Kagan confirmed under stormy skies in D.C.; Franken apologizes to McConnell for clowning around

Obama Supreme Court nominee Elena Kagan was confirmed by the Senate this afternoon.

USA Today breaks the vote down:

Only five Republicans voted in favor of Kagan’s nomination. Last year, just nine Republicans voted for Justice Sonia Sotomayor, Obama’s first Supreme Court appointee.

Today’s yes votes included Sen. Lindsey Graham, R-S.C., the lone Republican on the Senate Judiciary Committee to support Kagan when the panel recommended the nomination to the full Senate on a 13-6 vote. Other GOP yes votes came from Richard Lugar of Indiana, Olympia Snowe and Susan Collins of Maine, and Judd Gregg of New Hampshire.

Sen. Scott Brown, R-Mass, one of Kagan’s home state senators, voted against her.

The confirmation took place as a thunderstorm raged outside, prompting several wry Tweets as the votes were tallied:

When Senate Minority Leader Mitch McConnell laid out his opposition to Elena Kagan’s Supreme Court nomination, someone in the chamber appeared to be moving around in his chair, gasping and rolling his eyes.

It was Sen. Al Franken.

    Sure, I bet “they” are absolutely terrified. Riiight. I suppose if “conservatives” actually spent more time and energy engaged in the political process, which is to say, doing more than merely voting for the lesser of two evils in Presidential elections and doing more than just paying lip service to good non-R/D candidates during Congressional and local elections, then maybe “they” would have a reason to feel the slightest hint of dread.

    I actually take an optimistic outlook on Kagan’s confirmation.

    Why?

    Because when a case finally comes before the Supreme Court regarding Obama’s eligibility, any justice who was nominated by Obama would have a conflict of interest (if Obama is found to be a usurper, than so are they!), so they should be required to recuse themselves. Especially Kagan, who was involved in defending Obama.

    Obama is not a “natural” born U.S. Citizen, because he was not born subject exclusively to the jurisdiction of the United States. Regardless of whether or not he was born a U.S. citizen, he was undeniably born subject to the jurisdiction of Great Britain. His own web site admitted he was born a British subject.

    If we support and defend the Constitution, Obama will be removed from office as a usurper, and every action he has performed while usurping the office will be expunged.

    And that includes removing all judges and justices who were nominated by him.

    It also includes a repeal of Obamacare and everything else passed by this Congress and signed by this usurper.

    You all do realize, don’t you, that members of Congress did not request or inspect any birth certificate for Obama, right? They accepted as trustworthy the verdict of “Fact-Checking” groups. Despite the fact that those groups are biased and have been repeatedly shown to get their “facts” wrong.

    You might want to review that. But even if you don’t, please humor me and name even 1 out of 535 members of Congress who actually supported and defended the Constitution and even took the time to request and inspect a Hawaiian Birth Certificate for Obama.

    Even if you don’t believe the British subjecthood is relevant, surely you believe that if Obama’s birth narrative is fraudulent, then he has no right to hold that office, right?

    So who, among those Consitutionally charged with qualifying the President and Vice-President (see the 20th Amendment), has actually qualified Obama and Biden?

So far, more than 200,000 people have viewed that video.

    Army Col. Denise R. Lind will preside over the trial. Before becoming a judge, she served tours of duty both prosecuting and defending soldiers in court martial proceedings. She is a 1982 magna cum laude graduate of Siena College, and earned her law degree from Albany Law School in 1985. As Military Judge, she will decide all matters of law, including requests from the defense for discovery, and a motion the prosecution has said it will make to determine the lawfulness of the orders LTC Lakin is charged with refusing to obey. A “jury” comprised of Army officers will decide based on the facts whether Lakin is guilty or not guilty of the various felony-equivalent charges pending against him.

    In standing up for his convictions and in keeping with his training that illegal orders must be disobeyed, LTC Lakin has been widely praised for upholding the rule of law and the paramount supremacy in our society of the United States Constitution.

    Lakin is represented by military counsel, and by Paul Jensen, a civilian attorney from California who has been provided to him by the American Patriot Foundation, a non-profit group incorporated in 2003 to foster appreciation and respect for the U.S. Constitution, which has established a fund for Lakin’s legal defense.     No, the poll was that 58% either believed Obama was not born in the United States, or that he “may” have been born in the U.S., only 42 % believed he “was” born in the United States. Which is, of course, a separate but possibly related issue to not being a natural born citizen.

    I understand your concern, but cannot comprehend a situation that leaves America hostage to an illegal president because of fear of taking action. America would not exist as she has for 200 plus years with the kind of cowardice you speak of, and she will not exist in a form that is remotely like the America we love in the future if no one has the courage to do the right thing.     How many conservatives feel RealPolitik is the way to go here ? That’s what got us here in the first place.
