Defense Department: No Purple Hearts for Fort Hood victims because it could jeopardize Nidal Hasan’s chance at a fair trial

It’s been over three years since witnesses say Nidal Hasan shouted “Allahu Akbar” before killing more than a dozen people and injuring well over twice as many at Fort Hood. Even though FBI and congressional investigations found the shootings to be an act of terrorism, the Obama administration categorized the attack as “workplace violence.”

The move to prevent those killed and injured at Fort Hood from being awarded Purple Hearts seems to be about saving the administration from having to admit the attack was not “workplace violence,” even though the Defense Department claims the reason is that giving Purple Hearts to Fort Hood victims could taint Nidal Hasan’s chance at receiving a fair trial:

Legislation that would award the injured from the 2009 Fort Hood shooting the Purple Heart would adversely affect the trial of Maj. Nidal Hasan by labeling the attack terrorism, according to a Defense Department document obtained by Fox News.

The document comes following calls from survivors and their families for the military honor, because they say Fort Hood was turned into a battlefield when Hasan opened fire during the November 2009 attack. Fox News is told that the DOD “position paper” is being circulated specifically in response to the proposed legislation.

The document reads in part:

“Passage of this legislation could directly and indirectly influence potential court-martial panel members, witnesses, or the chain of command, all of whom exercise a critical role under the Uniform Code of Military Justice (UCMJ). Defense counsel will argue that Major Hasan cannot receive a fair trial because a branch of government has indirectly declared that Major Hasan is a terrorist — that he is criminally culpable.”

A source with knowledge of the position paper told Fox News that DOD is putting on a full-court press by sending senior officials, including generals, to meet with lawmakers in an effort to block support.

I guess if they want medals they’ll have to learn how to remotely fly drones.

In the days since 9/11 and the “War on Terror,” thousands of Purple Hearts have been awarded, and that didn’t prompt anybody in this administration to seek a moratorium on handing them out so as to not prejudice potential jurors while Eric Holder was trying to line up civilian trials for Khalid Sheikh Mohammed and others. What gives?

The “workplace violence” label for the attack has additional adverse impact:

Munley and dozens of other victims have now filed a lawsuit against the military alleging the “workplace violence” designation means the Fort Hood victims are receiving lower priority access to medical care as veterans, and a loss of financial benefits available to those whose injuries are classified as “combat related.”

Question of the day: “In the Army, your workplace is the battlefield. So shouldn’t they get Purple Hearts even if this is workplace violence like the brassheads want everyone to think?”
