesses (NFIB) – which joined 20 states in a lawsuit challenging the constitutionality of ObamaCare – the tax credit the Administration cites “will do little to nothing to make purchasing insurance more affordable for small firms.” According to the NFIB, only 12 percent of small businesses would benefit in any way, and the credit goes away after a short period of time.
President Obama has tried to deflect attention away from these broken promises with another tireless taxpayer-funded PR campaign, but the American people have spoken – again. Republicans are listening, and advancing this effort to repeal ObamaCare and replace it with commonsense, step-by-step reforms to lower costs and protect American jobs.

Why are they doing this now? The result was predictable and inevitable – making it a hollow circus. They need to do this when they have a majority.

Congressional Republicans thinking? Wow, that’s a trip down memory lane!
Maybe Boehner can provide more pro-BP comments for the left to distort so they won’t get a majority in 2010 or 2012.
Perhaps to get vulnerable Democrats on record for the upcoming elections. Obamacare is not a popular program and support for it can be beat like a drum.

Michelle, has Boehner explained the timing of this? I can understand wanting to get the members of the Socialist Democrat Workers Party on the record supporting Obamacare but, to me, this seems like an exercise in futility… We already know who we are not voting for.
That’s the only thing I can think of, but it seems redundant and pointless, no? It had no possibility of passing and the liberocritters already voted for BarryCare – now they need them on record for not repealing it? This makes no sense to me. Can a confused wingnut get some help?
Look on the positive side, if they are spending time on this legislation, even if you think it futile, they are not spending money we do not have for socialist programs.
Personally, I think it was a splendid idea.
It put the Deemocrats on record…AGAIN…following the revelations of the lies told by them and their Obamic leaders about what ObamaCare would and would not do.

SpeakEasy has it right. Since it is Obama who lied about so many features of Obamacare, those who voted for it the first time can try to weasel out by claiming that what is happening is not what they voted for. Now they’ve been forced to vote again so they have no wiggle room.
It’s not about timing. It’s about pinning down your opponent.
Of course it was, and they should continue to push this kind of initiative every time they get a chance from now until the election.
I think the GOP needs to raise this issue every month until the November elections. We need to remind every person in America of the unconstitutional nature of this bill and rub their faces in it, every chance we have until election day!
I want people to remember that Obamacare is going to cost them a fortune and provide them with substandard medical services if they can get any treatment at all!
Yes, we do, but a lot of people haven’t been paying that much attention, don’t read this blog and really haven’t made up their minds yet.
Not only do votes like these remind everyone of the radical Democrat Agenda (in case everyone hasn’t noticed there is still a large portion of the American people who still don’t “get it”) but also this vote just exposed all those much touted “Blue Dog” Democrats for what they really are: Lying Two-faced Politicians

We close and informed followers of the issue are not going to forget, but I was already getting concerned that the American public was starting to lose the sense of outrage over NobamaCare. Anything that can be done to keep it at the forefront is a good thing. Keeping people up to speed on this issue and reminding them what an outrage it is, will decrease the number of “useful idiots” (i.e. the uninformed, misinformed) the socialist/democrats can count on in November.
On another note, can you believe Nobama is going to use the BP spill to try to push cap and tax tonight, when Al Gore’s “Global Warming”, now known as “Climate Change”, has been exposed for the fraud it is. Sometimes, I feel like I am in the twilight zone here. How did we get to the point where everything right in the world is wrong, and everything wrong in the world is right? I’m a grown up and there are certainly no guarantees in life, but I really worry about my kids. We need another Reagan, and fast.

BTW – does anyone know what the status is of the constitutional challenges to the public mandate? As I recall about 14 states attorney generals were challenging it on constitutional grounds.

