US Appeals Court Rules Obamacare Individual Mandate Unconstitutional

The stampede to the health care law ending up in the lap of the Supreme Court rambles on:

The 11th Circuit Court of Appeals on Friday ruled that the health care reform law’s requirement that nearly all Americans buy insurance is unconstitutional, a striking blow to the legislation.

The suit was brought by 26 states — nearly all led by Republican governors and attorneys general. The Department of Justice is expected to appeal.

The panel partially upheld a ruling issued in January by Judge Roger Vinson, who struck down the entire health reform law. However, the 11th Circuit said that the rest of the legislation can stand even if the mandate is unconstitutional.

The Obama administration now has 90 days to either ask the 11th Circuit to review their decision, or they can appeal to the Supreme Court. Or they might decide to put their hands over their ears and yell “la la la la I can’t hear you la la la la” and ignore it the way they’ve done with other rulings. We’ll see.

    Can someone explain what IS Obamacare without the individual mandate? It seems maybe it’s the bottom card of the house of cards because insurance rates will skyrocket if the only people left buying insurance are those with a pre-existing condition. That will decimate the health insurance industry prompting many of us to just pay our doctor and other medical bills directly as well as give to private charity to help out those who get hit harder than they can afford. Perhaps many doctors will again also start participating in free clinics as they used to back when they weren’t spending all their ‘free time’ filling out insurance forms?

    Nothing would make me happier than to see the totally wasteful health insurance ‘industry’ LOSE its grip on health care and return to the days when doctors and health professionals were rewarded for quality not quantity.

    Congress has no authority to require American citizens to purchase any product or service. A better case could be made that everyone be required to purchase a gun, as the 2nd Amendment and US Code describe us all as the militia.
