Jackboot Watch update: Federal charges against grizzly shooter dad dropped after uproar, but…

By Michelle Malkin  •  September 8, 2011 09:11 AM

A week ago, I spotlighted the persecution and attempted prosecution of an Idaho man who shot a grizzly bear to protect his family. Local and state officials determined he did nothing wrong — and in fact, went out of his way to alert authorities.

Nevertheless, the warped U.S. Attorney’s Office moved to put him on trial in October.

Here’s the good news: The eco-zealous feds have backed off and dropped the charges.

Here’s the bad news: They made Hill pay a $1,000 fine.

Why?

The U.S. Attorney’s Office has dropped misdemeanor charges against a Porthill, Idaho, man who shot and killed a grizzly bear in his yard.

Instead, Jeremy M. Hill was issued a citation for the May 8 shooting of the male grizzly, and paid a $1,000 fine.

A press release issued by the U.S. Attorney’s Office said that state and federal wildlife officials were unable to establish the location of Hill’s children when three grizzly bears were first sighted in the yard, about forty yards from the Hill home. Hill told law enforcement officers that he last saw his children outside playing basketball in front of their home, but that he didn’t know where his children were when he saw the three grizzly bears near his pig pen. The two other bears ran off after Hill shot the 2-year-old male.

U.S. Attorney Wendy J. Olson said that dismissal of the criminal charge was based in part on Hill’s prompt notification of the shooting to Idaho Fish & Game officials.

“The United States Attorney’s Office well understands Mr. Hill is a concerned husband and father who wants to protect his family,” said Olson. “Anyone who observes or hears of a grizzly bear near campsites or residences must immediately contact fish and wildlife officials.”

Hill says he just wants to put the whole thing behind him:

Hill didn’t return a call seeking comment.

However, in a written statement he said, “I am thankful that the government has dismissed all criminal charges against me in this case.”

He said he paid the fine to avoid putting his family, which includes six children, through the emotional strain and the cost of a trial.

“I am glad this issue has been resolved out of court and I am looking forward to putting this unfortunate incident behind me,” Hill said.

It is a damned shame that the feds extracted a fine from him in these hard economic times and made an example of him after making his life hell for defending his property and family.

Warped green values at work.

The crime here is the shakedown by the federal government of this kind and obviously sound-minded family man.
He made an understandable decision not to offer himself on the altar of making a point…albeit a righteous point…at the expense of his family’s peace and pocketbook, for defending against federal charges would have cost far more than $1k.
For that, I am even more impressed with him than I was before.

I have seen this before. Many times when someone is being squeezed by some local govt. or agency it is not the whole organization coming down on someone but usually just one or two people who says to themselves “We could let this go but just to be safe let’s start an investigation.”
That way it then is taken out of that person’s hands and they just slink away or act as if they are sympathetic but there is nothing they can do when in fact they could have stopped it before it started.
It costs them nothing to put someone through what could be a very expensive legal process and many times they will do it because they have nothing better to do.

I have a close family member that was intimately involved in this kind of wildlife work, and I am 100% certain he would be laughing at the suggestion that such an operation could be executed in a matter of minutes (probably even a few hours). More typical, a 4-6 hour prep time would be considered a very good response (depending on location), but one day would be considered ‘normal’.

My guess is that although he’s gone through a lot of hassle, Mr. Hill will be able to recoup the fine. Whether the fine was $100, $500, $1,000, or more, I believe that it’s the principle of the whole thing that is disturbing. I believe it would be poetic justice for the Republicans to significantly reduce funding to DFW and fine them for their obnoxious behavior.

We conservatives ate so afraid of the “conspiracy nut” label that we don’t look for patterns. Indeed, we eschew seeing them even when they’re painted in glowing flashing neon – with klaxons and disaster-whistles sounding all around it!

I wouldn’t be surprised if the actual number of self-defense cases involving humans or animals is MUCH HIGHER than reported, especially in jurisdictions with this kind of insanity leveled toward the victim.

Yeah right. And then they can show up later, speed dial your number, and find the pile of bear crap that was once you, with a intact cell phone in it.

Oh, they made him pay the fine so they would be able to say “We let him off because of all the publicity…..but we were still right.”

I had posted before that the jerk U.S. Attorney should be covered in honey, huckleberries and pine nuts, then dropped in bear country. Now, if you add bacon bits and break her leg, you have a heck of a PPV event. Maybe we could make bets in Vegas to see how long the idiot lasts. Make your bets, ladies and gentlemen! Oh, well, you can only dream…

To be fair, if he selfishly hadn’t had children – they wouldn’t have been outside to begin with.

And the pigs? Why doesn’t he guzzle cheeseburgers and shakes like the first lady instead of raising his own food like some sort of entrepreneurial capitalist pig?

“It seems unjust to me that someone would be charged when they were protecting their family,” state Sen. Shawn Keough, R-Sandpoint, said after the hearing. “I’m at a loss to understand why the U.S. government is pursuing this in the manner they are.”

After shooting the grizzly with a bolt-action rifle, Hill contacted the Idaho Department of Fish and Game.

“Jeremy did the right thing, he called Fish and Game,” Keough said. “I think that prosecuting this case really sets back the grizzly bear recovery effort. … People are saying, ‘Boy, if that happened to me, there’s no way that I’d report it.’ That’s a human reaction.”(emphasis added)

After learning about this incident, you can bet people won’t be calling Fish and Game if they have to shoot a threatening bear. This idiot Olsen has actively discouraged people from complying with the law.

According to her bio, she had very little actual trial experience before she was appointed US Attorney. but you can bet she has impeccable liberal credentials. I don’t see any connection to eco-zealotry, animal rights groups or anti-gun groups, but we all know how most liberals view those issues. Her actions in this case suggest she has a serious common-sense deficiency, at the very least.

Actually don’t break her leg….make it more sporting for the bear. It’d be exciting to see her fear as she unsuccessfully attempts to outrun a griz.

I’d don’t use PPV much, but I’d pay to see such a deserving eco-zealot earn her just reward.

    Remember, language matters.

Mr Hill was a political prisoner.

Otherwise law-abiding citizens who are arrrested by the leftist nitwits for breaking the tiniest bit of the arcane laws and regulations pushed on us by the leftist nitwits are political prisoners.

(These are the same nitwits who refuse to prosecute the real criminals, violent felons, repeat offenders, etc.)

Language matters. The left has mastered this. We have a lot of catching up to do on that front. Choose your words carefully, not just for denotation, but for connotation and implication.

    denotation
(logic, linguistics, semiotics) The primary, literal, or explicit meaning of a word, phrase, or symbol; that which a word denotes, as contrasted with its connotation; the aggregate or set of objects of which a word may be predicated.

    connotation
A meaning of a word or phrase that is suggested or implied, as opposed to a denotation, or literal meaning. A characteristic of words or phrases, or of the contexts that words and phrases are used in.

    SHOOT, SHOVEL & SHUT UP.

I first read about the “Shoot, shovel and shut up” advice in regard to some California property owner who was in a dispute with authorities over planned property development where some ‘endangered’ critter was discovered. The advice was too late for the landowner in the dispute, but was offered to others that were contemplating similar developments.

I believe it could apply here as well.

And that gives them the power to fine him? I thought that under the principles of our legal system, they had to prove he and his family were not in danger, and that his act was overtly criminal?

Oh, wait, I’m accusing government of requiring “principles”. My bad…
