Kill the Obamacare 1099 tax mandate

By Michelle Malkin  •  January 13, 2011 11:17 AM

Yes, I said “kill it.”

Yes, it’s a “job-killer.”

And yes, thank goodness, the Republicans are not retreating.

Via The Hill:

Republicans signaled Wednesday that repealing a controversial tax provision in the healthcare law is one of their most pressing priorities.

House Republicans have re-numbered the bill repealing the tax requirement as H.R. 4, signaling it will be one of their first pieces of business.

The bill would repeal language requiring companies, starting in 2012, to report all goods and services transactions valued over $600 to the IRS. Republicans and Democrats, and even the White House, have since said they support repealing this language, which would raise $19 billion over ten years and was included to help pay for the healthcare law.

Rep. Dan Lungren (R-Calif.) had already introduced a so-called 1099 repeal bill, which was numbered H.R. 144. By bumping up that bill to H.R. 4, Republicans are making it clear that they will move this bill on an expedited basis. Traditionally, the House majority controls the first ten bills in Congress (H.R. 1 through H.R. 10), and usually reserves those numbers for high-priority items.

The bill has 12 Democrat co-sponsors and wide support across party lines. It is scheduled to be taken up after the full Obamacare repeal bill, H.R. 2.

Support bipartisanship: Repeal this Obamacare burden.

Also, on that same subject, what do you think Tom Donohue and the US CoC (Chamber of Commerce) are up to these days? Yes, they are STILL plugging for amnesty for illegals in the US. Some people just don’t get it.
Forget it Tom, the new group in the US House has made it clear: they plan on enacting REAL enforcement, get with the program or get pushed aside. It’s time to show the ‘US’ part in your organization’s name.

Absolutely. I see some states aren’t waiting for the Congress to act and are pushing for legislation within the states regarding the birthright citizenship issue.

I still believe the 14th Amendment has been deliberately misapplied to children of illegals.

    Yes it has, hawkeye54.

Read this issue of Imprimus from Hillsdale College. You will see that the intent of the legislators that wrote the 14th amendment was to not grant citizenship to children of illegal aliens.

Couple that with this from the case of Steward vs Kahn, 78 US 504: “The intent of the legislators constitutes the law.” The Supreme Court was clear on that.

The 14th amendment does not grant citizenship to children of illegal aliens born in this country.

For example, if my medical coverage paid for $100,000 of intensive care treatment at the hospital, would I get a 1099 for an additional $100K of income in that year, and be expected to pay tax on it? Or am I missing the boat?

Can’t the BLM ever get anything right.

The 1099 provision would not require reporting of “all goods and services transactions valued over $600 to the IRS”

    That’s already required of businesses.

The new requirement would require that the annual accumulation of smaller transactions be added up and submitted to the IRS. This is completely different from one time transactions of $600, and far far more onerous.

And since when does the media report revenue projections as absolute facts like this: “…which would raise $19 billion over ten years and was included to help pay for the healthcare law.” Normally they would identify that as an estimate or projection, not a fact.

I think I know why they are doing it. Once this and other things get changed in Obamacare, and the law inevitably costs much more and raises far less revenue than “expected”, the BLM can then turn around and blame the Republican tweaks, such as removing this 1099 provision.

The 1099s in Obamacare are all about giving the Obamacare bureaucracy the ability to create and operate a health care VAT tax without having to go thru Congress.

Without the 1099s in Obamacare, the Obamacrats working in the Obamacare bureaucracy would not have sufficient information to create a regulation that puts a ‘fee’ on every business transaction over $600 to keep Obamacare solvent — aka a healthcare VAT.

The Obamacrats may argue that Congress knew what it was doing when it added the 1099s in the bill, because it allows Obamacare to pay for itself. So expect some resistance to eliminating it by the left.

Actually you missed one BIG point with the new law.

Businesses do not have to report payments made to corporations (other than lawyer corporations) right now. The law changes that to every entity.

Go to the Apple Store and buy a computer for work. You’ll need to get a W-9 before doing so. (Granted, the IRS is thinking of a credit card exemption from the law change)
