Justice Dept. Confirms Lawsuit Against Arizona, Ecuador Just Nods and Says ‘We Know’

By way of Right Scoop, now that Hillary Clinton got the diplomatic formality of notifying Ecuador out of the way, Arizona and the rest of America can be told that the Obama Justice Department will file suit against Arizona’s immigration law:
Now a senior administration official tells CBS News that the federal government will indeed formally challenge the law when Justice Department lawyers are finished building the case. The official said Justice is still working on building the case.
At least maybe now Eric Holder will have to read the law in order to prepare his case, but I’m not totally counting on it.
Jan Brewer has vowed to fight any suit over the law. The first thing Arizona should do is use the $1.25 million federal grant they got for building a “Squirrel Bridge to Nowhere” and instead put it toward fighting the lawsuit.
You can’t help but wonder what the cost to taxpayers of this lawsuit will be, and how much fencing and additional border security the money could have paid for. Then again, if the Obama administration gave a damn about border security, drug smuggling and illegal aliens in general (known to the DNC as “potential voters”), they wouldn’t be filing the lawsuit in the first place.
President Obama had told Arizona Governor Brewer that he’d notify her within two weeks of their meeting about her request for National Guard troops at the border. The two weeks were up on Wednesday and Brewer heard back nothing. Brewer said that was “unacceptable,” but if she thought that was unacceptable, just wait until Obama sends in the National Guard, but only to deliver her court summons:

Update: Arizona’s Attorney General says he won’t defend the state’s immigration law against the Federal lawsuit. The Attorney General is a Democrat and a gubernatorial candidate, so this isn’t really a shocker — who are we to expect the worm to actually do his job?
Update II: “Squirrel bridge” project cancelled. It’s on!

This headline is misleading.
There is still a difference between filing a case and claiming a case will be filed.
Obama having abdicated responsibility on both the border and the gulf I think it is about time IMPEACHMENT proceedings should be initiated.

How sad is it that Gov. Brewer has to use taxpayer dollars to hire outside counsel because Arizona’s own Attorney General won’t defend a duly enacted law from his own Legislature?
When exactly did we get to the place where politicians can refuse to enforce laws they don’t like? Was it the ’60′s? 70′s? It’s utterly baffling to me. I assume the AG’s oath of office would have said something to the effect of “swearing to uphold the laws” and “defend the Constitution” or something similar. How can he violate his oath but still keep his job?

Hmmm. Maybe Arizona need to find out who’s building the squirrel bridges. If they can make it so specific squirrels can pass, but not others and protect them from predators, then maybe we need those people designing the border fence.
Another interesting thought. Maybe AZ could build their own border fence. Is that possible?

Maybe Arizona should open radioactive waste storage sites along the border and widely advertise (in various languages) the dangers of approaching these sites. Arizona could probably solve the border intrusion problem and at the same time rack up billions in storage fees for doing something nobody else wants to touch.
The author of the legislation should just say he’s a member of the NBPP, and the suit will be dropped.

Notice, too, from where the majority of LEGAL immigrants and refugees come thanks to the progressives that operate the State Dept. Typically, they come from third world nations run by governments the Dems want to emulate. Too many of the LEGAL immigrants we get are ill educated about our political system, don’t understand the basic differeces between parties (not that leadership in the GOP is at all helpful).
Our newly arrived immigrants, over the last 20-30 years, are often used to the corrupt style of government the Dems provide and either support it or are just resigned to live with it and don’t believe they can make a difference. Just the sort of LEGAL immigrants the Dems want as well to keep them politically entrenched.
It’s likely the expense is too great, but they could always send Obama the bill.
But I have another idea.
All prisons in the US can be lined up contiguously along the southern border. Use the prisons as a fence. Imposing barrier and 24 x 7 x 365 guards.
That’s a good point. I don’t know the stats, and there are likely some factors driving immigration from these place….ie, they suck…but State determines the figures.
State. There’s another bureaucracy that needs to be abolished.
Maybe not armchair patriotism, but ARMED patriotism, now that’s a different story.
I doubt we are operating as a republic and certainly not one that is anything like the founders envisioned and recorded for posterity in the Constitution. It appears to me that we are operating as some combination of a socialist and fascist state with an administration that is unencumbered by anything remotely resembling the rule of law.

I read somewhere in the past that the State Dept. progressives, at least since the ’70s changed its policy from the preferrece of more highly educated immigrants who emulated western civilization and culture and who were expected to adapt our way of life, to the preference of those who emulate everything BUT and to ENCOURAGE and SUPPORT them to continue to retain the culture and language of the nations they left as US citizens. The ideal goal is to make the USA a nation where no cultural or ethnic group is more powerful or influencial as another.
The intent of our

The federal gov’t is going to have to explain just how the AZ law is violating federal immigration authority. With the prior approval from the 9th Circuit (hardly a bastion of conservative thought) there is precedent for AZ to win the case.
Another important quote from the article is — …and Congress has not displaced all state laws from the field… — California still has laws that discourage illegal immigration and as long as one other state has them, the AZ law will stand.