I’m glad to see the Republicans doing this. If they should take control of the House following the November elections, I hope they keep doing it. Of course, Obama would veto any attempt to repeal Obamacare, but if the Republicans are serious, then the next step would be to defund the agencies associated with Obamacare.
Personally, I feel that the passage of Obamacare has dragged the economy down, and were it to be repealed, I believe the economy would rebound sooner and with more strength.
If the Republicans keep bring it to a vote, it turns the tables on the dems. they have to fight to stop the amendment every time and we only have to get it right once. it is the same strategy they used on us.
That’s the route I think they’ll take. Death by starvation. It will be fairly easy to defund the monster piece by piece when there is no money there to fund it anyway. And I don’t see how the public mandate will pass the constitutional test.
If not, down the road an interesting result of the Dems using reconcilliation is the Byrd rule kicks in. After 10 years, the legislation becomes void, unless re established and refunded with money they won’t have. This is why the Bush tax cuts are expiring soon. They had to use reconciliation to get them through.
One way or another this monster will die. It’s to big not to fail.
the downside is that if we win the repeal of the mandate, then most of the lawsuits that would have eliminated it will have their cases cut off at the knees.
Southpaw, just make sure and do it where you have a CHL so you can blow their arse away when they refuse to let go of you. And the beauty is it’ll be on video to be used in your defense at your trial.
People have short memories. A little refresher is nice and I expect this isn’t the last one we’ll see.

This was plain STUPID.
Without the mandate (which won’t pass muster in the courts), the rest of the health care bill will result in the BK of private companies, paving the path to single payer Medicare for all with gold bricks. It’s the endgame in this whole health care reform bill. Plain and simple.
To my way of thinking, there was no excuse for voting for a bill with the individual mandate in it, period, but some of those voting for it might have claimed there were other parts of the bill making up for it and they didn’t really like that part. This was just about the individual mandate, right? So this vote could potentially be used against that particular dodge. The Obamacare supporters may be put in the position of having to not just defend yet another well-intentioned huge spending program, but to try to defend the most blatantly offensive and most clearly unprecedented part of the bill. It’s no longer about reaching out to the poor-it’s about requiring YOU to buy a product with your money so the administration can claim the bill “covered” you and stick you in their propaganda numbers.
Personally, glad to see fight in the Repubs..my concern is what does Odopo and his pals have up their sleeves for Nov. You just know they have to have a nasty, ugly kettle brewing somewhere in an effort to sabotage the elections. Their up to something, and it ain’t good for freedom lovers of America.

IMHO, I think this stunt was to help cover some vulnerable congressmen and a nice feel good thing for the Republicans. Seriously, do you think they will ever repeal this monstrosity even if the Republicans get power in Congress again?
I honestly believe that both parties will not do what is right for the country or obey the Constitution no matter what rhetoric they spew.
The only way out of this is to remove the incumbents from office, no matter what party they belong to. And, to elect non-politicians to Congress.
Looking forward to a November To Remember
I can think of two good reasons to do this now…
1. While they’re focused on stuff like this the Democrats aren’t doing anything else to dismantle the country.
2. It’s a good way to remind the people that the Democrats don’t have any remorse or second thoughts about Obamacare.
Certainly a noble effort, and the repeal of the prescription drug plan should also be repealed. That would be a start at addressing what is not in the Constitution.
After those items are repealed then working on the repeal of Social Security, Medicare and Medicaid should be next.

Don’t be too harsh in criticizing the vote pushed by the Republicans. This is a good way of showing up the Dems. Besides taking up time and preventing the Democrats from floating any other bill (and we all know anything they propose is bound to be detrimental to taxpayers), this shows Republicans are solid! At any rate, Queen Nancy was unable to table the issue. A vote was actually allowed to be taken, albeit Pelosi, herself, refrained from voting..
Everybody, take a good look at the Democrats on the ‘Nay’ side. Remember their names. They have to be ousted in November. Cong. Etheridge, and the rest of them should know that their days are numbered.

My first thought was “Exercise in Futility,” but on further reflection I have to agree with those who have seen the tactical value of such a move.
1. Force the the donks to hug the Tar Baby. Don’t let them try to weasel their way out of what they’ve done.
2. Put the R’s on record early on as to what’s going to be on the agenda five months from now, when the gavel is wrested from that Botox-induced brain-addled Nancy Pelosi’s grasp.
Overall a good gambit that should be repeated at least two or three more times before November.

More votes like that! How about an amendment demanding that unspent “stimulus” funds go to deficit reduction?
I think this was an excellent idea. With all the little revelations about the unintended side-effects, some of the Dems might be able to claim that they wouldn’t have voted for it if they had known about X. Get them on record for opposing repeal and that takes away another excuse.
The ultimate question is whether Republicans have the stomach to do a lot of this come January 2011. Gingrich’s Contract with America was a recognition that most Americans were really angered by runaway government – and it is even worse this time. I am for repeal and replace to clearly show the difference between the big government socialists and the free market constitutional capitalists.