Can anyone with law experience answer this question: Since the federal government is charged with defending our country from invasion and we, the taxpayers, pay them for the service, do we have standing to file a lawsuit? Breach of contract? Dereliction of duty? Would we be well within our rights to discontinue payment since no service is being provided? I am fed up.

As to your last question, I think you do have a right to withhold support. You are not the subject of a sovereign. Government derives its powers to act from you and I, and that implies that we can withdraw our consent.

My understanding was that Gov. Brewer dosn’t want the AG to defend in the lawsuit because she knows he hates the law and would therefore have a conflict of interest (or just do a lousey job defending it).
I wonder how far the $1.25 million would go to provide a small chain-link fence with little signs saying “¡El campo de minas guarda hacia fuera!” followed by an anti-vehicular minefield, an anti-vehicular ditch, then an anti-personnel minefield followed by another cheap chain-link fence with little signs saying, “Mine Field. Keep Out!” Then give the Border Agents a UAV capability to provide overwatch, perhaps using National Guard or Reserve units who can brush up on their flying skills.

Our country is being invaded from the south, and we are basically losing more and more land to them every day as the government “protects the citizens” by marking of more and more land as “no entry”.
We have an oil rig that exploded, weeks ago, and a president and administration that are doing everything they can to stall efforts to protect the coastal areas and cap the hole, because they gain political advantage by doing so.
Michelle has blogged the various and growing examples of how conservatives are the only ones who are expected to obey the law, and the only ones punished for breaking it.
It has been documented clearly how minorities are the only ones who have rights in this country.
And so far, the conservatives and the “tea party” can’t find any one person who can step out to the front and lead them in the slightest direction.
*You* tell me what the point is. Because I sure as hell would like to know what this mythical solution is that people have that resolves this crisis that we call a “government” without completely replacing it to begin with.

There’s a reason we have elections. It’s so we don’t have military coups and attempted rebellions on a regular basis. Oh, and we also don’t get the string of dictators and political executions that go along with that.

You are correct, we are replacing politicians with politicians. Abraham Lincoln replaced James Buchanan. Ronald Reagan replaced Jimmie Carter. Rudy Gulianni replaced David Dinkins. The 1994 Republicans replaced a Democrat controlled House.
In each case things changed for the better IMO. Rush pointed out it took conservatives 40 years “in the wilderness” educating, teaching, and informing to make 1994 happen.
Yes, you do see a ;ot of short term tactical comments here. I think this site helps people vent and yes we should be more strategically focused. However, what we have for a framework of government that is unequalled in the world. It will survive this as it always has, if we are willing to educate, inform, teach, and defend this way of life.

Now that Obama has solved that pesky oil spill and cleaned up the Gulf he is moving on to other important matters. Oh wait…
Let us look closely at what is happening.
The Secretary of State announces in a foreign country that the U.S. Government will challenge the Arizona SB 1070.
The Federal Government is prepared to revamp the “Detention Centers” where illegal immigrants are held into nice cushy quarters.
There are sections of the Arizona border that are closed due to incursions of illegals, drug smugglers, traffickers, etc.
The Federal Government has yet to call up the National Guard as indicated by President Obama two weeks ago.
Ok folks, we arm ourselves and show up at the National Wildlife Refuge (NWR)…This will immediately have the National Guard, Border Patrol, ATF and other agencies on the border. We get Sheriff Joe (the toughest sheriff in America) to set up a bunch of tent cities on the border to contain the illegals that are caught. The illegals are charged with criminal trespassing and held until cleared (90 days) or other charges are made, have them build the fence between Mexico and the United States, heck we cannot just have them sitting around. This is nothing we are not asking our young men and women to do in Afghanistan and Iraq; and they are in body armor and being shot at.
Now are you not glad Obama got elected an awoke the American Public.

There is just one thing I would add to your list. Give those who are there defending the border the authority to “shoot to kill”. The only way to deal with the drug cartel and other terrorists is to put some teeth into our laws and enforce them vigorously!!

The problem is these areas that are unsecure are not state land. The unsecure areas are federal land.
Have not heard anyone point out that what Hilary said, and what the left has consistently said, is NOT what SB1070 is. SB1070 does not write laws defining or determining immigration policy.
One of the reasons we in AZ welcome a law suit is what will be “sued” IS the actual law. Not what has been portrayed as the law by the left.
At the end of the day the left, Hilary, Obama and Holder will look stupid.
